05-05-1975 ~ Q v p~ ~ BOARD OF ADJUSTMENTS PUBLIC HEARING MAY 5, 1975 The Public Hearing of the Board of Adjustments of the City of Edgewater was cal~ed to order May 5, 1975, at 8:00 P.M. by Chairwoman Woodard. ROLL CALL Alice Murphy Marie Nichols Cliff Denton Jerry Fenske Phyllis Woodard Joseph E. Weaver Present Excused Present Present Present Excused Mrs. Woodard stated that she would like the record to show that we are starting this meeting at 8:07 due to the fact that Case A: James Cartee d/b/a Government Builders, Inc., was on the notice and a lot of people were here interested in this case. City Attorney Weaver explained to these people why Mr. Cartee does not need a variance to build on the lots in question. Mr. Denton made a motion to approve the minutes of the Public Hearing on April 7th, being seconded by Mr. Fenske. Said motion CARRIED. The board continued to Case B: - John Dewar requests a variance in lot size and side setbacks on Lots 3 and 4 in Edgewater Acres. Said lots were a part of Lot 7, Edgewater Acres and are located at the North end of Mary Street. The purpose of this variance request is to allow a single family home to be constructed on each lot. This property is zoned R-3. The board members began discussion with Mr. Dewar in regard to this. Mrs. Woodard asked Mr. Dewar if he bought these lots as two separate lots or did he buy one lot and split them himself? Mr. Dewar stated that he bought them as two separate lots, and he pays the taxes on two separate lots. Mr. Dewar explained that he is only asking for approximately two thirds of a foot on each side of the house, and he could cut off this and he would not have to ask for a variance, however he feels that it will effect the house. Mrs. Murphy pointed out that there is no opposition present at the Public Hearing. The board discussed the criteria that they must go over before granting a variance. Mr. Denton stated that this is a non conforming lot of record; and his only question in his mind was - was it a lot of record, and apparently they are. ~ u u After much discussion in regards to this variance, Mr. Denton made a motion that the request be granted, being seconded by Mrs. Murphy. Upon roll call vote said motion CARRIED. The members explained that this will go before the Council on Thursday, May 8, 1975. Mrs. Murphy made a motion to adjourn, being seconded by Mr. Fenske.
