04-14-2005 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, April 14, 2005 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:03 PM in the Community Center. ROLL CALL Members present: Ed Corn, Gene Mirabella, Glenn Barnhill, Ben Wagner, Ben Delnigro, Linda Johnson and Jean Kayat. Also present were Code Officer Mike McGrath, Code Officer Robin Bell, Chief Tracey Barlow, Code Attorney Glenn Storch and Board Secretary Shontella Jackson. APPROVAL OF MINUTES The Minutes for the regular meeting of March 10, 2005 were presented to the Board for approval. MOTION by Ben Wagner, SECOND by Ed Corn to adopt the minutes of Regular Citizen Code Enforcement Board on March 10, 2005 with the following revisions: Page 1, Roll Call, first sentence: "Members present: Ed Corn, Gene Mirabella, Glenn Barnhill, Ben Wagner, Ben Wagnef Delnigro and Linda Johnson. Also present were Code Officer Mike McGrath, Robin Matusick, and Board Secretary Shontella Jackson. Code Board Attorney Glenn Storch arrived at 2:20." MOTION to adopt revised minutes CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Mike McGrath, Code Officer Robin Bell and Fire Chief Tracey Barlow were sworn in for testimony. Violation of Section 21-60.04 — Prohibited signs. Chief Tracey Barlow presented the case summary to the Board. Current photographs were provided for the Board's review. Chief Barlow presented staff's recommendation to find Sky Hospitality Group in violation of Section 21- 60.04 of the Land Development Code to assess the citation fine of $53.00 and additional fine of $100.00 per day for each day the violation continues to exist past April 15, 2005 also for a lien to be placed on the property if not satisfied by April 18, 2005. MOTION by Ben Wagner, SECOND by Ed Corn that the Board finds Sky Hospitality Group in violation of Section 21-60.04 of the Land Development Code assessing a citation fine of $53.00 and an additional fine of$100.00 per day for each day the prohibited sign violation exists past April 15, 2005 also for a lien to be placed on the property if not satisfied by April 18, 2005..._MOTION CARRIED UNANIMOUSLY, Case #2005-CE-2008, 131 Park Ave., Edgewater, Florida; Daniel & Michelle Troian. Violation of Section 21-34.04 — Inoperable/abandoned vehicle. Chief Tracey Barlow presented the case summary to the Board. Current photographs were provided for the Board's review. Chief Barlow presented staff's recommendation to find Daniel & Michelle Troian in violation of Section 21-34.04 of the Land Development Code and assess a citation fine of $53.00; also for a lien to be placed on the property if not satisfied by April 18, 2005. MOTION by Ed Corn, SECOND by Ben Delnigro that the Board finds Daniel & Michelle Troian in violation of Section 21-34.04 of the Land Development Code and assess a citation fine of $53.00; also for a lien to be placed on the property if not satisfied by April 18, 2005. MOTION CARRIED UNANIMOUSLY, Glenn Barnhill term Chairperson Linda Johnson acknowledged receipt of Glenn Barnhill's letter for reappointment to the Board. The Board would like to recommend reappointment of Glenn Barnhill to the Citizen Code Enforcement Board to City Council. City of Edgewater Code Enforcement Board Minutes April 14,2005 Page 2 of 2 OLD BUSINESS: Chairperson Linda Johnson announced the reappointment of Co-Chairman Ben Delnigro by City Council to the Citizen Code Enforcement Board. CODE COMPLIANCE REPORT:, Chief Tracey Barlow gave a brief update on the J. C. Carder sign agreement with the City of Edgewater. Attorney Mark Hall who is representing Mr. Carder will be appearing before City Council on April 18, 2005 requesting lien reduction for existing fines. Chief Barlow presented the first quarter code report for the Board to review. The Code Enforcement Department has received 273 cases in the first quarter which is from January 2005 to March 2005. 218 cases resolved, 13 citations issued, 55 notice of violations issued, 9 cases presented to the Board and 50 cases not requiring case numbers in the first quarter. Chairperson Linda Johnson welcomed new Code Officer Robin Bell. Chairperson Linda Johnson opened the floor for discussion if negative votes require explanation. Board Attorney Glenn Storch advised the Board that negative votes do not require explanation as long as there is evidence that support the Boards decision. PUBLIC COMMENTS: None. ADJOURNMENT Chairperson Linda Johnson adjourned the meeting at 2:26 pm.
