04-20-2006 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, April 20, 2006 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:06 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ed Corn, Ben Delnigro, Gene Mirabella, Glenn Barnhill, and Ben Wagner. Also present were Code Officer Robin Bell, Code Supervisor Angela DeSue, Attorney Ty Harris, Chief Tracey Barlow, City Manager; Ken Hooper and Board Secretary Shontella Jackson. Jean Kayat was present and entered at 2:15 pm. APPROVAL OF MINUTES The Minutes for the regular meeting of March 16, 2006 were presented to the Board for approval. MOTION by Ben Wagner, SECOND by Ed Corn to adopt the minutes of Regular Citizen Code Enforcement Board on March 16, 2006 as written, MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Robin Bell, Code Supervisor Angela DeSue, Chief Tracey Barlow and Maurice Kaminski of 1330 Royal Palm Dr., Edgewater, FL. CASES IN COMPLIANCE: Code Supervisor Angela DeSue stated that the following cases are in compliance as of April 20, 2006: Case #2006-CE-8023, 1958-1960 Fern Palm Dr., Edgewater, Florida; Tara Warnock. Violation of Section 10-41 — Littering — public property and waterways and Case #2006-CE-2037, 1205 Regent St., Edgewater, City of Edgewater Code Enforcement Board Minutes April 20,2006 Page 1 of 1 Florida; Richard W. Priebe. Violation of Section 10-42 — Same property of another. NEW BUSINESS: Case #2006-CE-1215, 1330 Royal Palm Dr., Edgewater, Florida; Maurice A. Kaminski. Violation of Section 21-34.06 — Recreational vehicles. Code Officer Robin Bell presented the case summary to the Board. Code Officer Robin Bell presented staff's recommendation to find Maurice Kaminski in violation of Section 21-34.06 of the Land Development Code assessing a fine of $50.00 per day for each day the violation exists past April 20, 2006 and for a lien to be placed on the property, if the violation is not corrected and the fine not satisfied by April 25, 2006. Maurice Kaminski was present and testified. Mr. Kaminski testified that he owns the RV and it is not registered. Mr. Kaminski stated that he lives paycheck to paycheck and is planning on getting the RV registered and insured when he gets paid. Chairwoman Johnson closed the public hearing. The Board had a brief discussion. Jean Kayat arrived at 2:15 pm and will be excused from voting on this case. MOTION by Ed Corn, SECOND by Glenn Barnhill that the Board finds Maurice Kaminski in violation of Section 21-34.06 of the Land Development Code, to correct the violation by 5:00 pm on April 25, 2006 with the requirement to contact Staff with documentation proving the violation has been corrected. If the violation is not corrected by April 25, 2006 at 5:00 pm a fine of $50.00 per day will begin incurring on April 26, 2006 for each day the violation exists past April 26, 2006 and a lien will be placed on the property. MOTION, CARRIED 5 to 1, Case #2006-CE-2052, Lot 3020 Lime Tree Dr., Edgewater, Florida; Jane Church. Violation of Section 21-33.01 — Purpose. Code Officer Robin Bell presented the case summary to the Board. Code Officer Robin Bell presented staff's recommendation to find Jane Church in violation of Section 33.01 of the Land Development Code accessing a citation fine of $53.00 and an additional fine of $50.00 per day for each day the camping violation exists past April 20, 2006, and for a lien to be placed on the property if not satisfied by April 25, 2006. No witness was present for this case. Mr. Hooper gave a brief update on the case. Mr. Hooper stated that this is a health and safety issue which has been going on since January. Chairwoman Johnson asked Staff to clarify for the record what the violation is by the Code. Chief Barlow stated, under Section 21-33.01 permitted use chart. The matrix chart which was provided listed R-1 thru R-5, the (P) indicates what is permitted in the zone areas. Camping is not permitted anywhere in the City of Edgewater, therefore it City of Edgewater Code Enforcement Board Minutes April 20,2006 Page 2 of 2 is not permitted due to it is not recognized on the chart. Zoning on this lot is R- 2. The Board had a brief discussion. MOTION by Ben Wagner, SECOND by Gene Mirabella that the Board finds Jane Church in violation of Section 21-33.01 of the Land Development Code assessing a citation fine of $53.00 and an additional fine of$50.00 per day for each day the camping violation exists past April 20, 2006. Also for a lien to be placed on the property if not satisfied by April 25, 2006. NOTION CARRIED UNANIMOUSLY. OLD BUSINESS: None. CODE COMPLIANCE REPORT: None. PUBLIC COMMENT: None. BOARD DISCUSSION: Mr. Wagner had requested copies of the code pertaining to parking vehicles in residential areas and the City right-of-way. Mr. Harris gave the Board clarification regarding to the Land Development Code change process. Chief Barlow interjected some additional clarification and encouraged Board members to get involved with the Planning and Zoning Board for the Land Development Code. ADJOURNMENT Chairperson Linda Johnson adjourned the meeting at 3:12 pm.
