11-10-2005 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, November 10, 2005 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:05 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ben Delnigro, Gene Mirabella, Glenn Barnhill, Jean Kayat and Ben Wagner. Also present were Code Officer Robin Bell, Code Supervisor Angela DeSue, Code Officer Mike McGrath, Fire Marshal Jill Danigel, Attorney Glenn Storch and Board Secretary Shontella Jackson. Absent were: Ed Corn. APPROVAL OF MINUTES The Minutes for the regular meeting of October 13, 2005 were presented to the Board for approval. Entered into the case as Exhibit A. Ms. Coyle stated that the property has engine parts in front of the garage, tree limbs, a boat and garage garbage strewed along the yard." City of Edgewater Code Enforcement Board Minutes November 10,2005 Page 1 of 1 NEW BUSINESS: Case #2005-CE-9037 (A), 208 Cherrywood Lane, Edgewater, Florida; Dorothy Duke. Violation of Section 21-56.03 (b) — Property maintenance. Code Officer Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review, Photographs were entered into the case as Exhibit A. Code Officer Mike McGrath testified that the photos were taken on September 15, 2005. Code Officer Mike McGrath presented staff's recommendation to find Dorothy Duke in violation of Section 21-56.03 (b) of the City of Edgewater's Land Development Code access a citation fine of$53.00 and an additional fine of$50,00 per day for each day the violation exists past November 11, 2005. Also for a lien to be placed on the property if not satisfied by November 17, 2005. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff if the violation is not corrected by November 17, 2005 and that a lien is placed on the property. The citation has not been paid. Dorothy Duke reviewed the photographs which were presented to the Board. Ms. Duke testified that she has been out of the home since September 29, 2004 and she is the property owner. The water has been turned off and she is waiting for the insurance company to pay for the damage. Ms. Duke states she has owned the property for seven years. Ms. Duke states she will pay the $53.00 citation. The grass has been cut on the property. Chairwoman Johnson closed the public hearing. MOTION CARRIED UNANIMOUSLY. Case #2005-CE-9037 (B), 208 Cherrywood Lane, Edgewater, Florida; Dorothy Duke. Violation of Section 21-35.04— Neglected premises. Code Officer Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Mike McGrath presented staff's recommendation that the Board find Dorothy Duke in violation of Section 21-35.04 of the City of Edgewater's Code of Ordinances assessing a citation fine of$53.00 and an additional fine of$50.00 per day for each day the violation exists past November 11, 2005, and for a lien to be placed on the property if not satisfied by November 17, 2005. It is also recommended that the Board issue a Board Order requesting the City Manager approve the removal of the debris by City Staff if the violation is not corrected by November 17, 2005. Code Officer Mike McGrath testified that the property is not in compliance, City of Edgewater Code Enforcement Board Minutes November 10,2005 Page 2 of 2 unfortunately Ms. Duke has an outstanding refuse/water bill and the City will not pick up debris due to the unpaid bill. Code Officer Mike McGrath explained to Ms. Duke what she will need to do to bring the property into compliance. MOTION CARRIED UNANIMOUSLY, Code Board Attorney Glenn Storch explained to Ms. Duke that the $53.00 citation fine needs to be paid by November 17; also to remove all the debris and contact the Code Officer to verify the removal by November 17th. In the event, this is completed then the Board has indicated they will review the case at the next Board meeting and may consider waiving all fines. Case #2005-CE-9016, 2312 Limetree Dr., Edgewater, Florida; Geoffrey &Stacy M. Pittard. Violation of Section 21-34.04— Inoperable vehicle. Code Supervisor Angela DeSue indicated that the above case was in compliance. CASE IN COMPLIANCE Code Supervisor Angela DeSue presented cases which are in compliance: • Case #2005-CE-10135 Patrick Girvan — 2001 S. Ridgewood Dr. Violation of Section 10-22 — General restrictions Citation Paid on 11/02/05 • Case #2005-CE-9017 Madeline Wallace Life Estate— 2318 Limetree Dr. Violation of Section 21-35.04— Neglected premises Citation Paid on 11/03/05 Fire Marshal Jill Danigel presented the case summary to the Board on the existing fire code violations and corrections which have been made to correct the violations. 3050 Holdings LLC has paid all previous citation and will be deemed as repeat violators. • Case #2005-CE-5042 3050 Holdings LLC— 2982 S. Ridgewood Ave. Violation of Section 21-210.02 — Fire Code Citation Paid on 09/21/05 City of Edgewater Code Enforcement Board Minutes November 10,2005 Page 3 of 3 OLD BUSINESS: Case #2005-CE-8023 (A) (Tabled item). 1958-1960 Fern Palm Dr., Edgewater, FL; Tara Warnock. Violation of Section 10-41 — Littering public property/waterways. Code Supervisor Angela De Sue presented the case summary recommending the Board maintain a continuance while the City continues their research and negotiations with Mr. Warnock. 64 • 11 # # I • # I I I next meeting. PUBLIC COMMENT: None. BOARD DISCUSSION: The Board had a brief discussion if there would be a December meeting and concluded that there will not be a December meeting.
