09-29-1975 . u u BOARD OF ADJUSTMENTS SEPTEMBER 29, 1975 Chairwoman Murphy called the Public Hearing to order, Monday, September 29, 1975. ROLL CALL Mr. Denton Mr. Fenske Mrs. Nichols Mrs. Murphy Present Present Excused Present APPROVAL OF MINUTES Mr. Denton made a motion to approve the minutes of the Public Hearing September 8, 1975, being seconded by Mr. Fenske. Said motion CARRIED. BUSINESS Mrs. Murphy read the ground rules for conducting a Public Hearing. She verified with the secretary that the property was posted and the adjacent property owners were notified. Mrs. Murphy read the request of Mr. Thomas H. Bresnaham,Jr.: Request a variance to construct a single family residence on the following described property: Lot 4, Block D, Highland Shores Section 2, as shown in Map Book 9, page 64 of the Public Records of Volusia County, Florida. Mrs. Murphy explained that Mr. Bresnaham is going to comply with all of the setback requirements, however he needs a variance because of the size of his lot. Mr. Denton questioned why the Zoning Board zoned this area like this, because none of the lots in that area are 75 feet. Mrs. Murphy read the amendment to Ordinance 880 in regard to this. Mr. Denton made a motion to grant the variance, being seconded by Mr. Fenske. Said motion CARRIED. Mrs. Murphy read the next request: Mr. Gene Harris requests a variance to construct a one single-family residence on each numbered parcel. The legal description of the property is a portion of Lots 4 and 5, Block 3, Riveredge Acres, consisting of six numbered parcels, being numbered as follows: 2,4,5,6,7 and 8, as depicted on survey plats. Mr. Denton reminded the members that Mr. Harris stated that all he was interested in for a variance were lots 6 and 7. An adjacent property owner, Mrs. Matthews was present at the meeting. She voiced that she has no objections to what Mr. Harris wants to do Mr. Denton made a motion to gnant the variance, There was more discussion about exactly which lots he needs a variance for. .. u \.,J Mrs. Murphy stated that the way Mr. Harris spoke he wanted permission to build a single family residence on lots 2,6 and 7 and that the three lots on the other side of the street were going to be combined into two. Mr. Denton stated that the request as Mr. Harris stated was only for lots 6 and 7. He asked if he is only asking for a depth variance? At this time Mr. Denton withdrew his original motion. Mr. Denton made a motion that the variance be granted, the depth variance, being seconded by Mr. Fenske. Said motion CARRIED. Mrs. Matthews commented that she feels that this was worked out very nicely. ADJOURNMENT: Mr. Denton made a motion to adjourn, being seconded by Mr. Fenske. Said motion CARRIED. -2-
