ROLL CALL Members present were: Donna Wagner, Liz Scarvarda, Dr. D. Vanis, and Debrah Brazzell. Also present were: Legal Assistant Robin Matusick, Animal Control Officer Brandi McNair, Animal Control Officer David Castetter, Captain Jill Landerville, and Board Secretary Sue Griffiths. Members absent were: Robin Hendricks NEW BUSINESS Wesley Animal Control Officer Brandi McNair explained that "Wesley", a 9-month to 1-year-old intact male Pitt bull, went after Angelique Bodien and her 18- month-old child on 09/25/01. ACO McNair explained that Ms. Bodien called the police department and she was dispatched to the area. ACO McNair went on to explain that when she arrived on scene the dog showed an aggressive, agitated manner, and even though she used her catch pole as a deterrent the dog continued to come after her. A neighbor nearby seeing that the dog was going after McNair came over and distracted the dog with his bicycle, so she would be able to get back inside her animal control truck. After she reached her truck "Wesley" came after her again, but she was able to get inside without harm. McNair went on to explain that a month prior to this incident she had a similar incident with the same dog, where she had to use her animal control truck to make the dog back up and away from a neighborhood woman that the dog was going after. McNair explained that the dog resides at a home in which there is a privacy fence and the dog is capable of getting out of the yard and had u o gotten out of the house previously through a window. McNair explained that ACO Castetter had an incident with "Wesley" attacking a neighbor's cat by seriously injuring the animal who later died at the veterinarians office from its injuries. McNair explained to The Animal Control Board that "Wesley" is being kept at the South East Volusia Humane Society due to the owner of the dog not at home on the incident date and she felt it best to have the dog contained where it would not get out. McNair stated the dog is progressively getting more aggressive at the humane society and has had to be maced by the workers so they can get the food and water bowls out of his kennel. ACO McNair stated at this time she is unsure if the owner is going to surrender the animal or if he is willing to uphold the terms of the dangerous dog classification but feels it is important to have the dog classified either way. After a brief discussion among board members, the following motion was made. Motion: Motion was made by Liz Scavarda and seconded by Dr. D. Vanis to uphold the decision made by animal control to deem the dog dangerous, with notification to owner as such. Motion held unanimous.
