COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:10 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ed Corn, Ben Delnigro, Ben Wagner and Gene Mirabella. Also present were Code Officer Mike McGrath, Attorney Glenn Starch, Chief Tracey Barlow and Board Secretary Shontella Jackson. Absent were: Glenn Barnhill and Jean Kayat. Mr. Barnhill is excused due to prior notification. CASES IN COMPLIANCE: None. NEW BUSINESS: The Board has approved an amendment to the agenda to move agenda item of annual election to follow old business. The Board members had no objections to the agenda amendment. i CONTINUED CASES: Case #2006-CE-11074 (A), 3035 Orange Tree Dr., Edgewater, Florida; Barry D. Daniels II &Tracy L. Card. Violation of Section 21-34.06 — Motor home/trailers. Chief Tracey Barlow presented the case summary with background updates to the Board. Chief Tracey Barlow presented staff's recommendation to assess a fine of$50.00 per day for each day the recreational vehicle/trailers and camper violation continues to exist past June 16, 2006 and for a lien to be placed on the property if the violation and fine is not satisfied by June 19, 2006. Ms. Card was present and testified that her attorney, Mr. Birch asked that we postpone the case since he was unable to attend. A brief recess was requested by Mr. Delnigro at 2:18 pm. Chairwoman Johnson called the meeting back to order at 2:20 pm. Kourtnie Nand lal testified that Tracy Card is one of their clients. Ms. Nand lal stated that Volusia County has not closed the 2004 season as of yet. Ms. Nandlal stated due to the ligation issues we can not make any repairs to the home. Ms. Card stated that she received a letter from FEMA regarding her rent in June and that was the last time she had contact with FEMA. hI Ms. Card stated that they were given a citation issued on March 1, 2006, and presented a copy of a public record request she received from FEMA dated 2/27/06. Ms. Card requested an explanation of what notice of violation was faxed to FEMA on February 2. Chief Barlow replied that he was not sure what FEMA received but he will enter the City of Edgewater public record request into evidence as Exhibit 1 and there is no copy of what was faxed to FEMA attached to the document. Ms. Card stated that FEMA has not authorized another location for the trailer, they haven't even discussed it other than an brief comment last year, perhaps we can look into moving you to Brevard County and nobody said anything since then. Mr. Wagner asked Ms. Card why didn't she contact FEMA and ask that they relocate her to another location? Ms. Card stated that even if they moved it to some camp ground we couldn't afford to live in it because we would have lot rent, hook up, water and all that stuff. Plus the trailer payment, mortgage payment, electric and water at the home; we would be doubling everything and that would put us further behind on our coverage. Mr. Wagner stated to Ms. Card that if she was not living in the house and moved the trailer to an approved campsite, then she could cut off the utilities to the house and use that to pay lot rent at the campsite. Ms. Card stated that she is required to keep the air and heat running so that the mold does not get worse. Ms. Johnson asked, Ms. Nandial how long she has been working with Ms. Card? Ms. Nandlal replied since 2004. Ms. Nandial stated that she has contact with Ms. Card every single day. Chairwoman Johnson requested that the record reflect that the Board members each received a copy of Volusia Inter-Faith/Agencies Networking in Disaster (VIND) brochure as Exhibit 2 along with a business card of Kourtnie James Nandial as Exhibit 3. Chairwoman Johnson closed the public hearing. Mr. Storch advised Ms. Card to take what she heard today as an order but the order is that she has a 30 day grace period before the fines start incurring. OLD BUSINESS: None. NEW BUSINESS: ANNUAL ELECTION OF CHAIRPERSON AND VICE CHAIRPERSON Chairwoman Johnson stated that she was not sure if the Board had a formal amendment to the bylaws as far as date or month which the Board should have their election.
