BRUSH SHALL 3E CLEANED OR REMOVED AND PROVIDING ;.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF EDGEWATER,
FLORIDA:
SECTION 1. That pursuant to Chapter 2265 No. 751 (Senate
Bill No. 364) of the laws of the State of Florida, wherein
authority was granted to the Town of Edgewater to assess costs
of lot cleaning and trash and brush removal against the lands
from which such trash or brush shall be cleaned or removed
and providing for the collection of these costs when this
Ordinance is hereby enacted.
SECTION 2. The Town Council of the Town of Edgewater, Florida,
shall assess each year the cost of cleaning or removing trash
or brush from any lot in the Town of Edgewater against such lot
or land so cleaned or frog which such trash or brush shall have
been removed. The amount of such assessment shall be reasonable
and shall be based upon actual time spent by the employees of
the Town of Edgewater in said work and in a rate of compensation
not in excess of the prevailing real wage in said community in
said work.
SECTION 3 . Such work shall be under the supervision of either
the Town Marshal, or the Town Street Supervisor, or other officer
duly designated by the Town Council for such purpose.

It shall be the duty of such officer in charge of such
work to keep an accurate per hour time book of the men engaged
in such work and to file with the Town Clerk each week a report
of such work together with the correct legal description, as
the same appears in the Town Assessment Roll for that year of
the lot or lands upon which such work shall have been done.
The basis of such Payment shall be uniform in each year
and the report of such officer shall be used by the Town Clerk
in preparing the assessment to be entered as hereinafter pro-
vided against each said lots or pieces of land.
SECTION; 4. The Town Clerk of the Town of Edgewater shall keep
a permanent record book in which he shall enter the name of the
owner of the property upon which such work shall have been done,
and the description of said Property as said name and descrip-
tion appear on the assessment Rolls of said Town, and shall enter
under said name a statement showing the work done on said property,
and the amount charged thereafter, and the time consumed in the
performance of such work as the same appear on the record required
to be filed with him under Section 2 of this Ordinance.
Annually each year, and before preparing the list of delin-
quent taxes the Clerk shall extend on the Tax Roll of the Town
of Edgewater in a column to be provided for that puroose under the
heading "Lot Cleaning Assessment", and opposite the name and desc-
ription of the property herein referred to, the amount of such
assessment as the same shall have been computed by him.
Annually each year it shall be the duty of the Town Clerk
at the same time property is sold for delinquent taxes to sell in
the same manner provided for delinquent tax sales, such lands upon
which such lot cleaning assessments shall not have been Paid,
and if the taxes assessed by said Town shall have been paid
said Clerk shall issue a Tax Sale Certificate for the amount
only of such lot cleaning assessment, but if the taxes shall
not have been paid then said Clerk shall enter on the regular
tax sale certificate in a separate item the amount of such lot
cleaning assessment. Such tax sale certificate shall carry
with it all of the attributes, rights, and privileges of the
usual Town Tax Sale Certificate, and where separate lot cleaning
certificate is issued the same shall be in a form similar to the
usual tax sale certificate.
S-CTICN 5. Prior to entry of such lot cleaning assessment on
said Tax Roll, and within ten (10) days after the receipt of the
Town Clerk of the Officer' s report of such lot cleaning the Town
Clerk shall notify the -)i•:-ner of said property as the name appears
on the Assessment Roll for that year, of the fact of such assess-

ment, which Notice shall advise such property owner that said
property may be sold for non-payment of such assessment. Such
Kotice shall be by Registered Mail, or may be delivered personally
by the Town Marshal to such property owner, or if the address cf
such property owner by not known then such Notice may be posted
on the premises and a copy thereof posted at the Town all or such
Place as shall he used by the Town Council of said Town for holding
its regular meetings. Upon receipt of such notice and within
thirty (30) days after mailing the same the owner of such Property
shall have the right to appeal to the Town Council to revise or -
adjust such assessments and the Council shall have the power to
revise of adjust the same.

SECTION 6. Prior to entering upon any property for the pur-
pose cf cleaning same, or removing therefrom trash, or brush
by any employee of the Town of Edgewater the Town Council shall
first determine whether the condition of such property constitutes
a fire hazard, or a menace to the health and safety of the Public,
and if said Council finds that the condition of said property does
constitute such fire hazard, or menace, then it shall cause Not-
ice in writing to be served upon such property owner, calling his
or her at .ention to the condition of said premises and requiring
that the same be cleaned within a Period of fifteen (l5) days
from the date of the service of such Notice.
The Notice herein provided for shall be served in the manner
provided in the preceeding Section of this Ordinance. If said
property owner shall fail to comply with said :c:ctice then the Town
Council shall have the authority to order that said lot be cleaned,
or said trash, or brush be removed therefrom.
SECTION 7. All Ordinances or parts of Ordinances in conflict
herewith be and. the same are hereby repealed.
SECTION 8. This Ordinance shall take effect immediately upon its
passage and approval by the :.ayor.
The above ordinance was read in full and passed by the unanimous
vote of the Town Council of the Town of Edgewater, Florida at a
regular meeting on the 22nd day of March, A. D. 1950•
Upon motion duly made, seconded and unanimously carried, the
requirement of reading said ordinance upon second reading was
waived and the ordinance was ordered put upon final passage.
Passed by the unanimous vote of the Town Council of the Town of
Edgewater, Florida at a regular meeting of said council held on
the 22nd day of March, A. D. 1950, and approved as provided by
law, the vote of said council on roll call being as follows:
