Counc i I man Fish seconded the motion. Councilmember Bennington stated there aren't enough people here who were at that meeting. Mayor Mitchum. stated this would have to be tabled ~nd the Council would have to withdraw. Councilman Gold withdrew his motion. Councilman Fish withdrew his second. Mayor Mitchum stated he needed a motion to table. Councilmember Bennington made a motion to tab Ie. Counc i I man 60 I d seconded. 110t i on CARR] ED 4-0. CITIZEN COMMENTS Mayor Mitchum advised there's a three minute time limit unless Council rules otherwise. Warren Fisher, 1720 Juniper Drive, stated he !..JQuld like to discuss the train horn ordinanr.e. He stated that the railroad has presented facts indicating that wherever the elimination of horn blowing has occurred the number of accidents has risen dramatically. He stated that if we look at the local facts~ in the five or six years that New Smyrna has banned the horn blowing there has been no accidents and in the months that we have had no horn blowing there have been no accidents here. He stated that he was strongly urging the Council to decline the request of the railroad to reinstate horn blowing at night. Richard Jackson, 1603 Willow Oak Drive, stated that he has taken a survey from many people in t.he Shores and he has not heard one person say they want the horns to be blowing at night. He stated that he has approached between 60 and 80 people and no one wants the horns to be blowing at night. He stated the citizens fought long and hard to make the horn blowing stop in the first place and he suggested holding tight right now. Dominick Fazzone, 302 Paradise Lane, stated that six years ago the same question was brought up about the train whistle and he protested. He stated that four years ago he did the same thing and two years ago he did the same thing and finally this Council did eliminate the whistles. He stated he does not understand why the railroad authority came to this Council and asked that we bring the whistles back again but he does not see any other cities jumping in. He stated that the Council should reconsider and keep the ordinance as it is. Frank Roe, 2732 Juniper Drive, stated that he agreed with the preceding speakers about the train whistles. He stated he thinks \ q .. '-. (,J ~ ;/' ,~ we should compromise. He stated he thinks the railroad should be given a little leeway and allow them in an emergency situation to blow their whistles. CONSENT AGENDA Public Works Director's reauest to 00 out bids for new aarbaae truck; Police Chief's reauest to arant maternity leave of absence to Detective Diana Floyd from Dec. 10. 1990 and endina about March 9. 1991 - Mayor Mitchum asked if they want to remove anything. There were not comments. He requested a motion to close and accept the consent agenda. Councilman Fish so moved. Councilmember Bennington seconded the motion. Motion CARRIED 4- O. NEW BUSINESS None ORDINANCES. PUBLIC HEARINGS. AND RESOLUTIONS First Readina: Ord. 90-0-39 Repealina Ord. 89-0-36 which prohibited soundina of railroad train horns and whistles between 10 p.m. and 6 a.m. at all public at-arade crossinas havina train activated automatic traffic control devices - Mayor Mitchum read the Ordinance. Ord. 90-0-39 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, REPEALING ORDINANCE NO. 89-0-36 IN ITS ENT1RETY WHICH PROH1BITED THE SOUND1NG OF RAILROAD TRA1N HORNS AND l-JH1STLES BETl-JEEN 10:00 P.M. AND 6:00 A.I'L AT ALL PUBLIC AT- GRADE CROSSINGS HAVING TRA1N ACTIVATED AUTOMATIC TRAFFIC CONTROL DEVICES; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. Councilmember Bennington stated that Council turn this Ordinance down. Councilman Gold seconded the motion. Motion CARRIED 4-0. Res. 90-R-66 Authorizinq participation in a 10anin9. leasina and warehousina proaram as an extension of Cooperative Purchasina Proaram and Council of Volusia Council of Governments - Mayor t1itchulli t-ead the Res.olution. RES. 90-R-66 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EOGEWATER~ FLORIOA~ AUTHORIZING PARTICIPATION IN A LOANING~ LEASING AND WAREHOUSING PROGRAM AS AN EXTENSION TO THE COOPERATrVE PURCHASING PROGRAM AND COUNCIL OF THE VOLUSIA COUNCIL OF GOVERNMENTS (VCOG); REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE. Councilman Gold moved they adopt 90-R-66. Councilman Fish seconded the motion. Motion CARRIED 4-0. Res. 90-R-67 Authorizina appropriate City officials to execute Joinder in the Interlocal Aareement creatina and aovernina the Halifax Reaional Water Supply Authority - Mayor Mitchum read the Resolution. RES. 90-R-67 - A RESOLUTlON OF THE CITY COUNC1L OF THE CITY OF EDGEWATER, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS OF THE CITY OF EDGEWATER, TO EXECUTE A ".JOlt-mER BY THE CI TY OF EDGEl-JATER I N THE I NTERLOCAL AGREEMENT CREAT 1 NG AND GOVERNING THE HALIFAX REG10NAL WATER SUPPLY AUTHORITY"; REPEALING ALL RESOLUTIONS IN CONFLJCT HEREWITH AND PROVID1NG FOR AN EFFECTIVE DATE. Councilman Fish moved they reject 90-R-67. Councilmember Gigi Bennington seconded the motion. City Manager Elly ,Johnson stated that this is a budgeted item and it has been approved. He stated that in a matter of short time there will be one author i ty for ralt~ It~ater in th i s County. The present makeup of the Halifax Regional Water Suppy Authority is: Daytona Beach, Ormond Beach, Port Orange~ New Smyrna Beach~ Holly Hill and Volusia County. The seventh member of the authority will be the City of Edgewater. He stated it is very important that we participate because we are involved in the aquaford that the water is going to be drawn from. There are plans to do a complete study so that we all will have raw water supply and that it will be properly handled. Motion CARR1ED 3-1. Mayor Mitchum voted NO. l Q '. ..- '-I . , ' ... .. - . QUESTIONS FROM PRESS None. CITIZENS COMMENTS NoraJane Gillesoie, 1719 Willow Oak Drive, stated she wanted to ask if the vehicles that were purchased this evening were going to be cash purchases. Mr. Johnson stated that nothing was purchased, but we have gone out for bids. He stated the money is set aside in the refuge fund to pay for it. Mrs. Gillespie stated in the budget that was approved~ the City is inheriting interest payments of $22,924 on little items, plus the interest payment set up for 5350,317 on the loans that are out. ADJOURN Mayor Mitchum suggested a motion to adjourn. Councilman Fish so moved. Councilmember Bennington seconded the motion.
