JUNE 16, 1983
MINUTES
Mayor David Ledbetter called the Workshop of Council to order at 1 :12PM in the Community
Center. The Workshop was called to discuss the Part-Time City Engineer position.

Also present was Mr. Sam Tucker, an appl icant for the position of Part-Time City Engineer.
Councilman Asting moved to recess the Workshop to go into the scheduled 1 :15 PM Special
Meeting. Councilman Spencer seconded the motion. Meeting was recessed.
SPECIAL MEETING
Mayor David Ledbetter called the Special Meeting to order at 1 :15 PM in the Community
Center. This meeting was called due to the health condition of the Building Official.

Mayor Ledbetter stated this meeting was called due to the emergency with the Building
Official's health for Council to discuss and take action on the authority for a temporary
replacement in the Building Department.
Mayor Ledbetter said that due to the fact that Mr. Bradshaw was released from the hospital
this morning and will be back to work on Monday, he would suggest a motion to take no
action on this.
Councilman Spencer said a situation 1 ike this could occur in the future and Council should
consider what would happen in those circumstances, such as someone becoming famil iar with
his duties.
Councilman Asting stated he felt we should have someone on a standby basis to step in
when necessary.
Councilwoman Bennington said she'd contacted a member of the Building Code Board and
asked if anyone on the Board was qual ified to do it and was told that only one member
was qual ified and he didn't have the time to do it, but held given her two names, Ray
Hester and Lorin Coppock. She'd contacted Ray Hester and he told her he was retiring
and wouldn't be able to do it, and when she contacted Mr. Coppock, he wasn't home and
she talked with Mrs. Coppock who said she felt he would do it on an emergency basis.
Councilman Asting said we'd have to come up with some amount for remuneration for someone
on an emergency basis.
Mayor Ledbetter said he could do the building inspection but not electrical and plumbing.
Councilwoman Bennington stated the Building Code member also suggested Mr. Charl ie Murphy.
Mr. Robert Christy,memberoftheaudience,suggested the Engineer that is being considered
do these inspections since he has to have this background to be an Engineer.
Councilman Spencer said that's one thing they can talk with Mr. Tucker about but perhaps
if licensed inspectors are available it might be more desirable. He questioned if there
was a need to advertise. Councilwoman Bennington did not feel there was a need to adver-
tise unless Mr. Bradshaw was out for an extended period of time.

Councilman Asting moved that Councilwoman Bennington follow up on Mr. Coppock and
report back to Council to see if he's available. Councilwoman Bennington said she'd
report at Monday's regular meeting. There was a discussion about how a reimbursement
could be determined.
Mr. Dana Armstrong, a member of the audience, asked if Mr. Bradshaw is a Building
Inspector or a Building Official. Mayor Ledbetter said he is an Official. Mr.
Armstrong said if he's an Official he has the prerogative of choosing between the trades
unions and organizations in Edgewater if he has the qualifications under the Southern
Standard Building Code.
Councilwoman Bennington seconded the motion for discussion, and said when they have
the workshop with Mr. Bradshaw they can go over all the alternatives.
Councilman Spencer referred to the problems Mr. Coppock had with New Smyrna Beach but
had no objections to Councilwoman Bennington's checking to see if he is available but
would not make any kind of commitment.
Motion CARRIED 3-1. Mayor Ledbetter voted NO.
Councilman Spencer moved that the Special Meeting be adjourned. Councilman Asting
seconded the motion. Meeting was adjourned.
WORKSHOP
Mayor Ledbetter called the Workshop of Council back to order at 1 :30 PM.
Mr. Sam Tucker stated he has submitted his resignation to Volusia County as a full
time employee to be effective July 8, 1983. He said it's possible he could be avail-
able before that time by taking leave. He said he is still interested in the position
of part-time City Engineer for the City of Edgewater.
Councilman Spencer asked the City Clerk to verify that there is no problem as far as the
County is concerned. He also asked about the response from Briley, Wild to City Attorney
Alvarez's letter regarding the Cityls plans to hire a Part-Time City Engineer.
Mayor Ledbetter asked Mr. Tucker the hourly rate quoted and he said he had left that
open for discussion and negotiation. Mayor Ledbetter said he felt the consulting
engineers would have to handle water and sewer due to Ordinance 400.
Councilwoman Bennington asked Mr. Tucker about fill ing in for the Building Official and
he said he doesn't consider himself an expert on electrical and plumbing and a repre-
sentative from the electrical trades or plumbing trades is a means of getting temporary
help.
Councilman Spencer asked if Ordinance 400 pertains 100% to all extensions and replace-
ments of pipes in the systems or is it related only to the sewer treatment and water
plant. Mayor Ledbetter said he interpreted the ordinance as the system as a whole.
Mr. Tucker said he felt consulting engineers were to be available for protection of
the bond buyers so that there was no misuse,or inoperable or inefficient systems.
Mayor Ledbetter said before any change can be made, two-thirds of the bond holders have
to concur with that change according to Ordinance 400. There was a continued discussion
on Ordinance 400.
Mayor Ledbetter said the drainage system in Florida Shores would be one of the main
interests, plus some of our subdivisions that have drainage problems.
Councilman Asting suggested Mr. Tucker be available for site plan reviews.
Mayor Ledbetter said the budget needs to be checked for funds available for a City
Engineer and held also 1 ike to see the zone one seat filled before definite action
is taken. Councilman Spencer suggested Council could take action on Monday night at
the regular meeting since the Workshop is being held today. Councilwoman Bennington
didnlt feel it would be beneficial to wait until after the election since these four
members of Council are the ones who have talked with Mr. Tucker.

Councilman Spencer suggested that Department Heads who need the Engineer's services
should request this through the office of the City Clerk.
Councilwoman Bennington suggested going with an hourly salary since budget preparation
for next year will begin soon and they can determine if it's more beneficial to put him
on a retainer or to put him on an hourly rate.
Councilman Spencer said he'd requested that the subject of part-time City Engineer be
put on the agenda for next Monday night's regular meeting and Council can take action
at that time if they desire to do so. He felt there should be an agreement drafted
between the City and the part-time Engineer. Councilman Spencer proposed $20.00 an
hour for Mr. Tucker's services which would include his providing his own transportation
and no remuneration for mileage.and as a part-time employee he would not be el igible for
City benefits.
Councilman Asting asked about City business outside the City 1 imits and he felt this
should be considered. There was a discussion as to just what circumstances would warrant
his travel out of the City 1 imits on City business. Councilman Asting felt Council
authorization should be obtained if there's a request to attend a conference or seminar.
Council members discussed the possibil ity of the Engineer's using the official City car.
Councilman Spencer said he wanted a very simple, uncompl icated agreement without the
necessity of a lot of recordkeeping. Councilman Asting felt the agreement should be
drawn up by the City Attorney in a draft form.
Mr. Tucker said he understood that transportation to and from his home to the City
would be his responsibil ity and then an arrangement made of either using his car within
the City or using a City car.
Councilman Spencer felt the agreement should. include a statement as to the kinds of duties
he should perform. Councilwoman Bennington said the City Attorney could review the
Briley, Wild contract to see what items we aren't locked into with them. Councilman
Spencer said he preferred tell ing Briley, Wild the things this Engineer will do and then
let them tell us if they have an objection. Mr. Tucker said he felt he could do the
subdivi~m .reviews without sending them to Briley, Wild which should be a considerable
savings. Mr. Tucker said he didn't feel day to day requirements would fall under Ordinance
400.
Mayor Ledbetter stated there would not be a regular meeting on July 4th due to the holiday
but a meeting would be called one day that week and there would be a full Council by
then and a financial statement would be available and the agreement could be acted upon
at that Special Meeting. This would give the City Attorney time to draw up the agree-
ment and present it to Mr. Tucker and to Council for their review.
Council members discussed the hourly rate and agreed that $20.00 could be used to work
up a financial figure. Councilman Asting suggested the City Clerk contact the City
Attorney and give him the information discussed here and request he start working on
a draft agreement. Council agreed they'd 1 ike to have this available by Friday, June
24th, for distribution to Council. Mayor Ledbetter noted that will also give the City
Clerk time to come up with a financial figure and the new Council member will have it also.
Mr. Tucker asked if copies are available of the City Charter and an organizational chart.
City Clerk Nancy Blazi said she'd get the information for him. Mr. Tucker asked if the
designation of a City Engineer is included in the Charter and Councilman Asting said no.
Councilman Asting said the position would be responsible to the City Council through the
City Clerk. Councilman Spencer said it would also be as a consultant to the Department
Heads and to the City for site plans and drainage problems.
Mr. Tucker said there was a meeting of County Council that afternoon on the proposed 4c
gasoline tax and asked if Council had taken action on it. Councilman Asting said they
passed a resolution opposing it. Mr. Tucker said if it does pass there would be some
funding and it could include drainage and re-surfacing and other projects.

There was a continued discussion on the pros and cons of the gas tax and its influence
on economy. ~.
Councilwoman Bennington moved to adjourn the meeting. Councilman Asting seconded the
motion. Meeting was adjourned.
