02-21-1983 - Special . u u ~- CITY OF EDGEWATER CITY COUNCIL SPECIAL MEETING FEBRUARY 21, 1983 MINUTES Mayor Richard McKillop called the Special Meeting to order at 1 :00 P.M. in the Community Center. This was tabled until the official report came in from the Bureau of Industrial Safety and Health. The City Clerk read the February 16th letter: The following report is submitted in response to an employee complaint received by the City of Edgewater. COMPLAINANT: Mary Hines - Union Representative, Public Works Department, City of Edgewater, Florida. Date of Complaint: February 8, 1983. Date of Investigation: February 11,1983. COMPLAINT #1: The roof of the office building leaks badly. Water stands on the floor in several places after each rain. During inclement weather, electric space heaters have been sitting in water on the floor. Water stands for considerable periods of time on the floor of the toilet. FINDINGS: The roof sags badly in several places and rotten boards can be seen around the structure. Water spots can be seen on the floor and on the walls near the electric panel. Councilman Asting suggested they could take these complaints one at a time and discuss them and find out what we're going to do to remedy the complaint and then go on to the next one. Council agreed. The City Clerk continued: Safety rules and provisions:-penalty.(l) Every employer as defined in S.440.02 shall furnish employment which shall be safe for the employees therein, furnish and use safety devices and safeguards, adopt and use methods and processes reasonably adequate to render such employment and place of employment safe, and do every other thing reasonably necessary to protect the life, health and safety of such employees. RECOMMENDATIONS: Employees should not be allowed to work in these conditions. An alternate location for these employees shall be designated. This is serious and shall be corrected immediately, or not later than March 11,1983. The City Clerk stated that Mr. Copeland had given her an estimate on the roof repair of $1,700. There was also an estimate to finish the inside of the building for about $2,300. There was a discussion as to just what these estimates would cover and what else that was cited which would still need repair. Councilman Asting moved to authorize an emergency repair of the roof for the $1,700.,Councilwoman Bennington seconded.Motion CARRIED 5-0. The City Clerk read the next complaint-#2: Employees are required to work using faulty equipment. For example, the road grader now in use does not have any brakes. Councilman Asting asked if the rest of complaint..#l is to be passed over or our City forces make the repairs. Mayor McKillop suggested doing those items that are essential to life, safety and health and come back to the others. There was a discussion about the road grader necessity. There was an estimate for repairs presented for $16,421.53 for the brakes, and the figure to date spent was $7,824.63 for repairs and parts. There was discussion about leasing or hiring a contractor and finding a source for the repair parts. It was decided that these items would be checked out and then another meeting called. The City Clerk then read complaint #3: Employees do not always use the restraining device when servicing split-rim wheels. The device does not look safe. RECOMMENDATIONS: Discontinue using this device. Cage should have bars substanitally closer together and from four to six bars on each side of the wheel. Safety devices are of little value unless employees are required to use them. The City Clerk stated that Mr. Copeland thought they could fix them and we could have it re-inspected for approval. Mr. Copeland confirmed they could add the bars. Mayor McKillop noted for the record that they are not to use the machine until it is repaired, and to use Goodyear until modification is done. The City Clerk read complaint #4: Only one toilet is available for use by twenty-two employees, including females. Discussion followed regarding the proposed partitions in the existing building. and that it would include this bathroom. The City Clerk stated on complaint #5 regarding the insufficient break area, that would be taken care of with the partitioning of the room and would be in-house. There was a discussion regarding the heat, air conditioning, or ceiling fans. ~ . ,/~ '-i u The City Clerk read complaint #6: The electrical feed to the office building is "falling down" over gas pumps and gasoline storage tanks. The City Clerk stated she understood this will be fixed when the roof is fixed. Council agreed to that. The City Clerk read complaint #7: Employees are allowed to spray paint in the main garage area in the vicinity of a wall-mounted gas heater and general shop activity, including welding. She said he had reported there was no evidence of spray painting in that area and it should be prohibited in the area and only permitted in an approved spray booth. There was discussion about the need for a spray booth. Councilman Spencer suggested asking Mr. Copeland to get prices to do automobile and pickup truck spray painting and tell us if itls economically justified based on the number we do per year versus having them done commercially. Councilman Asting asked about the roof on the main building as held been told it leaks around the seams. Mr. Copeland said he knows a man who seals the seams and he'll get an estimate as soon as the man returns from out of town. Council agreed that the price of $1,700. to repair the roof has to be firm. The next item was the Public Works Department Review. Council had said they would review all department heads and supervisors. Council was given an organizational chart and a job description for employees in this department. Councilman Ledbetter said Mr. Fuller, the Safety Representative, had told him it would be a good idea to have an equipment maintenance check list to protect the equipment there. Mayor McKillop reviewed the organizational chart and the number of employees in each division. There was discussion about the number of employees in the Street Department and the number of miles to be maintained in the City. The City Clerk stated she is working on a pay scale to match the job classifications. There was then a discussion on the Refuse Department number of employees and equipment, and a seasonal use of employees on the garbage trucks due to the drop-off in the summer. Mayor McKillop said held like to see some daily operating plans drawn up. There was a discussion on the amount of time cleaning the ditches with one piece of equipment, plus the culverts installed and the swales. Councilwoman Bennington asked that Mr. Copeland come up with a plan of what he thinks they need to get projects accomplished so that the Council will have something to work with. Councilman Spencer asked that Mr. Copeland prepare a list with priorities as to the paved roads maintenance and the shell road maintenance and plans for paving. Councilman Asting felt Council should consider a millage increase to provide funds for road paving and re-surfacing as Councilman Ledbetter had suggested earlier. Councilman Ledbetter felt the Council should prepare the plan and submit it to the department to be carried out. The next item was the Parks and Recreation Department Review. Councilwoman Bennington asked Mike Avery, Superintendent, about the part time recreation director that was in the budget. Mr. Avery said he got a laborer with that money. There was a discussion of the total number of employees and their responsibilities. Councilwoman Bennington compli- mented him on the cleaning of the Community Center. Councilman Spencer asked about the expenditure under professional services which was not budgeted. Mr. Avery said that was for grant work for Menard and Park and Pier. Councilman Spencer noted the total budget for the year for repair and maintenance is $5,000 and hels spent $3,000. Mr. Avery said he gets charged for City Hall, Community Center, Shuffleboard, and Ballfields combined in that, and the major bills were the clay to do both baseball fields. Council agreed that next year the budgets should be separated to get a clearer picture of expenses. There was a discussion about the use of the Federal Revenue Sharing money. Mayor McKillop asked if there is a plan. Mr. Avery said he writes it down each morning for the ballpark and the men keep their own books and he verbally tells the City Hall complex. Councilman Ledbetter said that anytime they do work for another department you should back charge the materials and time. Mayor McKillop asked why there would be back charging if the department is responsible for all City buildings. There was a discussion as to how this might be handled when they prepare the new budgets. Councilman Spencer asked about the boat docks and the safety hazard there. Mr. Avery said he'd get treated lumber and replace the ones that are questionable. Mayor McKillop asked that Mr. Avery make up an operating plan to submit to Council.
