07-14-2005 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, July 14, 2005 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:11 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ben Delnigro, Glenn Barnhill, Ben Wagner, Gene Mirabella and Jean Kayat. Also present were Community Service Code Officer Robin Bell, Code Officer Mike McGrath, Code Attorney Glenn Storch and Board Secretary Shontella Jackson. Absent and excused were: Ed Corn and Glen Barnhill. The June 9th meeting was cancelled due to a lack of quorum. APPROVAL OF MINUTES The Minutes for the regular meeting of May 12, 2005 were presented to the Board for approval. MOTION by Ben Wagner , SECOND by Gene Mirabella to adopt the minutes of Regular Citizen Code Enforcement Board on May 12, 2005 as written. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Robin Bell, Code Office Mike McGrath, Stormwater Supervisor Calvin Ayers, Jason Attride of 3411 Kumquat Dr., Edgewater, FL and Teresa Voshell of Edgewater, FL were sworn in for testimony. Also Darlene Rickelman of 1924 Juniper Dr., Edgewater, FL was sworn in for testimony. City of Edgewater Code Enforcement Board Minutes July 14,2005 Page 1 of 1 The Board has approved an amendment to the agenda to hear Case #2005-CE- 4094 due to Mr. Attride infant present. The Board members had no objections to the agenda amendment. NEW BUSINESS: Case #2005-CE-4094, 2216 Umbrella Tree Dr., Edgewater, Florida; Jason W. Attride Violation of Section 15.3 — Culverts under driveway. Code Officer Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Mike McGrath presented staff's recommendation to find Jason Attride in violation of Section 15.3 of the City of Edgewater's Code of Ordinance to assess the citation fine of $53.00 and an additional fine of $50.00 per day each day the culvert violation exists past July 17, 2005 and for a lien to be placed on the property if not satisfied by July 20, 2005. Mr. Attride presented a brief testimony to the Board. Mr. Attride stated he purchased the material from All Florida Plumbing and contacted a contractor to have it installed which he assumed was up to the City's code. Mr. Attride also stated he did not have the funds to remove and replace the driveway. Calvin Ayers gave a brief testimony. Calvin Ayers stated that permits were not secured before installation of the culvert. Mr. Attride attested that he no longer own the property and he notified the new owner of the existing violation. MOTION by Ben Wagner, SECOND by Gene Mirabella that the Board finds Jason W. Attride in violation of Section 15.3 of the City of Edgewater Code of Ordinance assessing the citation fine of $53.00 and an additional fine of$50.00 per day each day the culvert violation exists past July 28, 2005 also for a lien to be placed on the property if of satisfied by Auaust 8. 2005. MOTION CARRIED UNANIMOUSLY. Mr. Attride provided the new property owner name which is Wayne Pierson. Case #2005-CE-3088 (A), 913 Lake Ave.,Edgewater, Florida; Diane L. Barnaby & Edith L. Raymond. Violation of Section 21-34.04 — Inoperable vehicles. Code Officer Robin Bell presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Robin Bell presented staff's recommendation to find Diane L. Barnaby & Edith L. Raymond in violation of Section 21-34.04 of the Land Development Code and assess a citation fine of $53.00 and an additional fine of $50.00 per day for each day the inoperable vehicle violation exists past July 15, 2005 also for a lien to be placed on the property if not satisfied by July 18, 2005. Diane Barnaby and Edith Raymond were not present. MOTION by Ben Wagner, SECOND by Gene Mirabell. that the Board finds Diane Barnaby and Edith Raymond in violation of Section 21- City of Edgewater Code Enforcement Board Minutes July 14,2005 Page 2 of 2 34.04 of the Land Development Code assessing the citation fine of $53.00 and an additional fine of$50.00 per day for each day the violation exist past July 15, 2005 also for a lien to be placed on the property if not satisfied by July 18, 2005. _MOTION CARRIED UNANIMOUSLY, Case #2005-CE-3088 (B), 913 Lake Ave., Edgewater, Florida; Diane L. Barnabv & Edith L. Raymond Violation of Section 21-34.06 — Watercraft/trailers. Code Officer Robin Bell presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Robin Bell presented staff's recommendation to find Diane L. Barnaby & Edith L. Raymond in violation of Section 21-34.06 of the Land Development Code to assess the citation fine of $53.00 and an additional fine of $50.00 per day for each day the violation exists past July 15, 2005 also for a lien to be placed on the property if not satisfied by July 18, 2005. Diane Barnaby and Edith Raymond were not present. MOTION by Ben Wagner, SECOND by Gene Mirabella that the Board finds Diane L. Barnaby and Edith L. Raymond in violation of Section 21- 34.06 of the Land Development Code assessing the citation fine of $53.00 and an additional fine of $50.00 per day for each day the violation exists past July 15, 2005 also for a lien to be placed on the property if not satisfied by July 18, 2005. NOTION CARRIED UNANIMOUSLY. Board member Jean Kayat was excused from the Board meeting at 2:57. Case #2005-CE-5001 (A), 1928 Juniper Dr., Edgewater, Florida; Richard &Vickie Lao. Violation of Section 21-35.04 — Neglected premises. Code Officer Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Mike McGrath presented staff's recommendation to find Richard &Vickie Lao in violation of Section 21-35.04 of the Land Development Code to assess the citation fine of $53.00 and an additional fine of $50.00 per day for each day the neglected premises violation exists past July 15, 2005 also for a lien to be placed on the property if not satisfied by July 18, 2005. Richard &Vickie Lao were not present. Code Officer Mike McGrath entered Exhibit A — letter to Richard & Vickie Lao dated June 22, 2005, Exhibit B — copy of the citation issued on May 20, 2005 and Exhibit C — copy of the certified mail return receipt signed by Vickie Lao for the Board to review. Darlene Rickelman was present to testify. Mrs. Rickelman was sworn in and gave a brief testimony to the case. MOTION by Ben Wagner, SECOND by Gene Mirabella that the Board finds Richard &Vickie Lao in violation of Section 21-35.04 subsections City of Edgewater Code Enforcement Board Minutes July 14,2005 Page 3 of 3 a, b &c of the Land Development Code assessing the citation fine of $53.00 and an additional fine of$253.00 per day for each day the violation continues to exist past July 15, 2005 also for a lien to be CARRIED UNANIMOUSLY, Case #2005-CE-5001 (B), 1928 Juniper Dr., Edgewater, Florida; Richard &Vickie Lao Violation of Section 21-34.04 — Inoperable vehicle. MOTION by Ben Wagner, SECOND by Gene Mirabella that the Board finds Richard &Vickie Lao in violation of Section 21-34.04 of the Land Development Code assessing the citation fine of$53.00 and an additional fine of $253.00 per day for each day the violation continues to exist past July 15, 2005 also for a lien to be placed on the property 'f not satisfied by July 18. 2005. )IOTION CARRIED UNANIMOUSLY, Case #2005-CE-2021, 2424 Hibiscus Dr., Edgewater, Florida; The Supercloset LLC Violation of Section 21-36.03 — Outdoor storage. Code Officer Robin Bell presented the case summary to the Board. Current photographs were provided for the Board's review. Code Officer Robin Bell presented staff's recommendation to find The Supercloset LLC in violation of Section 21-36.03 of the Land Development Code to assess the citation fine of $53.00 and an additional fine of $100.00 per day for each day the violation exists past July 24, 2005 also for a lien to be placed on the property if not satisfied by July 31, 2005. Teresa Voshell was present and gave testimony to the Board. Ms. Voshell request that the Board grant her 20 days to have the slats installed. MOTION by Ben Wagner, SECOND by Ben Delnigro that the Board finds The Supercloset LLC in violation of Section 21-36.03 of the Land Development Code assessing the citation fine of $53.00 and delay any implication of additional fine of $100.00 per day for each day the violation continues to exist and lien to be placed on the property if not in compliance by August 3, 2005,^MOTION CARRIED UNANIMOUSLY, City of Edgewater Code Enforcement Board Minutes July 14,2005 Page 4 of 4 ANNUAL ELECTION Chairperson Johnson open the floor for discussion on the annual election for chairperson and vice chairperson. MOTION by Ben Wagner, SECOND by Ben Delnigro that the Board postpone the annual election of chairperson and vice chairperson until the first meeting the Board has a complete quorum. JIIOTION CARRIED UNANIMOUSLY, OLD BUSINESS: None. CODE COMPLIANCE REPORT: None. PUBLIC COMMENTS: None. MISC ITEM: The Board presented and signed a get well card for Code Supervisor Angela DeSue along with their well wishes. ADJOURNMENT Chairperson Linda Johnson adjourned the meeting at 3:55 pm.
