ZONING BOARD OF ADJUSTMENT
FEBRUARY 19, 1975
The Special Workshop meeting of the Zoning Board of Adjustment
was called to order February 19, 1975 at 7:30 P.M. by Chair-
woman Woodard.

OLD BUSINESS
Chairwoman Woodard asked Mrs. Nichols to read a letter from
Mr. Denton to the board, in which he stated that the board
violated the Board of Adjustment Summary Outline of PoweEs
at the Public Hearing on February 3rd. He stated that this
is more or less a warning to the Chairwoman that he intends
to voice his opinion and object to this type of order in the
future.
At this time the board discussed the letter and the Zoning
Ordinance.
Mrs. Woodard read a thank you note from Mr. and Mrs. Borgerson.
Mr. Denton also stated that in the last hearing there was some
confusion in regard to non-conforming lots and that this is very
unclear in the Ordinance. He showed the board a clipping from
the paper where New Smyrna Beach is trying to get the same
section amended.
There was some discussion about this.
There was some discussion as to whether the Council is going
to have the final authority in regard to variances or whether
the board will have.
Mr. Denton made a motion to write a letter to Mr. Weaver requesting
a clarification on the non-conforming lots, being seconded by
Mrs. Nichols. Said motion CARRIED.
At this time Mrs. Murphy entered th~beeting.
The board discussed the variances which were granted at the Public
Hearing and there was more discussion about whether the new zoning
was published correctly.
Mrs. Murphy stated that she can take correction as well as the
next one, but she stated that she wanted it on record that the
last thing she asked Mr. Weaver at the Public Hearing was didn1t
these people still have to go to the Council before they could
get their building permits, and he said No to her.
There was discussion about the confusion on this and the board
needs clarification.

At this time Mr. Fenske entered the meeting.
There was more discussion about the variances which were granted
at thJPublic Hearing, and about the confusion which followed the
next Jay in regard to getting the building permits.
Mrs. Murphy questioned what was goigg to be done about the four-
teen houses or whatever are going to be built?
At this time Mrs. Woodard read the Notice of Public Hearing and
the board began discussion the two items.
CASE IIAII - John A. Griffith d/b/a Rapid Homes requests a variance
on Lot 145, Map 19, Book 167, Edgewater Acres Resub., Unit 4 for
the purpose of constructing a new home.
There was no letter with the application for a variance therefore
the board members did not understand exactly what he wants a
variance for.
There was much discussion on this, and it was decided that
Mrs. Woodard would talk with this man and find out what his
plans are.
The board expressed that they need a copy of an old Zoning Map.
CASE IIBII - James G. Cartee d/b/a Government Builders requests
a variance on Lots 20,30,32,34,36,48 and 50 in Pointer Sub
No.1 as recorded in MB 19, page 200, Public Records of Volusia
County, Flori da for the purpose of constructi ng . new homes
Mrs. Woodard stated that she has spoken with this man and he
told her that these homes are not like the 235 homes.
They want a variance of 5 feet setback on sides only, for each
of the lots they want to build on. The present zoning requires
10 feet.
Mrs. Woodard stated that she suggests that the members go and
check these out, because this is set for Public Hearing March 3rd.
Mrs. Nichols stated that the Government Builders are affiliated
with the Farm Program or the 235 houses, however this should
have nothing to do with the decision as to whether they get
the variance or not.
There w~ more discussion about where these lots are and what
they arjpresently zoned.
Mrs. Woodard stated that thebayor informed her that the appli-
cation fees for the varianc~s will no longer be returned.
There was much confusion as to whether Mr. Cartee owns all the
lots on the block.
There was discussion about the size of the lots and the size
of the houses which are going to be built.
Mr. Denton explained the blueprints to the board members.
The question came up as to whether this man gought this property
before or after the new zoning.
Mrs. Woodard stated that she invited Mr. Cartee to come to this
workshop meeting, and he has not shown up. She als~ stated that
each member of the board should take a look at this area.
