MINUTES
CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Citizen Code
Enforcement Board to order at 5:35 PM in the Community Center.
ROLL CALL
Members present: Chairperson Linda Johnson, Vice Chairman Ben Delnigro, Jean
Kayat, Glenn Barnhill, Ed Corn, Gene Mirabella and Ben Wagner. Also present
were Code Officer Mike McGrath, Code Supervisor Angela DeSue and Board
Secretary Shontella Jackson. The Board extended a welcome to new board
member, Jean Kayat.
Absent: Code Board Attorney Glenn Storch was excused from the meeting.
APPROVAL OF MINUTES
The Minutes for the regular meeting of May 20, 2004 were presented to the
Board for approval. MOTION by Ed Corn, SECOND by Ben Delnigro to
adopt the minutes of Regular Citizen Code Enforcement Board on May
20, 2004. MOTION CARRIED UNANIMOUSLY.
SWEARING IN OF WITNESSES:
Code Officer Mike McGrath and Code Supervisor Angela DeSue were sworn in for
testimony.

NEW BUSINESS:
Case #2004-CE-6068, 3001 India Palm Dr., Edgewater, Florida; Delco Oil Inc.
Violation of Section 21-56.03 (B) — Property maintenance.
Angle DeSue presented the case summary to the Board. The Board was
presented with photographs showing the condition of the property when cited
the initial notice of violation and current photographs were also provided for the
Board's review. Angela DeSue informed the Board that Delco Oil Inc. came into
compliance on July 15, 2004 and had paid the citation fine of $53.00.
Case #2004-CE-6068, 3001 India Palm Dr., Edgewater, Florida; Delco Oil Inc.
Violation of Section 21-34.08 — Refuse and dumpsters.
Angela DeSue presented the case summary to the Board. The Board was
presented with photographs showing the condition of the property when cited
the initial notice of violation and current photographs were also provided for the
Board's review. Angela DeSue informed the Board that Delco Oil Inc. came into
compliance on July 15, 2004 and had paid the citation fine of $53.00.
Case #2004-CE-5081, 2221 Queen Palm Dr., Edgewater, Florida; William &
Cynthia Davidge. Violation of Section 21-34.10 (A) — Waste receptacles.
Angela DeSue presented the case summary to the Board. No photographs were
provided for this case. Angela DeSue gave a brief background on the case and
informed the Board that the Davidge's had came into compliance immediately
and paid the citation fine of $53.00.
CODE COMPLIANCE REPORT:
Angela DeSue stated that during next month's Code Board Meeting an update
will be provided on the Lenik case.
Angela DeSue gave a briefing on the different projects which Code Enforcement
are currently involved: the Pelican Cove West project, a sweep on Guava and
Hibiscus, sign sweep of the City regarding businesses, and the beginning of a
basketball hoop sweep in September. Code Enforcement has worked
approximately 100 to 130 cases per month in the last two months. The Board
was presented with minutes from August 20, 2003 meeting showing how we
would reduce the amount of information given in the packets to the Board.
Angela DeSue announced that the packets for Code Board would be ready the
Friday before the scheduled Code Enforcement meeting. You will be able to pick
up the packets Friday morning at the Fire Department or they will be mailed
Friday afternoon to each member.

PUBLIC COMMENTS:
Mrs. Johnson informed Mr. Hennigan that he was welcome to speak on the
matter he would like to discuss, even though it is not listed on the agenda. Mrs.
Johnson stated that the case might come before the Board, however individuals
on the Board may be persuaded, bias or disqualified from hearing the case. Mr.
Roy Hennigan of 2736 Mango Tree Dr. appeared to comment regarding his
neighbor in a case, which may be presented to the Board. He gave a brief
overview of the situation and wanted to present photographs to the Board. The
Board declined reviewing the photographs and advised Mr. Hennigan to appear
at the next Code Board Meeting. Angela DeSue advised Mr. Hennigan that some
of the issues he was advising the Board on were not code issues; they are civil
issues that the Police Department needs to address. Mr. Hennigan agreed to
attend next months meeting and would testify at that time.
ADJOURNMENT
Chairperson Johnson adjourned the meeting at 6:15 pm.
Next Meeting will be held on August 19, 2004 at 5:30 pm.
