BOARD OF ADJUSTMENTS
WORKSHOP
FEBRUARY 11, 1976
Chairwoman Murphy called the workshop meeting of the Board of Adjustments
to order.

NEW BUSINESS
Mrs. Murphy started going over the papers which were turned in to go over at
this workshop.
The first letter is from Mr. and Mrs. Ray1, who are asking to make an addition
to their present home in order for installation of a lavatory on their sun
porch. This is in a R-3 Zoning, which requires 10 feet on the side, however
if they make this addition they will only be 6 1/2 feet from the side.
There were several letters from adjacent property owners stating that they
do not object.
The board members looked over the drawing Mr. Ray1 sent to them. It was
explained that there are several pine trees on the other side of the house.
Mrs. Murphy asked the members if there are any more questions from the board.
There being no more questions, Mrs. Murphy explained to Mr. and Mrs. Ray1
that they should come into City Hall and pay their $50.00 fee and the Public
Hearing will be March 10th.
Mrs. Murphy stated that Mr. Blanken was next, and they started with the infor-
mation that he left. His address is 504 North Riverside Drive.
Mr. Blanken spoke to the board members explaining his situation.
Mrs. Collins had a statement to the board members, which was read.
Mr. Blanken stated that he and his neighbors are not requesting a variance
at this time. He explained that this is a Zoning Board's problem, and the
reason he is at the Board of Adjustments is because the Council sent him here.
He presented a survey, a photograph, spot zoning research, Florida Statute
253 and a copy of the statement to the Board of Adjustments. He stated that
since he can not accept this board as the proper agency to discuss this matter
he must retire from the meeting.
The dimensions of Mr. Blanken's parcel was discussed with him, and he showed
the members how he plans to place two houses on the parcel, and how the new
Ordinance has affected his plans.
Mrs. Murphy asked Mr. Blanken if he has been listening to the new Flood Control?
She stated that this concerns her.
Mr. Blanken stated that Federal regulations do not say you have to build up so
high, they say that they would like for you to, however if you don't you can
not get a loan.

Mrs. Murphy stated that the main concern with Riverside Drive property is
cutting off the view.
Mr. Denton asked Mr. Blanken how close up to Riverside Drive does the slit
come?
Mr. Blanken said approximately 120 feet from Riverside Drive.
Mrs. Murphy explained that if Mr. Blanken is allowed to build on smaller than
50 foot lots, then everyone else owning property on Riverside Drive would
have to be allowed to build on their lots and eventually there would be con-
gestion in that area.
Mr. Blanken explained how this could now happen, because if we don't get a
rezoning we could still build two houses; the houses just could not be placed
the way we want them.
Mr. Denton questioned Mr. Blanken's right-of-way from the Loehman Estate.
Mr. Blanken explained that he has complete right-of-way to drive down and
back. He added that he has been looking into trying to puy this easement.
Mr. Blanken explained that he spoke with the Building Inspector before the
Zoning was changed and he was away when the Zoning was changed and did not
find out about it until he returned to Edgewater.
Mr. Blanken stated that he does not want a Public Hearing, because he is
going to go back to the Councilor the Zoning Board for a decision.
Mrs. Murphy went on to Mr. Hay's request to build a single family residence
on a lot 50' by 241 I. Mr. Hay explained that he has some nice old trees on
his property which he is trying to save.
Mrs. Murphy explained that if he is allowed to build as he plans he will have
a side setback of 5 feet on one side and 13 feet on the other. She read a
letter from one of Mr. Hay's neighbors stating that they do not objec~ to
Mr. Hay building 5 feet from their property line.
Mrs. Murphy asked if it is the feeling of the board that all Mr. Hay needs
is a 5 foot variance on the side setback, or does he also need a variance
to build at all on a lot this size?
It was discussed and decided that this is a single lot of record so he does
not need a lot size variance.
Mrs. Murphy explained that the Public Hearing on this will be March 10th
because it has to be advertised in the newspaper, and if he will bring in
his $50.00 fee he will be placed on the agenda for that hearing.
Mrs. Murphy explainedthat this is all of the new business.
The board members went back over the information that Mr. Blanken left.
Mr. Denton stated that the drawing does not look correct, and that this is
not a legal survey, it is not accurate therefore not reliable.
Mrs. Nichols stated that he is asking to do exactly what even the amendment
to the Ordinance says that you can not do and that is divide the property the
way you want and beat out the Ordinance.
Mr. Denton also questioned Mr. Blanken's idea of setting up a sail boat harbor
in Edgewater.
At this time Mrs. Murphy passed out a letter which was written for all the
board members from the City Clerk. The members discussed this letter stating
that they feel that they have not criticised the secretary's work.
