Vice-Chairman Mullen called to order the regular meeting of the Planning and Zoning Board at
6:30 p.m., August 14, 2002 in the Community Center, 102 N. Riverside Drive, Edgewater,
Florida.
ROLL CALL
Members present were Vice-Chairman Russell Mullen, Robert Garthwaite, Charlene Zeese,
Kristine Pluscec and Donald Masso. Chairman Edwin V opelak and Anton Heeb were excused.
Also present were Chief Planner Darren Lear and Planning Technician Bonnie Wenzel.
APPROVAL OF MINUTES
Mr. Garthwaite made a motion to approve the minutes of July 10, 2002 as read, Mr. Masso
seconded. MOTION PASSED 5-0.
OLD BUSINESS
None at this time.
NEW BUSINESS
1. AB-0205 - Joseph and Cynthia Cvach, owners, requesting abandonment/vacation of
an unopened 30-foot right-of-way, known as Coquina Drive, west of Bradford Road.
Vice-Chairman Mullen opened the public hearing and Mr. Lear gave background
information on this request. Mr. Mullen asked who would be responsible for the people
hanging out on this property if it is abandoned/vacated. Mr. Masso suspected that the
applicant would become responsible.
Mr. Joseph Cvach, 1600 Bradford, stated that his plan is to fence in the area in hopes of
keeping people out. He further stated that he has been maintaining the area.
Mr. Mullen read into the record a phone message from Mrs. Betty Crouser in favor of any
decision the Board makes.
There being no further discussion Mr. Mullen closed the public hearing.
Mr. Garthwaite made a motion to send a recommendation to City Council to approval
the abandonment/vacation of an unopened 30-foot right-of-way, known as Coquina
Drive, west of Bradford Road with a second by Mr. Masso. Motion Passed 5-0.

2. V A-0214 - Edgewater-New Smyrna Cemetery, requesting a variance from Section
21-52.02G) of the Land Development Code for a reduction in the minimum width
for double access driveways from the required 20-feet to 14-feet.
Vice-Chairman Mullen opened the public hearing and Mr. Lear gave background
information on this request and explained why this site was unique and in need of the
vanance.
Mr. Masso asked if the applicant agreed with Staff s recommendation. Mr. Mullen asked
if the request would cause traffic problems. Mr. Lear stated that he left a message with
the applicant and has not heard back from them.
Much discussion ensued regarding the width and location of the existing driveways. Mr.
Garthwaite stated he did not agree with Staff s recommendation to close driveways one
and three.
Mr. Lowell Lohman, owner, stated that the cemetery does not have a lot of traffic and
they are trying to improve the site. They are going to place a very nice sign and make a
nice entry at the northernmost driveway. The reason the requested variance is being
made is that existing burial sites are too close to the road, and if the roads where to be 20-
feet wide and then add the swales it would disturb the burial sites.
Mr. Mullen asked the applicant if he had any problems with Staffs recommendation.
Mr. Lohman stated he had no problem closing the two driveways.
There being no further discussion Mr. Mullen closed the public hearing.
Mr. Masso made a motion to approve the variance request to allow double access
driveways be 14-feet in lieu of the required 20-feet provided driveways 1 and 3 are
closed with a second by Mrs. Zeese. Motion Passed 4-1, Mr. Garthwaite voted no, he
did not agree with closing the two driveways.
