10-19-1981 - Regular ~. .'#' .. ~ ".. .,: ':" . - ,- ~ CITY CITY OF EDGEWATER COUNCIL PUBLIC HEARING and REGULAR MEETING October 19, 1981 u Mayor Christy called the meeting to order at 7:00 P.M. In the Community Center. ROLL CALL Mayor Robert H. Mayor Christy opened the Public Hearing for discussion of Ordinance 81-0-37 which concerns the extension of the limited area for permitted uses in the B-2 Zone along the F.E.C. right-of-way between 20th and 30th St. There were no comments from the audience. The next item for discussion at the Public Hearing was Ordinance 81-0-38 which concerns the parking of emergency vehicles in residential areas. There were no comments from the audience. Mayor Christy closed the Public Hearing. APPROVAL OF MINUTES - Councilman Wilbur motioned to approve the minutes of October 5, 1981, seconded by Councilman Lodico. Upon roil call motion CARRIED 4-0. The City Manager requested that the Council reconsider the minutes of Sept. 28, 1981. Mayor Christy said that the minutes had been voted on and they should remain as not accepted. The City Attorney said that these minutes could be brought back for another vote since this is the historical record of the City. Councilman Lodico said that the minutes of Oct. 5, 1981 reflect the corrections that the Mayor complained about in the Sept. 28th minutes. He motioned to accept the minutes of Sept. 28, 1981, seconded by Councilman wilbur. There was some discussion concerning the correction of the minutes and the motion by Councilman Lodico. Councilman Lodico again motioned to accept .the minutes of Sept. 28, 1981 as they have been corrected. Councilman Wilbur seconded this motion. Upon roll call the motion CARRIED 3-1. Mayor Christy voted NO. BILLS AND ACCOUNTS - Councilman Wilbur motioned to pay the bills, seconded by Councilman Lodico. Mayor Christy questioned bills for $719.00 (Council Chamber chairs) , $70.00 (installation of map in Chambers), $56.00 (Subscription for Utility Dept. Supv.) $1,118.00 (dumping fee, Refuse Dept.) $482.00 (Fla. League of Cities dues) $324.00 (technical books for F & A). Upon roll call the motion to pay the bills CARRIED 3-1. Mayor Christy voted NO. COMMUNICATIONS - Letter from Zoning and Planning Bd. concerning their recommendation on the parking of emergency vehicles in residential areas. The Board voted unanimously to permit the parking of emergency vehicles in a residential area only when sucfu vehicles are on call by the City of Edgewater for emergencies. Mayor Christy said this should be taken into consideration when the ordinance is voted on. Letter from Zoning and Planning Bd. commending the City Attorney for the outstanding work he has been doing with the Board. Letter from Fulton Real Estate requesting removal of easement on certain property owned by Marge Fulton. J.. " - , ,,' ..- v '-J MISCELLANEOUS Councilman Lodico asked the Mayor about the meeting he attended in DeLand. Mayor Christy said that he had already spoken to the Council about the Courthouse Annex in New Smyrna Beach. However, he has also spoken about the kennels that were proposed on the outskirts of Edgewater. The application to the County to build these kennels has been denied. \ Mr. Frank Opal, Florida Shores, read a letter to the Council that he had written to the News and Observer which the newspaper has not yet published. The letter concerned Mayor's lawsuit, allegations against the City Manager, etc. The Council objected to the personal names that Mr. Opal referred to and the Mayor reminded Mr. Opal that it is against the Charter to make personal references. Mr. Carmen Montesan~ , Florida Shores, told the Council he had taken pictures in Florida Shores and he would see them in Court. Mr. Kenny Clinton, Florida Shores, asked about the extension of cable television into Florida Shores. The City Manager said that he had been in contact with the Teleprompter people and letters have been written to ask when the schedule is for extending lines into Florida Shores. This should be done in 1982 and the question still remains when they will start this. It is up to the main headquarters and we are waiting for an answer. There was a discussion concerning the franchise. Mayor Christy requested copies of the franchise agreement for all Council members. (d.l) OF THE ZONING ORDIN NCES, APPENDIX A, CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, TO EXTEND THE LIMITED AREA FOR PERMITTED USES TO THAT AREA ZONED B-2 ALONG THE F.E.C. RAILROAD RIGHT-OF-WAY BETWEEN 20th ST. TO 30TH ST. REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. (Second Reading). . 'V ,~ Councilman Pendleton motioned to adopt this ordinance, seconded by Councilman Wilbur. Upon roll call motion CARRIED 4-0. The City Attorney read Ordinance 81-0-38. AN ORDINANCE DEFINING EMERGENCY VEHICLES AND EXEMPTING SAME FROM PARKING RULES AND REGULATIONS WITHIN THE CITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. Councilman Wilbur motioned to deny adoption of this ordinance, seconded by Councilman Pendleton. Upon roll call motion CARRIED 3-1. Mayor Christy voted NO. Councilman Wilbur stated that he did not want to adopt this ordinance because after requesting that the Council give some relief from parking restrictions, Mr. Montesano instituted a lawsuit against the City. Councilman Pendleton said that he had not had sufficient time to study the effect this ordinance might have on the parking of other vehicles in a residential area where there might be complaints from neighbors or not enough room to park the vehicle. We might be opening the door to something we may have to correct later on. Councilman Lodico said that he felt this could be considered spot zoning. Mayor Christy said that he voted to adopt because he thought the Council was in agreement on this emergency ordinance. UNFINISHED BUSINESS - The City Manager read a letter from the Governor to the Edgewater Fire Dept. commending them on the performance of their duty during the Crane Swamp Fire. Mayor Christy requested that the original letter be given to the Fire Department for their records. The City Manager also read a list of the new officers of the Fire Dept. effective Nov. 1, 19 81. Councilman Wilbur motioned to authorize the attorney to draw up a resolution naming the new officers for the Fire Dept., seconded by Councilman Lodico. Upon roll call the motion CARRIED 4-0. This resolution will be presented for adoption at the November 2, 1981 Council meeting. The other item before the Council concerning the Fire Department was the new contract with the County for FY 1981-82. Councilman Wilbur motioned to authorize the Mayor to sign the contract for the City, seconded by Councilman Pendleton. Upon roll call motion CARRIED 4-0. Fire Chief Severance spoke to the Council thanking them for the support they have given to the Fire Department during the past year. He also specifically mentioned the Police Dept. and Dispatchers, Richard Iasimone, mechanic, the City Manager, Debbie Sigler, Accounts Payable, the other City Departments, Terry Wadsworth, Earl Copeland, Nancy Blazi, City Attorney and all the citizens of Edgewater who have supported the Fire Department. A letter from Terry Wadswbrth, Sup~rvisor of Utilitie~, was read concerning the water break at wildwood Subdivision on 9/24/81. Mr. Wadsworth explained that this break was caused by the contractor while attempting to upgrade the condition of the drainage canal and that the contractor was assuming the cost for repair and water loss. NEW BUSINESS The City Attorney discussed the civil action brought by Carmen Montesan~ against the City. The charges are against the building department and the police department and both supervisors have assured the attorney that these charges are false. The attorney needs Council authorization to defend this suit. Councilman Wilbur motioned to authorize the City Attorney to do what is necessary in this matter, seconded by Councilman Pendleton.
