05-27-1981 . u ~ CITY OF EDGEWATER BOARD OF ADJUSTMENTS REGULAR MEETING May 27, 1981 Chairman Millard called the regular meeting of the Board of Adjustment to order at 7:00 P.M. in the City Hall conference room. ROLL CALL Mr. Millard Mr. Wetzel Mr. Roush Mrs. Martin Mrs. Walker Mr. Butt Mr. Newell Present Present Present Present Present Present Present APPROVAL OF MINUTES Chairman Millard asked for any questions or corrections to the minutes of the April 22nd meeting. There were none, Chairman Millard declared the minutes approved. COMMUNICATIONS Chairman Millard asked Mr. Wetzel to explain his findings to the board in regard to Mr. Wharton's complaint. Mr. Wetzel stated, as in his memo to the board, that the question remains as to what is Mr. Schick's legal address. Chairman Millard restated the issue at hand and explained that the Board of Adjustments actually has no jurisdiction concerning this matter. The Building Official has stated that there is no violation. Mr. Wharton explained all of the improvements that have been constructed. He stated that Mr. Schick is renting part of this to other people and he still has an apartment for himself. This is being used as a duplex. Chairman Millard went over the information on file. He explained that the board cannot have a proper hearing without having both parties present. There are still some facts that need to be determined before the board can vote on anything. Mrs. Martin suggested that Mr. Murphy be asked to give the board all of the information regarding the ownership of the land on Riverside Drive. Chairman Millard asked Mr. Wharton if he would be satisfied if the tax roles show that Mr. Schick owned the land up to Riverside Drive and that was his legal address? Mr. Wharton stated no,besides the setback violation, the house is being used for two separate families. He went over the history of the land ownership, and stated that he does not believe that Mr. Schick owns the land all the way up to Riverside Drive. It was explained again to Mr. Wharton that the board must have more facts. Chairman Millard instructed the recording secretary to issue a memo to the City Attorney asking that he furnish the board with the following information: 1. Is Carlson Cove a public or private road? 2. Can someone have a private road as their legal address? 3. Does Mr. Schick own the land between his house and Riverside Drive? - o o . Chairman Millard explained to Mr. Wharton that the board must have the answers to these questions and that both concerned individuals will have to be present at the meeting before the board can vote on this matter. Mr. Wharton stated that he just wants what is right, he feels that we are not getting proper protective inspections. Chairman Millard stated that he feels that Mr. Murphy is a reputable official of the City. This board has to look at the facts that are presented to them. OLD BUSINESS Chairman Millard asked the board members to turn to Article IX of the Code of Ordinances that they received prior to the meeting. He explained that this is the section explaining the Board of Adjustments. He also stated that the Appendix A, Zoning is very important and the members should be familiar with these sections. At this time Chairman Millard went over his changes to the Rules and Procedures to be followed by the board. There being no objections to his changes, this will be typed up by the secretary and returned to all of the board members before the next meeting. The board members were asked if they would come into City Hall to pick up their material rather than have the packages mailed to them. The secretary will call each member when the packages are ready.
