APPROVAL OF MINUTES-None at this time. 3. PRESENTATIONS!PROCLAMATIONS/PLAQUESICERTIFICATES/DONATIONS a. AR-2015-135 Proclamation to Boston Whaler, Inc. proclaiming December 7, 2015 as Boston 7 Whaler,Inc.Day This Presentation was received and filed. 4. CITIZEN COMMENTS Bob Andrejoviks, 331 Admiralty Court, thanked the Mayor and Council, City Manager, all departments, and all personnel that work for the city of edgewater, for keeping Edgewater beautiful all year; and wished everyone a very Merry Christmas, a happy and healthy New Year, and that 2016 be prosperous for all. Michael Visconti, 316 Pine Breeze Drive, thanked the Mayor and Council for the beautiful time that was had during the Pearl Harbor Remembrance Day celebration; stated it was a very successful event;and thanked them very much for all of their acknowledgement. Vincent Snowden, one of the property owners at SR-442 and 1-95, discussed the City's request to acquire five (5) acres of his property on the western side of SR-442, for a through road; and the City's eminent domain proceedings. Mayor Ignasiak asked City Attorney Wolfe if the issue is currently under litigation, and if he advises Council not to comment at this time. Mr. Wolfe replied "that is correct"; and explained where the City was in the eminent domain litigation proceedings. John Lawrence, Kanazawa Jolley, 515 Sunset Road, Boyton Beach, discussed: damage to the planet's agriculture products; the foundation of the problem being dams on rivers; and asked Council to have Volusia County consider the idea of undamming rivers. APPROVAL OR CHANGES/MODIFICATIONS TO THE AGENDA City Manager Barlow requested to pull agenda item number 10a., stating it would come back before Council in the first part of2016. 6. CITY COUNCIL REPORTS Councilman Blazi reported attending: the November YMCA board meeting; New Smyrna Beach's Christmas parade, which was a fine example of Southeast Volusia cities working together; and the Pearl Harbor Remembrance concert,which he thanked Vice Mayor Bennington, and Councilman Conroy for their concert assistance, and stated he was honored to MC the event. He discussed: external threats, the safety of residents and children at a time of a critical incident, lack of school resource, or DARE officers for schools, and proposed Edgewater aggressive look at increasing more officers in their police department, by at least two (2) additional officers; assigning those two (2) officers with dual roles, one for traffic division duties, and the to assign them to Edgewater's elementary school during critical time periods; and the dual assignment being cost effective for the City. He also discussed: Brevard County sheriff's office having a monthly self defense and tactical shooting decision making course for civilians, which they charge a fee to attend; the overall concept of the course; and Edgewater looking into doing the same thing. He addressed last month's Council meeting, that occurred on November 16, 2015, where they discussed the police department, and alleged unfair treatment of officers; his second, for discussion only, of a motion by Councilman Conroy for an independent investigation of Edgewater Police Chief Dave Arcieri; and, For the Record; he read, and entered into the record, a copy of a letter of explanation, and apology, that he had written to Chief Arcieri(attached). Councilman Conroy reported: attending the Pearl Harbor Remembrance Day celebration; the reflections on heroes, by two soldiers from General Patton's Third Army; recognized Mr. Mike Visconti,for the event, attending Council meetings, and always supporting the City and Council, which has saved the City a lot of money; stated he appreciates what Mr. Visconti does for Edgewater;and suggested the City have a proclamation to declare'Mike Visconti Day". After discussion, Council members concurred to present a proclamation at the next Regular Council meeting declaring a day in December as, "Mike Visconti Day". Mayor Ignasiak reported attending: the Southeast Volusia Chamber of Commerce, board installation dinner; the Edgewater chapter of the Fraternal Order of Eagles FOE #4242, Flag Raising Ceremony, which was also attended by Representative Fred Costello; discussed all that FOE #4242 does for the community; attended the year's last Volusia League of Cities dinner meeting, which was held in Lake Helen; he discussed the legislative update that was presented at the meeting; and stated that the Florida League of Cities being the number one proponent for local Home Rule and a City's ability to govern themselves. He also reminded everyone of the following upcoming events: Citizens Assisting Police (CAPS) dinner on December 8th, 2015; the Edgewater City parade on December 12, 2015; and the employee appreciation breakfast on December 18, 2015, at the Elks Club. He thanked citizen Bob Andrejoviks and his wife for their kind words of thanks, and stated that he would pass them on during the employee appreciation breakfast. • City of Edgewater Page 2 Printed on 12123/2015 City Council Meeting Minutes December 7,2015 Councilwoman Power reported attending: the New Smyrna Beach parade, and handing out candy canes for the Cub Scouts; and the Pearl Harbor Remembrance concert; and stated, For the Record; if the event were held a little later in the day, that people could come from church. She stated: she plans on attending the CAPS dinner; she has a School Scholarship Committee meeting this week; and that the January 2, 2016 Edgefest, Car Show, being held at Hawks Park, is benefiting the scholarship fund, so everyone please attend. Councilwoman Bennington reported attending: the Pearl Harbor Remembrance day event, where she read the proclamation for Mayor Ignasiak; she stated that attending the event with all of the veterans, and the playing of the National Anthem, gave her goosebumps, and made her so proud to be an America; she thanked Mr. Visconti for coordinating the event; stated she plans on attending the City parade; and the employee appreciation breakfast; wished everyone a Merry Christmas; and thanked everyone for attending the Council meeting. 7. CONSENT AGENDA A motion was made by Councilman Conroy, second by Councilwoman Power, to approve the Consent Agenda. CityAttorney Wolfe read Ordinance No. 2015-0-24 into the record. City Manager Barlow made a staff presentation. Mayor Ignasiak opened and closed the public hearing. City Manager Barlow made a staff fjr'presentation. Council members and staff discussed: whether or not the exact rate and amount, legally needs to be on the ballot; the ballot question being rather ambiguous in identifying projects, asking residents to approve a $3.5 million dollar obligation bond, and possibly identifying or clarifying the projects; changes to ballot questions having to come back before the Council for approval; the ballot language providing flexibility in projects that can, or cannot be implemented; and the possibility of retiring the bond early. Mayor Ignasiak opened the public hearing. Michael Visconti, 316 Pine Breeze Drive suggested having a refreshment stand at Whistle Stop Park. Mayor Ignasiak closed the public hearing. A motion was made by Councilman Blazi, second by Councilwoman Power, to approve Resolution No.2015-R-37.The MOTION was APPROVED by the following vote: Yes: 5- Mayor Ignasiak,Councilwoman Power,Councilwoman Bennington,Councilman Blazi and Councilman Conroy c. 2015-R-39 Resolution 2015-R-39 Supporting Governor Rick Scott's Legislative Request to Develop the Florida Enterprise Fund Thereby Providing a More Competitive Economic Development Incentive Tool City Attorney Wolfe read Resolution No. 2015-R-39 into the record. City Manager Barlow made a staff presentation. Councilman Conroy stated that he sat in on a Team Volusia Economic Development Committee (TVEDC) meeting, where they discussed: other States having more economic development incentive funds than Florida; economic development incentives, and being competitive with other States; some corporations in the State not paying taxes; Governor Scott's economic Development incentive plan, and someone having to pay the bills for the plan; and stated that he does not agree with the Governor's plan, there is already a fund for him to use, but he wants more money to use, however, that is the tax payers money. Councilwoman Bennington asked where the Governor thought he was going to get the $250 million dollars from; the Governor would have to take the money from somewhere; and that she agrees with Councilman Conroy. Cay of Edgewater Page 4 Printed on 12123/2015 City Council Meeting Minutes December 7,2015 Council members and staff discussed the Governor's economic development incentive plan; benefits of the plan, and reasons to support the incentive plan; reasons not to support the plan; wondering when the incentive plan will ever end; how would the City track if any corporations came to Edgewater; which areas would benefit the most by the plan; and the $250 million dollars being for the entire State to use. Mayor Ignasiak opened the public hearing. Bob Andrejoviks, 331 Admiralty Court, stated: bringing jobs to the community, more homes, more businesses being better for the City in the long run;and the plan is just the costs of doing business. Josh Lucke, 3419 East Parson Peak Place, Boise, Idaho, stated that the Northwest Lineman College was in Edgewater because of TVEDC. Mayor Ignasiak closed the public hearing. Councilman Blazi stated: he supports the legislation; the State has to be competitive, both in the National, and the International community; there will come a time when the funding pendulum swings in the other direction, but now is not that time; and that we should not cut off our nose to spite our face, but should use any, and all tools available. A motion was made by Councilwoman Power, second by Councilwoman Bennington, to approve Resolution No. 2015-R-39. OTHER BUSINESS a. AR-2015-134 Authorization to partner with the YMCA in securing a professional fund raising 2 consultant for the expansion of the Aquatic Program with an addition of an Olympic size(50 meter)competitive swimming pool. This Other Business Item was withdrawn. b. AR-2015-134 Memorandum of Understanding between Benchmark Idaho, LLC, NLC FL., Inc. 7 (dba Northwest Lineman Center)and the City of Edgewater City Manager made a staff presentation, discussing City economic development incentives; and the Northwest Lineman College considering to establish in Edgewater, and the City's partnership with Team Volusia Economic Development Committee. Economic Development/Redevelopment Coordinator Samantha Bishop, made a staff presentation, discussing: tax abatement; the Line man College meeting the level of pay criteria; the College's City of Edgewater Page 5 Printed on 12'23!2015 City Council Meeting Minutes December 7, 2015 positive impact on the community; and she introduced Josh Lucke, from the Northwest Lineman College. Mr. Lucke made a presentation, at which time Council, and staff discussed: benefits of the college coming to Edgewater; the City's investment to Team Volusia Economic Development Committee paying off; the City's Memorandum of Understanding (MOLT), and abating taxes on property improvements for the first 10 years; coordinating with other entities, and building foundational elements of the program; benefits to high school students and veterans; housing in the area being a critical shortfall; the positive impact on local businesses; the Lineman College personnel having reviewed the MOU, and their excitement in moving forward with the project; the status of the college opening a campus in Florida; housing opportunities in the Edgewater area; and discussed signing the MOU, and the next steps to be taken by the college,and the City. A motion was made by Councilman Conroy, second by Councilman Blazi, to approve the Memorandum of Understanding between Benchmark Idaho, LLC, NLC FL., Inc. (dba Northwest Lineman Center) and the City of Edgewater, with authorization for the City Manager to sign the Memorandum of Understanding with a ten year one hundred percent abatement agreement.The MOTION was APPROVED by the following vote: Yes: 5- Mayor Ignasiak,Councilwoman Power,Councilwoman Bennington,Councilman Blazi and Councilman Conroy 11. OFFICER REPORTS a. City Clerk Interim City Clerk Matusick discussed coordinating details for the City's upcoming Christmas parade. b. City Attorney City Attorney Wolfe discussed: the Council previously authorizing him to file suit relating to the deed restrictions on the City Hall building; the case was filed, and was not contested; and that the judge issued a final declaratory judgment, voiding the deed restrictions on City Hall. He stated that the other property is a separate case;is still being litigated;and is being contested. c. City Manager City Manager Barlow discussed: 2016 Community Redevelopment Agency (CRA) meeting dates; and bringing a resolution to Council during the January 2016 meeting identting possible changes or amendments to the Council meeting policy. Council and staffdiscussed a few areas of the meeting policy to make changes to. After discussion, Council concurred to have the City Manager bring a resolution before Council that changes citizen comments to three (3) minutes, with a Council majority vote approving the Mayor to allow an extension of time to speak; and only bringing motions that have failed, back up for further discussion one other time within a twelve (12) month period, from the meeting when the original motion failed City of Edgewater Page 6 Printed on 12,23/2015 City Council Meeting Minutes December 7,2015 City Manager Barlow discussed: a prior bond resolution adopted by Council for parks improvements; the informational brochure on the "Proposed Voter Referendum Projects"; the "Go For Parks" hyperlink located on the City's website; and reviewed some of the other updates and enhancements to the City's website. Council and staff discussed: using the water bill to market Edgewater's resources, as a way to keep residents informed; Edgewater's new event coordinator; and not having all of the results in yet to discuss evaluations. 12. CITIZEN COMMENTS An Edgewater resident discussed his water bill going up; other taxes that residents pay; some residents only having their social security as income; and trying to develop payments in accordance with wages. Mike Visconti, 316 Pine Breeze Drive, discussed looking for donations towards the planned improvements at Whistle Stop Park. 13. During this meeting,a large contingency of Fraternal Order of Police Lodge members,and some union representatives,spoke in reference to alleged unfair treatment of officers within your department. The allegations were of selected and targeted disciplinary actions taken upon otficers who tell out of tavor with the administration of the department. Also in the room was a large contingency of Edgewater Police Officers,sitting in solidarity in support of you. A motion was made by Councilman Gary Conroy to have an independent investigation conducted on you. I seconded the motion for discussion purposes. During discussion I requested if any investigation was to be conducted,it would be in-house by the City Manager. The motion was later amended. I voted yes to that amended motion. Since that evening,I've been evaluating the total circumstances that led to my vote,and I would like to tell you I was incorrect in my assessment at that time. I cannot take my vote back,and I know it is probably not a politically good idea to pull back from a previous decision made,but I felt it would be unfair of me to not let you know my present stance on this issue. In short I was mistaken,and I apologize for any stress caused by my vote. There is no other area in the realm of public satety more scrutinized than the tield of law enforcement. Due to this,the standards of law enforcement officer conduct,and accountability within a police agency is greater than it's ever been in the past. Because of these increased demands,the standards and procedures for the protection of officers' rights are also greater than they've ever been. The officers issuing the complaints would have been better served by utilizing the proper grievance procedures through their union representatives. The sideshow atmosphere of the Council meeting screamed of sloppy politics,and did not present an atmosphere of good governance. In the end,no one really benefited,and nothing was resolved. I was very impressed with the showing of support given to you. I don't think I've ever seen a greater show of support for an administrative head by employees. This was not a case of a majority of officers presenting a vote of no confidence in their police chief. It was a showing of solidarity among a large majority of employees in defending you on what they perceived as being unfair allegations against you.
