BOARD OF ADJUSTMENTS
PUBLIC HEARING AND REGULAR MEETING
January 23, 1980
CALL TO ORDER
Mr. Lupinek called the Public Hearing to order at 7:00 P.M. in the
Edgewater City Hall.

PUBLIC HEARING
~1r. Frank Costa
Mr. Sloan questioned why Mr. Costa whould have to fill in 21. If he did this
it would make his home 21 higher than Pine Street and would not conform to
the other homes in the area. He stated that Mr. Costa would conform to the
other homes if he left off the 21 fill and built a home with 900 square feet
of living space.
Mr. Costa spoke to the Board and stated that before he purchased this land,
he had checked, and the Building Official said that it would be all right
to build. Mr. Costa feels that 2' fill above the crown of the road would
make it too high.
Mr. Webster stated that a 2' fill was not needed.
Mr. Sloan made a motion to recommend the doing away of the 2' buildup of the
existing road anp build on the same level as the rest of the homes on the
block. Also that he .should build his home no less that 968 square feet
living space. Mrs. Kane seconded the motion. Upon roll call the motion
CARRIED 4-0.
Letter to Council granting this variance.
Mr. Webster
Mr. Webster passed out pictures of approximately what the building would look
like and explained what he wanted.
Mrs. Fulton, of Fulton Real Estate, objected to the variance because she
feels that it would be too close to her property line.
Mrs.. Ferris, of Fulton Real Estate, stated that she was also against granting
this variance.
Mr. Sloan suggested tabling this for further information, which will be the
next meeting held on February 27th. There is possibly no need for this
request.
Mr. Lupinek recessed Mr. Webster's variance until next month. He also
- wants the Building Official contacted.
Letter to the Building Official asking him to explain why this variance was
requested. According to the Ordinance this is okay, why was building permit
not issued. The Board needs this information back before the next meeting.

Mrs. Martin seconded the motion. Upon roll call the motion CARRIED 4-0.
Mr. Herbert thanked the Board.
Letter to Council granting this variance.
The Board agreed to speak with the Building Official. Mrs. Martin will
write the letter.

REGULAR MEETING
APPROVAL 'OF MINUTES
Mrs. Martin made a motion to accept the minutes of December 19, 1979. Mrs.
Kane seconded the motion. Upon roll call the motion CARRIED 4-0.
ELECT PERMANENT CHAIRMAN AND VICE CHAIRMAN
Mr. L'upinek made a motion .to elect Mrs. Martin Chairman and Mrs. Kane Vice
Chairman. Mr. Sloan seconded the motion. Upon roll call the motion CARRIED
4-0.
Letter to Council.
BOARD COMMENTS
There was a long discussion about the Building Official.
Mr. Sloan made a motion to adjourn. Mrs. Martin seconded the motion.
