03-10-1976 w w BOARD OF ADJUSTMENTS PUBLIC HEARING MARCH 10,1976 Chairwoman Murphy called the Public Hearing of the Board of Adjustments to order, Wednesday, March 10, 1976 at 7:30 P.M. ROLL CALL Cliff Denton Jerry Fenske Marie Nichols Alice Murphy Absent Present Present Present Chairwoman Murphy went over the groundrules for conducting a Public Hearing. She read the notice that was published in the newspaper. Mr. Thomas M. Hay requests a five foot variance on the North side of his property line in order to construct a single family resi- rence, the description of his property being the South 100 feet of the North 387.4 feet of Lot 39 F, except the W.est 41 feet thereof of Assessor's Subdivision of the G. Alvarez Grant, Edgewater, Florida, as recorded in Map Book 3, page 137 of the Public Records of Volusia County, Florida. Chairwoman Murphy explained that Mr. Hay had been called out of town because of illness, and will not be able to attend the meeting tonight. She read a letter from Mr. and Mrs. Kemp, who are the property owners directly involved in the variance which states that they do not object. All other concerned property owners were notified and no one was at the meeting to object. Mr. Fenske made a motion to grant the five foot variance on the North side of Mr. Hay's property, being seconded by Mrs. Nichols. Upon roll call vote said motion carried. Mr. Clifford C. Rayl is requesting a three and one half foot variance on the East side of his property line in order to con- ~ruct an addition to his present residence, the description of his property being Lots 13 and 14 and North 10 feet of Dixwood Avenue South of same Block A, Dixwood Subdivision, Map Book 8, page 73, of the Public Records of Volusia County, Florida. The board members discussed this with Mr. and Mrs. Rayl, and they wmt over a drawing that was presented. Mrs. Nichols explained that Mr. Rayl is actually squaring up with tre existing house, however with the new zoning laws, they are re- ~ired to leave a ten foot set back. Mrs. Nichols made a motion to grant a three and one half foot variance on the East side of Mr. and Mrs. Rayl's property line, being seconded by Mr. Fenske. Upon roll call vote said motion carried. Chairwoman Murphy explained that these recommendations will go to fue City Council for final approval tomorrow night, March 11, 1976. She called for a motion to adjourn the Public Hearing.
