(.) u CITY OF EDGEWATER CITY COUNCIL SPECIAL MEETING AND PUBLIC HEARING MARCH 28,1983 ~1I NUTES Mayor Richard McKillop called the Special Meeting to order at 6:32 P.M. in the Community Center. ROLL CALL Mayor Richard McKillop Councilman David Ledbetter Councilwoman Gigi Bennington Councilman Neil Asting Councilman Jack Spencer Present Present Present Present Present City Attorney Josel Alvarez City Clerk Nancy Blazi Police Chief Earl Baugh Deputy City Clerk Susan Wadsworth Present Excused Present Present The Special Meeting was called to discuss and act upon the subject of the re-establishment of the Board of Governors. Councilman Asting said that in reading the by-laws of the past Board of Governors, he feels that the duties of the Board should be modified to be the management of public buildings and to recommend to the Council the rental fees for usage of the public buildings. He feels it would be very beneficial to the City and suggests at least a 5-member Board that would meet once a month. Walter Gross, 909 Lake Avenue, member and vice-chairman of the former Board of Governors, spoke to Council and said the Board of Governors had been very active in the City and put effort into getting grants for the City of Edgewater. They scheduled the rental of the Community Center and had it set up for the people of the City to benefit by this building. They scheduled meetings for the Shuffleboard Building and made recommendations to Council when problems came up for emergency repairs that might be a hazard. Councilman Asting suggested that any improvements made to public buildings or construction of new buildings could be handled by this board. and also the Police Department needs to be enlarged as there is no way of holding prisoners here, they have to take them over to the County. He feels this is an area that isn1t adequately covered in the City. Councilman Ledbetter said he's aware of what the functions were intended to be and suggested we pull some of the old by-laws and compare them with what they have tonight. Councilman Asting said he had outlined the scope of the duties of the Board and if it is re-established, they could prepare a new set of by-laws to be reviewed by the Council for Council's approval or disapproval. Councilwoman Bennington asked the number of boards in the City now and the Deputy City Clerk read the names of the current boards. Councilman Asting said that doesn't enter into it as this is a different area of City management and he felt we should have as many citizens as possible participate in City government. Councilman Spencer felt the subject came up in conjunction with the concern about the Shuffleboard court and the consideration of the rate fees for the Community Center usage. He felt we already have an existing board to handle both functions, the Parks and Recreation Board, and he didn't see a need to create another advisory committee. He read some of the duties of the Parks and Recreation Board. Councilman Asting said the Parks and Recreation Board is going to be mostly concerned with the athletic programs in the City. Walter Gross said that the Board of Governors has nothing to do with the recreation program. It is responsible to maintain our buildings in a good state of repair and over see the .pier. He feels it is a safety factor for the City and would eliminate the possibility of lawsuits in the future. There was a discussion regarding expanding or new facilities for the Police Department to include a holding cell. r - -~...-..... t u t U Councilwoman Bennington asked the duties and responsibilities of the Buildings and Grounds Department. The Deputy City Clerk said they are responsible for the buildings, the parks, and janitorial service for the Community Center. Councilwoman Bennington said the recommendation for fees should come from the administrative staff. Dana Armstrong, Cheeta Drive, referred to years ago when the Community Center was first built. He said there was a Board of Trustees established and then it was dissolved and the Board of Governors was formed and was answerable to Council. He does not think a board should be created just to give somebody a position on a board and suggested a committee of 2 or 3 people to keep the calendar. Councilman Asting moved to reconstitute the Board of Governors for the City of Edgewater to oversee the City-owned buildings and that this board consist of 5 members, that they have a set of by-laws prepared for this Board for review and comment by the City Council. Motion DIED for lack of second. Councilwoman Bennington moved that we do not consider the re-establishment of the Board of Governors again. Councilman Asting stated the motion died for lack of second so it shouldn1t come up again. Councilwoman Bennington withdrew her motion. Councilman Spencer moved to adjourn the meeting. Councilman Ledbetter seconded. Meeting was adjourned at 7:00P.M. PUBLIC HEARING MARCH. 28 ~ 1983 ~1I NUTES Mayor Richard McKillop called the Public Hearing to order at 7:02 P.M. in the Community Center. The purpose of the public hearing was for the second and final reading of Ordinance 83-0-6 on the election. ROLL CALL Mayor Richard McKillop Councilman David Ledbetter Councilwoman Gigi Bennington Councilman Neil Asting Councilman Jack Spencer Present Present Present Present Present City Attorney Jose' Alvarez City Clerk Nancy Blazi Police Chief Earl Baugh Deputy City Clerk Susan Wadsworth Pr-esent Excused Present Present The City Attorney read the ordinance. 83~0~6 - AN ORDINANCE OF THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, SETTING FORTH A PROPOSED CHARTER AMENDMENT THROUGH A SPECIAL ELECTION AMENDING SECTION 9A OF THE CITY CHARTER OF THE CITY OF EDGEWATER, BY REPEALING SAID SECTION IN ITS ENTIRETY; WHICH GIVES THE CITY COUNCIL OF THE CITY OF EDGEWATER, THE POWER TO APPOINT OR REMOVE A CITY MANAGER AND PROVIDE BY ORDINANCE HIS COMPENSATION, DUTIES AND POWERS; CONTAINING A REPEALER PROVISION: A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Councilman Spencer moved to open the Public Hearing. Councilwoman Bennington seconded. Motion CARRIED 5-0. There were no comments from the audience. Councilman Ledbetter moved to close the Public Hearing. Councilman Spencer seconded. Motion CARRIED 5-0. Councilman Spencer moved to adjourn the meeting. Councilman Ledbetter seconded. There was a question as to the wording of the special meeting notice and it was determined by the City Attorney that the advertisement in the newspaper was of sufficient notice for the Council to adopt this ordinance. Councilman Spencer withdrew his motion to adjourn. Councilman Ledbetter withdrew his second. Councilman Asting moved to adopt 83-0-6 and that the Special Election as stated in the ordinance be scheduled. Councilman Ledbetter seconded. The City Attorney read the ordinance again and said the ordinance consists of six sections and this is a standard format as prepared by the Department of Elections.
