The first item to be considered was a Request from Zoning Commission to have re-zoning six
times a year. City Attorney Alvarez stated if this is considered for change, he would have
to be directed to prepare an ordinance which would have to be adopted at two separate
readings and would be subject to public hearing. Councilman Spencer asked why the original
ordinance was adopted, limiting it to four times a year.
Mr. Robert Christy, 1916 Evergreen Drive, former Mayor, was in the audience and stated this
was set at four times a year to have control and regulations over the zoning and they held
multiple hearings when this was done. He felt it should be left at four times a year.
City Attorney Alvarez read the section pertaining to Council being able to waive this
restriction by 3j5ths majority if they find an emergency exists.
Councilman Spencer moved that Council express its intent today to act on the two requests
at their next regular meeting when four Council members will be present. He stated Mr.
Siciliano, Chairman of the Zoning Commission, was not able to be present today and held
like to discuss this with him. Councilwoman Bennington seconded the motion. Motion
CARRIED 3-0. It was clarified that this would cover the second item on the agenda, also,
