10-22-1980 Public Hearing , -. u Q CITY OF EDGEWATER BOARD OF ADJUSTMENTS PUBLIC HEARING October 22, 1980 Chairman Louise Martin called the Public Hearing to order at 7:00 P.M. in the Edgewater City Hall. ROLL CALL Mrs. Martin Mrs. Kane Mr. Sloan Mr. Lupinek Mrs. Walker Present Present Present Absent Present Mrs. Martin explained that the purpose of this Public Hearing is to consider the following requests: Paul D. Roche - Special exception for multi-family residence Robert G. Howard - Special exception for multi-family residence Charles E. Wheaton - Requesting a variance Thurman M. Houghton - Requesting a variance Robert Webster - Requesting a variance The board reviewed the first application. Mr. Paul D. Roche of 236 N. Ridgewood, is requesting a variance to construct multi-family units in the B-3 zoning district. The legai description is the Southerly 180.75 feet of Lot 18, Assessor's Subdivision of the Alvarez Grant as shown on map in Map Book 3, page 137 of the Public Records of Volusia County, Florida, except that part now in road R/W and the South 95 feet of the north 165 3/4 feet of Lot 18, Assessors Subdivision of the G. Alvarez Grant in Edgewater, Florida, according to map in Map Book 3, page 137 of the Public Records of Volusia County, Florida, except that part now in road R/W. Mr. Roche and his builder, Mr. Slaney both discussed this with the board. They answered various questions that the board members had to ask. There were no objections from qdjacent property owners. Mr. Sloan made a motion to gpant this special exception, provided it meets all the requirements of the zoning regulations, being seconded by Mrs. Kane. Upon roll call vote, the motion CARRIED 3 - 1. M r s. Wa 1 k er v 0 tin g NO. It is the board's understanding that the site plans will be reviewed by the Zoning Board, Planning Department, Water and Wastewater Departments, Fire and Police Chiefs. Mr. Robert G. Howard, Architect of P.O. Box 280, New Smryna Beach, representing Barbara Bourdeaudhui who is requesting a special exception to build an apartment complex at the corner of Park Avenue and Old County Road. The legal description is Lot 1-10 inclusive, Block 1, Fuller & Settle Subdivision, Alvarez Grant Per Official Records Book 2088, page 600 of the Public Records of Volusia County, Florida. Mr. Howard spoke to the board in regard to this request and answered various questions from the board members. There were no objections from adjacent property owners. ~ Q Mrs. Walker made a motion to grant the special exception, being seconded by Mr. Sloan. Upon roll call vote, the motion CARRIED 4-0. Mr. Charles E. Wheaton for a 20 foot setback instead of a 40 foot setback on Woodley Avenue. The legal description is the Northerly 108.5 feet of Lots 258,259,260,261 and 262, except the Westerly 34 feet of Lot 258 now in road right-of-way/Ridgewood Avenue, U.S. Highway No.1, Hawks Park as shown on map in Map Book 15, page 93 of the Public Records of Volusia County, Florida. Mr. John Wilbur was present representing Mr. Wheaton. He answered various questions from the board members. There were no objecttons. Mrs. Kane made a motion to grant him a 8.1 foot variance on Woodley and an 8.1 foot variance on Connecticut, being seconded by Mrs. Walker. Upon roll call vote, the motion CARRIED 4-0. Mr. Thurman M. Houghton of 124 Parkwood Lane is requesting a seven foot variance on the side setback in order to enclose a carport. The legal description is Lot #6, Parkwood Subdivision. Mr. and Mrs. Houghton were present and answered questions from the board members. There were no objections from any neighbors. Mr. Sloan made a motion to grant the six foot front setback variance; this will conform with the structural appearance of the existing building, being seconded by Mrs. Kane. Upon roll call vote, the motion CARRIED 4-0. Mr. Robert Webster is requesting a variance to change ten resi- dential lots into six building lots. The legal descripting is Lots 2,3,4,5,6,25 and 26, Block D, Section 1, Highland Shores, per Map Book 9, page 63, Public Records of Volusia County, Florida and Lots 27,28 and 29, Block D, Section 1, Highland Shores Subdi- vision as shown in Map Book 9, page 63 of the Public Records of Volusia County, Florida. Mr. Webster was present and answered questions from the board members. There were no objections from adjacent property owners. Mrs. Kane made a motion to grant the variance for six building lots with a ten foot variance on the depth of each building site, being seconded by Mrs. Wa1ker. Upon roll call vote, the motion CARRIED 4-0. ADJOURNMENT Mr. Sloan made a motion to adjourn the Public Hearing, being seconded by Mrs. Kane. Said motion CARRIED 4-0.
