BOARD OF ADJUSTMENTS
SPECIAL WORKSHOP
APRIL 29, 1975
The Special Workshop meeting of the Board of Adjustments of the
City of Edgewater, Florida, was called to order April 29, 1975,
at 7:30 P.M. by Chairwoman Woodard.

The board began discussing Mr. John Dewar's Application for.
Variance:
Mr. Dewar requests a variance in lot size and side setbacks on
Lots 3 and 4 in Edgewater Acres. Said lots were a part of Lot
7, Edgewater Acres and are located at the North end of Mary
Street. The purpose of this variance request is to allow a
single family home to be constructed on each lot. This property
is zoned R-3.
Mrs. Nichols asked Mr. Dewar if he has a record of where the
City recorded these lots? She stated that the information that
she received was that this Lot 7 is not a recorded subdivision,
Or, more clearly that Lots 3 and 4 are not recorded as being
part of Lot 7.
Mr. Dewar stated that he doesn't, however he bought the two
lots, he has two warranty deeds and pays two separate tax bills.
Mrs. Nichols stated that the Planning Board should be directed
to correct the maps to show the division of this Lot 7.
There was much discussion in regards to this.
Mrs. Woodard stated that this isn't our problem to consider.
Mrs. Nichols stated that if it isn't really recorded we don't
have the authority to act on it.
Mr. ~ewar showed the board members the plans of the houses he
wants to build.
Mrs. Woodard explained that Mr. Dewar needs a one foot variance
on the side setbacks.
Mrs. Woodard told Mr. Dewar that this will be acted upon at the
Public Hearing May 5th.
Mrs. Nichols stated that she still feels that there should be
some clarification on the maps in regard to these lots.
Mrs. Woodard stated that in regards to the letter that each
member received where it says that no other business can be
discussed, she spoke to the attorney, and the board can discuss
anything at a workshop.

Mrs. Murphy stated that in regards to the lots on Live Oak
and Perdita, where it was said that they could be built on
because they are non-conforming lots of record, she feels
that from what she read, on some of those lots he will have
to leave a ten foot setback on one side and a five foot
buffer or green area in the interior side yar.d. She was
reading from page 21, Section 400.01.
There was some discussion about this, and the board decided
that they would like some clarification in regard to Interior
Side Yards, page 39.
Mrs. Woodard stated that she would like some discussion in
regards to the autonomy for our board. She spoke to the board
members as why she feels the board should have the autonomy.
Discussion began again about the Lot 3 and 4 in Edgewater Acres.
and whether this is a recorded lot or not, and whether the board
can actually do anything~on this until it is recorded.
Mr. Fenske made a motion to adjourn being seconded by Mrs. Murphy
Said motion carried.
