CALL TO ORDER Chairman Vopelak called to order the Regular Meeting of the Planning and Zoning Board at 6:30 p.m., November 8,2006 in the Community Center, 102 N. Riverside Drive, Edgewater, Florida. 2. ROLL CALL Members present were Edwin Vopelak, David Ross, Charlene Zeese, Dan Grisell, Pat Card and William Miller. John Weiss was excused. Also present were Development Services Director Darren Lear and Planning Technician Bonnie Wenzel. 3. APPROVAL OF MINUTES MOTION by Mr. Card. second by Mr. Grisell to approve the minutes of October 11. 2006 as presented. MOTION CARRIED 6-0 PUBLIC HEARINGS 4. OLD BUSINESS Chairman Vopelak stated that RZ-0616 would be continued to the December 13, 2006 meeting. MOTION by Mr. Card. second by Mr. Miller to continue item RZ-0616 to the December 13. 2006 meeting. MOTION CARRIED 6-0 a. AN-0601 - Sid Peterson, requesting annexation of approximately 79.18::1:: acres of land located south of the Taylor Road and Glencoe Road intersection. Chairman Vopelak opened the public hearing and Mr. Lear provided background information on the request. Glenn Storch, 420 S. Nova Road Daytona Beach, stated this was one of the highest pieces of land in Edgewater. There being no further discussion Chairman Vopelak closed the public hearing. MOTION by Mr. Card. second by Mrs. Zeese to send a favorable recommendation to City Council for the annexation of 79.18::1:: acres of land located south of the Taylor Road and Glencoe Road intersection. MOTION CARRIED 6-0 b. AN-0602 - Orner & Paulette Stull, requesting annexation of 20.28::1:: acres of land located north of 27th Street and south of the Majestic Oaks subdivision. Nova Road Daytona Beach, stated this property is part of an enclave and meets the requirements for annexation. Mr. Miller asked what the archeological study was for. Mr. Storch stated it was to look for potential archeological sites. Mr. Lear stated if there were any, the developer would have to mitigate. Michael Stull stated that a study was completed and nothing was found. There being no further discussion Chairman Vopelak closed the public hearing. MOTION by Mrs. Zeese. second by Mr. Card to send a favorable recommendation to City Council for the annexation of 20.28:l:: acres of land located north of 27th Street and south of the Majestic Oaks subdivision. MOTION CARRIED 6-0 5. NEW BUSINESS a. CPA-0619 - Dioceses of Orlando requesting an amendment to the Comprehensive Plan Future Land Use Map to include 9.97:l:: acres of land located at 2310 S. Ridgewood Avenue, west of Pelican Drive as Commercial with Conservation Overlay. Chairman Vopelak opened the public hearing and Mr. Lear provided background information. There being no further discussion Chairman Vopelak closed the public hearing. MOTION by Mr. Card. second by Mr. Grisell to send a favorable recommendation to City Council for the amendment to the Comprehensive Plan Future Land Use Map to include 9.97:l:: acres of land located at 2310 S. Ridgewood Avenue as Commercial with Conservation Overlay. MOTION CARRIED 6-0 b. RZ-0619 - Diocese of Orlando, requesting an amendment to the Official Zoning Map to include 9.97:l:: acre of land located at 2310 S. Ridgewood Avenue, west of Pelican Drive as B-3 (Highway Commercial) . Chairman Vopelak opened the public hearing and incorporated the previous discussion into this one. Mr. Lear provided background information on the request. Mr. Grisell wanted to clarify that there were no plans for development at this time. Mr. Lear stated that was correct. There being no further discussion, Chairman Vopelak closed the public hearing. CPA-0601 - Sid Peterson, Jr., requesting an amendment to the Comprehensive Plan Future Land Use Map. to include 79.18:l:: acres of land located south of Glencoe Road and Taylor Road as Medium Density Residential with Conservation Overlay. Chairman Vopelak opened the public hearing and incorporated the discussion from AN-060!. Mr. Lear provided background information on the request. Mr. Lear stated that the applicant applied for Medium Density Residential, but due to the density of the development staff is recommending Low Density Residential with Conservation Overlay. He added that the net density of the project is under four (4) dwelling units per net acre. Glenn Storch, 420 S. Nova Road Daytona Beach, agreed that Low Density Residential was appropriate for the project. Mr. Ross asked if the multi-family residential was compatible with Low Density Residential. Mr. Lear stated it was provided the density was compatible, he added that the RPUD Agreement will address the type of units. There being no further discussion Chairman Vopelak closed the public hearing. MOTION CARRIED 6-0 d. RZ-0601 - Sid Peterson Jr., requesting an amendment to the Official Zoning Map to include 79.18:l:: acres of land located south of Glencoe Road and Taylor Road as RPUD (Residential Planned Unit Development) and approval of the associated RPUD Agreement. Chairman Vopelak opened the public hearing and incorporated the previous discussions. Mr. Lear provided background information on the request. Mr. Lear stated the Agreement meets the requirements set forth in the Land Development Code. Glenn Storch, 420 S. Nova Road Daytona Beach, stated the project meets the requirements of the Land Development Code pertaining to height, density, lot size etc. Mr. Card spoke of his concern that he has heard about the extension of Cow Creek Road. He asked if it was possible to give up more open space for additional right-of-way. There was discussion on how to accomplish this. Mr. Storch stated he would agree to having a 35-foot front setback in lieu of the proposed 30-feet. He added that the right-of-way would be 60-feet, which is adequate for a two (2) lane road. Mr. Ross suggested larger units and larger lots for the development. Mr. Lear stated that all angles are looked at, including affordability, he stated that 1,200 square feet sounds small, but that is just a minimum requirement. Mr. Ross asked Mr. Storch if he was willing to have a variety of unit sizes. Mr. Storch stated they had no problem with a variety of unit sizes. MOTION by Mr. Card. second by Mr. Ross to send a favorable recommendation to City Council for the amendment to the Official Zonin~ Map to include 79.18:1: acres ofland located south of the Glencoe Road and Taylor Road as RPUD (Residential Planned Unit Development) and approval of the associated RPUD A~eement with the condition that the A~eement be modified to have a front setback of 35-feet and a variety of sizes for sin~le-family and townhouses are available. Storch requesting an amendment to the Comprehensive Plan Future Land Use Map to include 20.28:1: acres of land located north of 27th Street and south of the Majestic Oaks subdivision as Low Density Residential with Conservation Overlay. Chairman Vopelak opened the public hearing and incorporated discussion from AN-0602. Mr. Lear provided background information. Glenn Storch, 420 S. Nova Road, stated the proposed amendment is consistent with Volusia County and the adjacent properties. o There being no further discussion Chairman Vopelak closed the public hearing. MOTION CARRIED 6-0 6. DISCUSSION ITEMS a. Development Services Director's Report Mr. Lear discussed the previous night's election and the approval of the 35-foot height limit within the City. Mr. Ross discussed his conversation with Mr. Lear and City Manager Jon Williams concerning future development. There was discussion of setting up a vision workshop.
