CITY COUNCIL OF EDGEWATER
PUBLIC INFORMATION SESSION
JANUARY 14, 2004

MINUTES
MEETING PURPOSE
The purpose of the meeting was to provide a Sunshine Law
information session to the members of City Boards and Committees,
including Voting Conflicts, the Florida Sunshine Law Update and
the Florida Public Records Law.
FLORIDA PUBLIC RECORDS LAW, FLORIDA SUNSHINE LAW UPDATE AND
VOTING CONFLICTS
City Manager Hooper went over the meeting schedule.
City Attorney Cookson made a presentation regarding the Florida
Public Records Law. (Attached)
Paul Rosenthal, Foley & Lardner, made a presentation regarding
the Florida Sunshine Law Update. (Attached)
Ed Storey, Foley & Lardner, made a presentation regarding Voting
Conflicts. (Attached)
City Attorney Cookson suggested if they have any questions to
contact City Manager Hooper or Paralegal Matusick and let them
know what their problem is, and if they feel it is something they
need to get them involved in, they will contact them.
City Attorney Cookson, Attorney Rosenthal, Attorney Storey and
City Manager Hooper answered questions presented by the Board and
Committee members and Council.
City Manager Hooper encouraged the Boards and Committees if they
have any further questions to contact him or Paralegal Matusick
and they will get in touch with City Attorney Cookson.
PLANNING AND ZONING BOARD'S ROLL AS BOARD MEMBERS
City Manager Hooper made a presentation regarding the roll of the
Planning and Zoning Board as defined by Article VIII of the Land
Development Code. (Attached)
Councilwoman Lichter presented comments pertaining to when she
served on the Planning and Zoning Board in Connecticut as well as

Edgewater. She feels you see things different when you are on
the Council. Advisory is totally different than having total
responsibility.
Councilwoman Rhodes commented on it being rare that she disagrees
with the Planning and Zoning Board. What comes from the Board is
her primary guide on Council. She appreciates the job they do.
Mayor Schmidt agreed with Councilwoman Rhodes. He feels they all
have the confidence of the people that serve on their Boards and
that the best interest of the City is all of their number one
goals.
City Attorney Cookson and City Manager Hooper answered questions
presented by members of the Planning and Zoning Board.
Councilman Vincenzi commented on being at the December Planning
and Zoning Board to express his displeasure of the actions of the
City Council.
City Manager Hooper and City Attorney Cookson further answered
questions presented by members of the Planning and Zoning Board.
Councilman Brown thanked everyone for being on the Board.
Councilwoman Rhodes commented on if the Board has issues, they
can contact the members of the Council.
City Manager Hooper explained it the Planning and Zoning Board
has a list of things they would like to recommend the Council
consider, they need to bring it up and vote on it. That is a
good formal transfer of knowledge information from them to the
Council. They can meet with City Manager Hooper or Chief Planner
Lear. He strongly discourages the Council, as well as other
Board members from attending other Board meetings, but they are
allowed to attend.
ADJOURNMENT
There being no further business to discuss, the meeting was
adjourned at 6:10 p.m.
