ORDINANCE NO. 173
AN ORDINANCE ADOPTING AS THE CITY SANITARY CODE THE RULES
AND REGULATIONS PROMULGATED BY THE FLORIDA STATE BOARD OF
HEALTH, PURSUANT TO CHAPTER 381, FLORIDA STATUTES, 1941,
AND AMENDMENTS THERETO, KNOWi'; AS "THE SANITARY CODE OF THE
STATE OF FLORIDA"; AND PROVIDING A PENALTY FOR THE VIOLATION k� ""+

WHEREAS Section 381. 53 3 , Florida Statutes, 1941, � �
3 53 of Chapter 81 � 1
and amendments thereto, provides that the Sanitary Code of the State
of Florida shall, as to public health matters to which it relates,
supersede all ordinances heretofore or hereafter enacted, and
WHEREAS it appears to be tc the best interest of the citizens
of the Town of Edgewater, Florida to adopt said State Sanitary
Code as the City Sanitary Code,
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF EDGEWATER, FLORIDA:
SECTION 1: That the rules and regulations now promulgated or
hereafter promulgated by the Florida State Board of Health, pursuant
to Chapter 381, Florida Statutes, 1941, or any amendments thereto,
known as "The Sanitary Code of the State of Florida" is hereby adopted
as the Sanitary Code of the Town of Edgewater, Florida.
SECTION 2: Any person, firm or corporation violating within
the corporate limits of the Town of Edgewater, Florida, the provisions
. of the State Sanitary Code or of this Ordinance shall be punished,
upon conviction thereof, by a fine not exceeding $500.00, or by
imprisonment in the city jail for a period not to exceed 60 days,
or both, such fine or imprisonment in the discretion of the Mayor.
SECTION 3: All ordinances or partes of ordinances in conflict
herewith are hereby repealed.

SECTION 4: The provisions of this Ordinance are severable
and if any section, sentence, clause or phrase thereof is, for
any reason, held to be unconstitutional or invalid, the decision
of the Court shall not affect the validity of the remaining portions
of this Ordinance.
SECTION 5: This ordinance shall take affect immediately upon
its passage and approval by the Mayor.
The above ordinance was read in full and passed by the unanimous
vote of the Town Council of the Town of Edgewater, Florida, at a
regular meeting on the 26th day of April, A. D. 1950.
Upon Notion duly made, seconded and unanimously carried , the require-
ment of reading said ordinance upon second reading was waived, and
this ordinance was ordered put upon its final passage.
Passed by the unanimous vote of the Town Council of the Town of Edge-
water, Florida, at a regular meeting of said Council held this 26th
day of April, A. D. 1950, and approved as Provided by law, the vote
of said Council on roll call being as follows:
