CITY COUNCIL SPECIAL MEETING
August 19, 1982
Mayor Christy called the Special Meeting to order at 1:00 P.M. in
the Community Center. The purpose of the special meeting was to
allow citizen input for the use of Federal Revenue Sharing Funds.

Mayor Christy informed the Council that according to Federal Laws
we must have the information available during working hours and hold
the hearings after working hours so that every working person can have
the opportunity to be able to be heard. Technically, according to
Federal Law we are in violation of the law by having the public hearing
now.
The City Manager told the Council that the present meeting arose from
the problem encountered when the public hearings were adjourned on
August 16th. The City auditors, May, Zima, were contacted concerning
the Federal Revenue Sharing proposed use hearing and advised the
City Clerk that a notice in the paper of the adjournment and rescheduling
of the hearing would meet the requirements. This is a use hearing
rather than a budget hearing.
The City Clerk read the total of Federal Revenue Funds for FY 1983.
Anticipated Federal Revenue - $86,942.00 and Unexpended Federal Revenue-
$28,138.00. This is a total of $115,080.00.
The City Manager added that to update these figures the new expected
total rather than $86,942.00 would be $91,202.00.for a total available
of $91,637.00 new money or carryover plus the other authorizations.
The purpose of this hearing is to receive citizen input as to their
ideas as to how the money should be spent.
Mayor Christy opened the public discussion which he added was illegal.
Mr. Opal spoke to the Council in criticism of the advertising and the
fact that there were so few people at the meeting. He added that the
$115,000.00 was enough to cover part of the street paving program.
He agreed with the Mayor that this meeting was illegal.
There were no further comments from the audience. Mayor Christy
also noted for the record that he would be filing papers with Washington
because this meeting is illegal.
Councilman Wilbur motioned to adjourn the public hearing.
Councilman Ledbetter suggested that the Council should readvertise for
next Council meeting.
The City Clerk advised the Council that 10 days notice was needed
for a proposed use hearing on Federal Revenue. This regulation was
complied with and then subsequent to the adjournment of the public
hearing last Monday, she was told by May, Zima to put another notice
in the paper stating that the public hearing had been rescheduled for
August 19th. This notice appeared in. the paper. We are also scheduled
for two budget hearings on Federal Revenue Funds.
The City Manager said he believed we had met the requirements of the
law but there is no reason why on Sept. 8th when we have the introduction
to our budgets that we cannot have an additional input on revenue funds.

The City Manager continued by saying that because of the auditor's
advice the City feels that the requirements have been met. However,
because of Councilman LedbetteE:' s suggestion, the City will schedule
a second use hearing.
Mayor Christy noted that if this was considered a legal hearing he
would file papers with Washington.
The City Manager said this could result in denying the public the
use of these funds.
Councilman Pendleton told the Mayor he could be jeopardizing the
City's Federal Revenue Sharing grant.
The suggestion was made to recess this meeting until Sept. 8th.
Mayor Christy said they should adjourn this meeting and call that
other meeting a new meeting.
The City Manager advised the Council to adjourn and move for an
additional hearing to be held Sept. 8th.
Councilman Pendleton said the motion had been made to adjourn and
he would second it.
Meeting was adjourned 1:20 P.M. Mayor Christy said a public hearing
would be held on Sept. 8th.
