09-08-1975 r~ u u , BOARD OF ADJUSTMENTS PUBLIC HEARING SEPTEMBER 8,1975 Vice Chairwoman Murphy called the Public Hearing of the Board of Adjustments to order. ROLL CALL Mr. Denton Mr. Fenske Mrs. Murphy Mrs. Nichols Mrs. Woodard Present Excused Present Present Present APPROVAL OF MINUTES Mrs. Nichols made a motion to approve the minutes of the August 27th meeting, being seconded by Mr. Denton. Said motion CARRIED. Mrs. Murphy read the ground rules for conducting a Public Hearing. Mr. Bingham Edsall requests a variance for a two car garage in the rear south-east corner facing Garage Street. The legal description of the property is Lots 14, 15 and 16 Forster Resub. Hawks Park at 122 Hotel Avenue. Mrs. Woodard asked if it is correct that he is asking for a lOfoot setback on the front and 5 feet on the side. Mrs. Murphy stated that she feels that Garage Street should be considered as an alley. Mrs. Nichols stated that it still is a street of record. Mrs. Woodard asked Mr. Edsall some questions about his drawing. Mrs. Murphy read a letter from some adjacent property stating that they do not object to Mr. Edsall building this garage. Mrs. Nichols stated that she doesn't see that this meets any of the criteria for a variance. Mr. Denton stated that he agrees with Mrs. Nichols. Mrs. Murphy read the criteria on Page 127 of the Zoning Ordinance, of which the board is required to meet at least five. Mr. Denton stated that this does not meet any of the criteria. Mr. Edsall spoke to the board that he feels this will not block the view of any of his neighbors. Mr. Denton made a motion that the variance be granted, there being no second, Mrs. Murphy stepped down from the chair to second the motion. Upon roll call, said motion DIED. Mrs. Murphy voting YES. The board members advised Mr. Edsall that he could go to the City Council's workshop meeting and ask to be put on their agenda, be- cause they are the only ones who can override their decision. Mrs. Woodard made a motion to adjourn the Public Hearing, being seconded by Mrs. Nichols. Said motion CARRIED.
