BOARD OF ADJUSTMENT PUBLIC HEARING
February 27, 1980
Chairman Louise Martin called the Public Hearing to order at 7:00 P.M.
in Edgewater City Hall.
ROLL CALL

The first application for a variance was from Mr. and Mrs. Ronald Miller,
148 W. Ocean Ave. The Millers were requesting a side setback of 16~'
to put a garage in the back of their propertj. The property is a corner
lot and the ~equired side setback is 30.. The property is located in
the R-3 Zoning District. He alsoreq~ested a 21 rear setback variance.
Mr. Miller pointed out to the Board that they would like to keep some
of the trees in their backyard and also have a better view from the
back porch than the side of a garage.
Mr. Lupinek said that he had checked out the property and felt that 16~'
was too close to the road. The distance must be measured from the
property line. He suggested that the Board consider granting a 20. side
setback (a va~iance 6f 101). This would still be 10' less than the
required setback.
Mr. Miller stated that he really didnlt need a variance because he had
enough room to meet the R-3 requirements. He had come to the Board
because he wanted a better looking backyard and he felt he would be in
line with the other houses in the neighborhood.
Mrs. Kane .told Mr. Miller that the Board of Adjustment had been established
primarily to give relief from some of the requirements of the zoning
ordinance in cases where there was a real hardship for the property oW~er.
It appeared that Mr. Miller did not actually have a hardship but in
the interest of giving the Millers more backyard space she felt that the
suggestion of M~. Lupinek was a reasonable solution.
Mrs. Walker. said that she had not been able to find this property but
that she had studied the drawings and plot plans. She also agreed with
the 201 side setback. .
Mrs. Martin told Mr. Miller that just because other houses were closer
to the street did not mean that the Board used this as a criteria. Most
of these homes were obviously built before the zoning ordinance was
passed but in granting variances the Board tries to come as close as
possible to existing zoning requirements rather than go by what was allowed
beforeithe zoning ordinance was passed.
Mr. Lupinek made a motion that the Board grant a 101 variance on a side
setback for Mr. Miller which would allow him to build the garage 20' from
the property line. The Board would also allow a 21 variance in the
rear yard to allow the garage to be built 181 from the rear of the
property. Mrs. Walker seconded the motion.
Upon roll call the motion CARRIED 3-1. Mrs. Kane voted NO.
Mr. Miller said that if he could not have the 16~. variance he did not
want any variance.
Mrs. Martin instructed the secretary to notify the Council of action .
taken by the Board on this application and that the applicant had refused
the variance. She did not believe any further action by the Council
would be necessary.

The second ap~lication was from Mr. Glenn Jones, 346 N. Riverside Dr.
(R-1) for a 71 variance to build a 10' x 201 addition to his garage.
Mr. Jone's house faces Riverside but the garage faces Rio Vista. .
The variance would be a side yard setback because of the way the property
is laid out. The present garage which was built before the Zoning Ord.
is located 31 from the property line. Mr. Jone's wants to line up the
addition with the present garage so that the addition would also be 31
from the pr~perty line.
There were no objections from the abutting property owner.
Mrs. Walker made a motion that the Board grant the 71 variance and allow
Mr. Jones to build the garage addition 31 from the side :property line.
Mrs. Kane seconded the motion. Upon roll call the motion CARRIED 4-0.
A letter will be sent to Council requesting their approval of this
variance.
The final application was from Mr. Lawrence Lucht, 2103 W. Sunnyside Ave.
Chicago, Ill. who is requested a variance on that part of Lot 13, Block
B, Turgot Terrace .that is located east of S. Riverside Drive (R-1A) at
the corner of Riverside and Turgot. Mr. Lucht requested a 101 side
setback off Turgot, a 161 rear setback on the S. E. corner and a 271
rear setback on the N.E. corner. Corner plots require a 301 side setback
and the rear setback should be 30'. The Board would have to grant
a 201 variance on the side setback, a 31 variance on the N.E. rear corner
and a 141 variance on the S.E. rear corner. The front setback in R-1A
is 401.

The Board agreed that granting of these variances would result in a.
lot that is too small for this area. This area is part of a single lot
of record and there is sufficient room on the part of the lot that is
located west of Riverside to build.
Mrs. Martin made a motion that the Board deny this request because this
portion of the property is not of sufficient size to build on. Mr.
Lupinek seconded the motion. Upon roll call the motion CARRIED 4-0.
A letter will be sent to the Council requesting they approve the denial
of this application.
The Public Hearing was adjourned.
Mrs. Martin called the regular meeting of the 'Board to order.
Mr. Lupinek made a motion to approve the minutes of January 23, 1980
and the Special Meeting of February 4, 1980. Mrs. Kane seconded the
motion. Upon roll call the motion CARRIED 4-0.
Mr. Lupinek brought up the subject of the inspection of properties
where variances had been requested. He called attention to the increased
cost of gasoline and the fact that this responsibility of the Board
members has become more costly. He suggested that the Board ask the
Council for some reimbursement for the expenses incurred when the members
have to travel.around the City inspecting various properties.
Mr. Lupinek made a motion that the Board send a letter to the Council
requesting some reimbursement for travel expenses. Mrs. Walker seconded
the motion. Upon roll call the motion CARRIED 4-0.
The meeting was adjourned.
