BE IT ORDAINED BY THE TOT COUNCIL OF THE TC1N OF EDGEWATER,
FLORIDA:-
Section 1. That from and after the date of this Ordinance ,
any person, firm or corporation seeking to construct a ditch
on, along or across any street or thoroughfare in the Town
of Edgewater, Florida and any person, firm or corporation
desiring ,to erect poles, wires, pipes, conduits, sewers or
drains on, along across or under said highways and any per-
son, firm or. coyporation desiring to erect on or along said
highways any temporary structure of any kind within the street
or thoroughfare area shall first obtain a permit therefor
from the Town Clerk of the Town of Edgewater, Florida upon
written application therefor filed with said Clerk. Such
application shall describe fully the nature of the work plan-
ned by the apulicant. Provided however that no such permit
shall be granted if the proposed work shall result in the
obstruction of any street or thoroughfare for a period of
over geven days, any provided further that an extension
of such permit may be obtained on good cause for an addit-
ional period of three days. For said permit a fee of fifty
cents shall be charged.

Section 2. All such permits shall be conditioned upon the
grantee thereof agreeing to repair any damage to said street
or thoroughfare caused by said work and upon the said grantee
placing said street or thoroughfare in as good condition as
the same was before said permit was granted; and in any case
where such application for permit is made, the said Town Clerk
by and with the approval of the L.ayor of said Town shall have
the authority to require a bond to be furnished to said Town
of Edgewater with one or more sureties to be approved by the
Layor of said Town, conditioned to indemnify and save harmless
said Town from any expense which it might be put to in repair-
ing such street or thoroughfare and likewise to indemnify and
save harmless said Town from any damages which it might sustain
and from any suits or actions for damages sustained by any third
parties as a result of said work, the amount of such bond to be
fixed by said Mayor. Provided, however, that public utilities
authorized to do business and having property located within
the corporate limits of the Town of Edgewater shall not be re-
quired to furnish a bond or .other sureties to procure a permit
to do work in the streets as provided for in this Ordinance ,
but all other terms and conditions of this Ordinance shall be
applicable to such public uti pities.
Section 3. Any person found guilty in the mayor' s Court of
said Town of violating any of the provisions of this Ordinance
shall be punished by fine not exceeding CND HOrn_➢REt) Dollars,
or imprisonment in jail not exceeding ‘0 days or both
in the discretion of the Mayor's Court of the said Town of
Edgewater, Florida.
Section 4. This Ordinance shall take effect immediately
upon its passage.
This Ordinance was read in full and passed by the
unanimous vote of the Town Council of the Town of Edgewater,
Florida, at its regular meeting on the 1st day of April, A.D.
1941.
Upon motion duly made , seconded and unanimously
carried the requirement of reading this L'rdinance upon second
reading was waived and this Ordinance was ordered put upon its
final passage.
Passed by the unanimous vote of the Town Council
of the Town of Edgewater, Volusia County, Florida, and ap-
proved as provided by law on this 1st day of April, A. D. 194L
