CITY OF EDGEWATER
CITY COUNCIL SPECIAL MEETING
November 3, 1982
Mayor Christy called the special meeting to order at 4:00 P.M. in the
Community Center. The purpose of this meeting was to transmit the returns
and count absentee ballots for the General Election held on 11/2/82.

The City Clerk told the Council that there were 63 absentee ballots. Two
of these ballots had not been signed in both places although they were
properly witnessed. The Council agreed to accept these two ballots and
allow them to be counted. Mayor Christy called a brief recess while the
ballots were opened.
The Meeting was called back to order and the absentee ballots were
counted twice. The number of absentee ballots were added to the returns
from the General Election.
The City Attorney read Resolution 82-R-62 A RESOLUTION DECLARING THE
RESULTS OF THE REGULAR GENERAL ELECTION HELD IN THE CITY OF EDGEWATER,
FLORIDA, ON NOVEMBER 2, 1982; REPEALING ALL RESOLUTIONS IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE. The Resolution declared
that Mr. McKillop was Mayor; Mr. Ledbetter was Councilman from Zone 1;
Ms. Bennington was Councilwoman from Zone 2; Mr. Asting was Councilman
from Zone 3 and Mr. Spencer was Councilman from Zone 4.
Councilman Wilbur motioned to adopt this resolution, seconded by
Councilman Ledbetter.
Councilman Lodico said that there had been questions raised whether or
not Mr. McKillop, as Postmaster, would be holding two "offices" and he
requested that the City Attorney clarify this matter. Mr. Alvarez
responded by saying that he had researched this matter and concluded
that the position of Postmaster was not an "office." The Postmaster
has authority only over the employees directly underneath him and no
authority to make policy. Since 1970, the Post Office Department has
been known as the U.S. Postal Service and is no longer under the President
as it used to be. The Postal Service is run by a Board of Governors.
The Postmaster is just another employee of the service and does not
hold an "office". Mr. Alvarez said that based on this research, it
is the opinion of the City's Legal Department that Mr. McKillop could
serve as Mayor. .
Upon roll call the motion to adopt CARRIED 4-0.
Councilman Wilbur motioned to adjourn, seconded
The meeting was adjourned at 5:00 P.M.
