07-12-1982 - Special "':f' u u CITY OF EDGEWATER COUNCIL PUBLIC HEARING July 12, 1982 Mayor Christy called the Public Hearing meeting to order at 7:00 P.M. in the Community Center. There was a silent Invocation and a salute to the Flag. Joseph Mitchell City Clerk Nancy Blazi Police Chief Earl Baugh Present Present Present Present Mayor Christy noted that the Public Hearing had been called pursuant to Resolution 82-R-32 for the purpose of complying with the require- ments of 170.07, Fla. Stat. The meeting is for the purpose of hearing the owners of property to be assessed and other persons interested as to the propriety and advisability of making the proposed improvements, as to the cost thereof, as to the manner of payment therefor, and as to the amount thereof to be assessed against each property so improved. The proposed improvements are for paving or hard surfacing of streets within the Florida Shores Subdivision more particularly described as: Pine Tree Drive between 30th St. and 21st St., Pine Tree Drive between Indian River Blvd. and 12th St., Travelers Palm between 12th St. and 30th St. and Vista Palm Drive between 22nd St. and 30th St. The City Attorney read from the State statutes regarding the procedure for assessments. The City Clerk read into the record two letters from property owners objecting to the proposed improvements. Mr. Montesano spoke to the Council about the possibility of a drainage problem in connection with paving. Mrs. Poates told the Council she objected to the front foot assessment. She also asked what the estimated cost would be for this project. Mr. Mitchell spoke about the estimated cost. At this time, the estimated cost is $4.10 per lineal foot or about $328.00 for the average size lot of 80 ft. It has been suggested that the cost for property owners could be extended over a five year period at about $6.20 a month. The City would borrow the money at a municipal rate of interest which would be paid back as property owners paid their assessment. Mr. Nahikan spoke against the proposed improvements. Mr. Rocks questioned whether or not there would be sufficient maintenance funds to keep these new roads in good repair. Mr. Lamanec brought up the drainage question but added that he felt paved roads were needed. Mrs. Murphy questioned the type of road to be installed. Mr. Hoffmeister spoke in favor of the paving as did Mr. Lawson. Mr. Glaser and Mr. Chenowith favored paving and Mr. Chenowith added that possibly some property owners could also have driveways paved at the same time. Mr. Mitchell said that the City could not become involved with the paving of driveways but certainly the paving contractor could be approached by individual property owners and might agree to pave drive- ways for a reasonable charge. Mr. Thompson, Mr. Newman and Mr. Wright also spoke in favor of the proposed paving. Mr. Mosley questioned the cost of the program and noted that it might create a hardship for some property owners. Mr. Mitchell said that real hardship cases would be reviewed on an individual basis and adjustments made. Other members of the audience speaking in favor of paving were Mr. Muzzy, Mr. Holahan, Mr. Lupinek and Mr. McMahon. Mrs. Brogan asked when the property owners would have to pay for the paving and was told that they would be billed after the paving had been completed. Mr. Opal spoke about drainage and also the question of a possible bond issue for paving all of Florida Shores. ---:t~ Q u . , The majority of those present at the Public Hearing appeared to favor the paving program and felt that it would be money well spent in regards to their own property. There was some discussion about future plans to install sewers. Mr. Mitchell discussed the involve- ment of our consulting engineers in this project. The engineers developed the specs for the project and will inspect the work. If sewers are installed in the future there should not be a need to tear up any paving. Mayor Christy closed the Public Hearing. The Council discussed the steps necessary in continuing with this proposed project. Bids for the paving contract will be presented to Council at the next regular meeting along with the recommendations of the consulting engineers. Councilman Wilbur motioned to authorize the City Attorney to prepare the necessary resolution to approve the assessment on a front foot basis, seconded by Councilman Pendleton. Motion CARRIED 3~2. Councilman Ledbetter and Mayor Christy voted NO. Councilman Wilbur motioned to adjourn the meeting, seconded by Councilman Lodico. Meeting was adjourned at 9:20 P.M.
