PUBLIC HEARING
Mrs. Martin stated that Mr. Driscoll wanted a variance to keep the existing
carport and storage shed built in error and asked if the board had any
questions.
Mr. Lupinek said that he had seen the property and felt that the property
owner had created their own hardship.
Mrs. Walker felt that people did not know permits were needed for different
types of work.
The City Attorney has reviewed this and will put it in writing for our files
to follow up. He feels that Mr. and Mrs. Driscoll were innocent victims
and that if any action is taken it should be taken against the contractors,
Belmont Homes and Alfax, and not the owners. There was no building permit
issued on this.
Mrs. Martin felt that there should be a mlnlmum fine for small jobs that
do not have permits. She also suggested writing a letter to the Building
Code Board concerning this matter.
lB Mr. Sloan made a motion to grant this variance and allow this building
to remain. Mrs. ..Walker seconded the motion. Upon roll call the motion
CARRIED 3-1. Mr. Lupinek voted NO.
LETTER to council.
Mrs. Martin felt that another letter concerning Belmont Homes and Alfax
needed to be written stating that in regards to the Driscoll variance,
the board feels something should be done about this problem, perhaps an
increase in the penalties. It is possible the Building Code Board
should investigate this problem.
The Public Hearing was adjourned.
