Motion by Alice Haldeman, second by Sherry Lester to approve the minutes of the
August 13,2015 Code Enforcement Board meeting.

Officer Kevin Pogany presented the case to the Board. Charles Breuilly of 2503 Glenwood Dr.
Edgewater, FL stated that due to the price for the engineering to be done on the property he figured
he would sell it and/or get rid of it. Code Supervisor Capt. Lariscy stated that any type of fill would
need a permit. The Chairman closed the public hearing. The Chairman reopen the public hearing.
Mr. Breuilly requested an additonal 30 days.
A motion was made by Ed Corn, second by Sherry Lester to find in violation of Sec.
21-53.02, delay the daily fines for seven days; fines will start on September 18th if the
material is not removed. If the City remove the material then you are responsible for the
cost incurred to remove the material. The MOTION was APPROVED by the following

Chairman Ben Wagner read the above listed cases and concluded with it appears after reviewing
these cases that no one was present for any of the cases just read. Pursuant to Section 10-348 and
10-345 subparagraph C 11 of the Code of Ordinances and the statement that appears on the
respective citation issued that failure to appear at the hearing means the alleged violator has waived
any right to contest the violation and that an order can be made for the maximum applicable
penalties that include but are not limited to administrative costs, fines, daily fines and liens. Since,
however we have the benefit of the staff recommendations, the Board shall entertain motions and take
whatever actions are deemed appropriate.
A motion was made by Sherry Lester, second by Alice Haldeman, to find the cases in
violation and follow staff recommendation. The MOTION was APPROVED by the

7. APPOINTMENT
a. AR2015-1091 Appointment of Chair and Vice Chair for the Code Enforcement Board.
Chairman Ben Wagner opened the nomination for Chair and Vice Chair. A nomination was made
for Ben Wagner as Chairman and no other nomination were presented.
A motion to appoint Ben Wagner as Chairman of the Code Enforcement Board was made
by Alice Haldeman, second by Ed Corn. The following vote was approved by:

8. CODE COMPLIANCE REPORT
Code Supervisor Capt. Jeff Lariscy stated that for the month of August there were 179 new cases, 290
working cases and 126 resolved cases.
