08-11-2005 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, August 11, 2005 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:07 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ben Delnigro, Glenn Barnhill, Ben Wagner, Ed Corn and Jean Kayat. Also present were Community Service Code Officer Robin Bell, Fire Chief Tracey Barlow, Fire Marshal Jill Danigel, Code Attorney Glenn Storch and Board Secretary Shontella Jackson. Absent were: Gene Mirabella. APPROVAL OF MINUTES The Minutes for the regular meeting of July 14, 2005 were presented to the Board for approval. MOTION by Ben Wagner, SECOND by Ben Delnigro to adopt the minutes of Regular Citizen Code Enforcement Board on July 14, 2005 with the following revisions: Page 1, Roll Call, first sentence: ROLL CALL "Members present: Linda Johnson, Ben Delnigro, , Ben Wagner, Gene Mirabella and Jean Kayat. Also present were Community Service Code Officer Robin Bell, Code Officer Mike McGrath, Code Attorney Glenn Storch and Board Secretary Shontella Jackson." "Absent and excused were: Ed Corn and Glen Barnhill." Page 2, New Business, last sentence: NEW BUSINESS: Case #2005-CE-4094, 2216 Umbrella Tree Dr., Edgewater, Florida; Jason W. Attride Violation of Section 15.3 — Culverts under driveway. City of Edgewater Code Enforcement Board Minutes August 11,2005 Page 1 of 1 "Mr. Attride attested that he no longer own the property and he notified the new owner of the existing violation. Mr. Attride also testified that he stated to the new owner that if he had to replace the culvert he would repay him for the cost." MOTION to adopt revised minutes CARRIED unanimously 6-0, SWEARING IN OF WITNESSES: Code Officer Robin Bell, Fire Chief Tracey Barlow, Fire Marshal Jill Danigel, Gary Lee of Edward Jones at 2982 S. Ridgewood Ave., Edgewater, FL and Wayne Clinton; Agent for Edgewater Commons of Edgewater, FL were sworn in for testimony. NEW BUSINESS: Case #2005-CE-5025, 2030 Hibiscus Dr., Edgewater, Florida; Ray & Burma Fisher. Violation of Section 21-36.03 — Outdoor storage commercial. Fire Chief Tracey Barlow presented the case summary to the Board. Current photographs were provided for the Board's review. Fire Chief Tracey Barlow presented staff's recommendation to find Ray & Burma Fisher in violation of Section 21-36.03 of the City of Edgewater's Land Development Code to assess the citation fine of $53.00 and an additional fine of$100.00 per day each day the outdoor storage commercial violation exists past August 21, 2005 and for a lien to be placed on the property if not satisfied by August 28, 2005. Ray and/or Burma Fisher were not present. The property is not in compliance and the citation has not been paid. MOTION by Ed Corn, SECOND by Ben Wagner that the Board finds Ray and Burma Fisher in violation of Section 21-36.03 of the City of Edgewater Land Development Code assessing the citation fine of $53.00 and an additional fine of $100.00 per day each day the outdoor storage violation exists past August 21, 2005 also for a lien to be placed on the property if not satisfied by August 28, 2005. MOTION CARRIED UNANIMOUSLY. Case #2005-CE-5042, 2982 S. Ridgewood Ave., Edgewater, Florida; 3050 Holdings LLC. Violation of Section 21-210.02 — Fire Code. Fire Chief Tracey Barlow presented the case summary to the Board. Current photographs were provided for the Board's review. Fire Chief Tracey Barlow presented staff's recommendation to acknowledge that 3050 Holdings LLC is a repeat violator of Section 21-210.02 (Section 10.4.1 of the Florida Fire Prevention Code) of the Land Development Code and has made payment of their citation fine of $108.00 which is defined as an admission of commission and an City of Edgewater Code Enforcement Board Minutes August 11,2005 Page 2 of 2 additional fine of $500.00 per day be levied until the violations are corrected. Also for a lien to be placed on the property if not satisfied by August 18, 2005. Fire Marshal Jill Danigel provided additional testimony to the case and stated that 3050 Holdings LLC is in compliance as of today, August 11, 2005 at 11:30 a.m. Gary Lee of Edward Jones testified that the alarm system was located in their office which the alarm systems has been having problems and that they had been making notes regarding the reoccurring problems. 3050 Holdings LLC did not have a representative present. MOTION by Ben Wagner, SECOND by Ed Corn that the Board finds 3050 Holdings LLC in violation of Section 21-210.02 and acknowledge the citation fine of$108.00 paid; also any further action be tabled until the next regular meeting for further guidance to the Code Enforcement •fficer and Chief. MOTION CARRIED UNANIMOUSLY, ANNUAL ELECTION Chairperson Johnson opened the floor for discussion on the annual election for chairperson and vice chairperson. MOTION by Ben Wagner, SECOND by Ben Delnigro that the Board continue to table the election of Chairman and Vice Chairman until a full Board. MOTION CARRIED UNANIMOUSLY, OLD BUSINESS: Chairperson Johnson acknowledged a "Thank You" card from Angela DeSue to the Board. CODE COMPLIANCE REPORT: Chief Barlow presented some of the success cases to the presentation for the Board to review and the second quarter code compliance report. PUBLIC COMMENTS: None. ADJOURNMENT Chairperson Linda Johnson adjourned the meeting at 2:46 pm.
