Instrument# 2017-001631 # 6 • Bank : 7345 Page : 1721 RESOLUTION 2016-R-11 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, AUTHORIZING AN EXCHANGE OF LAND BETWEEN THE CITY AND DIVERSIFIED PROPERTIES OF FLORIDA, LLC OF PROPERTY LOCATED WITHIN EDGEWATER LAKES SUBDIVISION; PROVIDING FOR THE CREATION OF A PUBLIC RIGHT-OF-WAY OVER THE CONVEYED PROPERTY; AUTHORIZING THE MAYOR TO EXECUTE DEEDS AND OTHER INSTRUMENTS TO EFFECTUATE SAID EXCHANGE; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND APPLICABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, DIVERSIFIED PROPERTIES OF FLORIDA, LLC ("DIVERSIFIED") is the owner of property which constitutes a portion of Public Safety Boulevard n/k/a Booker Street,more particularly described in Exhibit"A"; and WHEREAS, DIVERSIFIED wishes to exchange its property described in Exhibit"A" . i • for an equivalent parcel of property owned by the City, more particularly described'in Exhibit "B"so that DIVERSIFIED will have access into the rear portion of its property;and WHEREAS, DIVERSIFIED has clear title to the property described in Exhibit"A"and has agreed to convey said property by Warranty Deed, free and clear of all encumbrances,to the City;and WHEREAS,The City Council of the City of Edgewater has determined that an exchange of the DIVERSIFIED property described in Exhibit "A" with the City property described in Exhibit"B" serves a valid public purpose by providing the City clear title to Booker Street and allowing DIVERSIFIED access to the rear portion of its property; and { IWHEREAS, the City will dedicate Booker Street as a 60 foot wide public right-of.way . ii 1 20 16-R-I I i . Book : 7345 Page : 1722 as described in Exhibit"C";and WHEREAS, pursuant to Chapter 166 and Article VIII, section 2(b) of the State Constitution, the City is authorized and empowered to exchange the property described in Exhibit"A"for the property described in Exhibit"C";and WHEREAS, the City Council of the City of Edgewater deems the above described exchange of property to be for a public purpose and in the best interest of the citizens of the City of Edgewater;and WHEREAS, a Notice of Public Hearing was published one (1) time in a newspaper of general circulation in the City of Edgewater by an advertisement that was published in the Daytona Beach News-Journal on February 22,2016. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. Authority. The City Council of the City of Edgewater has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. The foregoing recitals are hereby incorporated herein by this reference and are hereby ratified and confirmed as being true. Section 2. Exchange Authorized. The property owned by DIVERSIFIED, as described in Exhibit "A," shall be exchanged for the City's property described in Exhibit"B." Section 3. Dedication of Public Right-of-Way. Booker Street shall become a public right-of-way 60 feet wide and+1-1,466 linear feet long. Section 4. Authority of Mayor. The Mayor of the City of Edgewater is hereby authorized to execute any and all deeds or other instruments necessary to effect the exchange and reservation of easement authorized by this Resolution. 2 2016-R-11 Instrument# 2017-001631 # 8 • Book : 7345 Page : 1723 Section 5. Conflicting Provisions. All resolutions or parts of resolutions in conflict • herewith be and same are hereby repealed. Section 6.. Severability and Applicability. If any portion of this resolution is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this resolution. If this resolution or any provisions thereof shall be held to be inapplicable to any person,property, or circumstances,such holding shall not affect its applicability to any other person, property,or circumstance. Section 7. Adoption and Effective Date. This resolution shall take effect upon adoption. During the Council Meeting on March 7, 2016, City Council voted to continue Resolution No. 2016-R-11 until the April 2016 Council meeting.
