The workshop meeting of the Board of Adjustments was called to
order by Chairwoman Woodard, March 17, 1975, at 7:30 P.M.

The Board began discussing Case "c" of the Public Hearing Notice.
Mr. Denton stated that he feels that these people were misinformed
about future houses being built next to them, until the present
zoning was passed anyone could build even 7 feet to the lot lines.
Mrs. Murphy stated that what happened was when the homes were
built, the whole area was on septic tanks, and a 55 foot lot
was not adequate for a septic tank, so when he started to build,
he built on every other lot. When the people moved in they were
told that no one could build on the lots next to them, since
this time a sewer was put in. Some of these people did go and
try to buy these lots and they were told that the lands were so
heavily liened that it would be hard to purchase them.
Mrs. Nichols stated that Bartley very plainly says that if a man
buys a piece of property knowing the zoning, he creates his own
hardship.

Mrs. Woodard explained her ground rules established for a Public
Hearing. It was explained that the failure to act on any case,
that is, no motion to grant a variance, denies the variance.
If a motion is made to grant a variance it will take a 4/5 vote
to pass. It was pointed out that you should be sure before you
make a motion.
There was discussion about different sections in the Zoning
Ordinance in regards to hardships. Mrs. Woodard stated that
all of the criteria has to be met.
Case "B" Harris Construction is requesting a variance for side
setbacks on the property at 104 Yelkca Terrace, Edgewater,
Florida for the construction of a two story, two family home
to include a business on the first floor.
There was some confusion about this being on the agenda for the
Public Hearing April 7th, because this requries an amendment to
be made in the Ordinance, and the Council will be taking care of
this.

There was discussion on what kind of variance Mrs. Harris is
asking for. There was also confusion as to what zoning re-
quirements a~e to be followed if a residence is allowed in a
business district, whether it will be R-5 or R-I or whatever.
The board feels that this is a premature request since the
Council has not made an amendment to the Ordinance at this
time.
Case "A" Mr. and Mrs. Dupont Murphey, 2008 S. Riverside Drive,
are requesting a variance in the setbacks required for the rear
yard so they can construct an addition to their present home.
Mrs. Nichols pointed out to the board that this is zoned B-4
and you can Just about build anything in this area.
There was some confusion as to how close to the lot line this
request is for, the drawing was not very clear.
Mrs. Woodard stated that everyone should visit this site and
take the information down in writing so that it will be clear
at the Public Hearing.
Mrs. Woodard stated that she would like the City Clerk to be
asked to p~ease on all applications a follow up letter statiBg
what it was zoned, what it is presently zoned for and exactly
what they are asking for. This should be precise, so it is
clarified to the board.
Mrs. Nichols made a motion to adjourn this meeting, being
seconded by Mr. Fenske. Said motion CARRIED.
