Verbatum recap - Council Meeting January 12, 1981 - Mayor Christy, Chairman (Regarding Mr. Witzig and Mr. Vasquez being escorted from the meeting) Tape 3-A-1S MISCELLANEOUS Mayor: "Now, next is Miscellaneous." Vasquez: "Point of Order." Mayor: "Point of order on what?" Vasquez: "On what you were talking about, what do you think?" Mayor: "What? To have a workshop?" Vasquez: "I raised my hand when in the hell you were going to have a point of order. You said you would let me know, when are you going to let me know, tomorrow?" Mayor: "We are having a workshop. Do you want a point of order on having a workshop?" Vasquez: "I want to discuss this. That's all you do is sit up there and say people can't... (interrupted) Mayor: "You won't discuss it because of the fact that a motion is made and I read off, if you have been listening." Vasquez: "I heard what you<read." Mayor: "O.K., then we are going by the book. If you don't like it you know there is such a thing as putting a letter into the Council to object to it." Vasquez: "These people ought to have a chance to be heard. All you are doing is restraining them from speaking. That's all you're doing." Mayor: "No Sir. After a motion is made by the Council no person shall address the Council without first securing the permission of the Council to do so. That's under Section 2-28. Rots of Ruk." Mayor: "Let's go on. Next, Mr. Gross. Remember, gentlemen we passed an ordinance tonight that whatever material you want to talk on a synopsis of the material on the subject shall be supplied and shall be of such to enable the City Council to have background material available at the meeting and that is where we are going to go by." Mr. Gross spoke. Mayor Christy spoke. City Attorney Henderson spoke. Mayor: "Now, Mr. Witzig." Mr. Witzig: "Robert Witzig, Queen Palm Drive, Edgewater." Ah, Mr. Mayor, has the City adopted the Robert's Rules Of Procedure, as part the..." (internupted) Mayor: "Yes Sir, it is" Mr. Witzig: "It has been adopted by the City?" Mayor "Yes Sir." Mr. Witzig: "That's one question. Number two, I understand at a workshop meeting it was stated that I was a trouble maker and I disrupted meetings." u u Mayor: "Well that you I would recommend..." (Interrupted) Mr. Witzig: "May I continue?" Mayor: "Go ahead." Mr. Witzig: "Ah, if I am a trouble maker and disrupted meetings I would assume that you, as a Chairman, would prevent it. This statement was not made by you and from what I understand the gentleman that made the statement has no knowledge of what has been going on in meetings here up until just prior to election." The audio system gave a very shrill noise. Mayor: "Ooooh boy, I will take my hands off it." Mr. Witzig: "But your feet are probably working." Mayor: "Are you accusing me of doing this with my feet?" Mr. Witzig: "No, your head is working, too." Mayor: "Let me bring a point but to you. First of all, I allowed you to speak and ... (interrupted) Mr. Witzig: "You allowed me three minutes and I haven't even started. Can't you let me say what I want to say? If I have disrupted a meeting I would assume you might be referring to the meeting we had last week when Mr. Lodico, at a point of order, ah after Mr. Gross finished speaking, ah would not permit me to speak, and I did speak out. Number one, if you adopted the rules and regulations of the Robert's Rules Of Order, Mr. Lodico was the gentleman out of order, it wasn't me. The individual that makes the motion is the only one that can move the motion. According to Robert's Rules, thanks to Mr. Holahan, who read this to me only the other day. So apparently it was not I that was out of order, at that point in time it was Mr. Lodico and you for not calling it to the attention of the Council. Anything else, if I speak I tell you what I think, how I feel as to the question and there has never been any arguments out of me or ridicule or anything else, although believe me mentally there may have been. If we are not permitted to give our opinions, speak our peace as we have been told in the past, please attend the meetings - we want some input from you people - it sounds to me like you people don't want any input from anyone. It is also stated in the paper that those that want to be on a board should put in their resume. Did you also put in their resume that they should go along with whatever the Council.... (interrupted) Mayor: "Just a moment, now you are getting out of order. Mr. Witzig: "I am not getting out of order." Mayor: "You are out of order." Mr. Witzig: "I want to get out of order because I.... the next thing there is going to be a Zig Heil, that is what happened in Germany, this is.... (interrupted) Mayor: "Will you please sit down - Chief, escort him out, I will sign a 751 form in the morning." Mr. Witzig: "You damn well, I'll be glad to go out....Zig Heil!" Chief Baugh escorted Mr. Witzig to the door, the audience applauded and the Mayor said "If you don't stop I'll ask you to leave". "I'm not kidding you'se now, you think I'm joking?" -2- (.) u Mr. Lodico: "On the question, when this was going on I said, I didn't say he was out of order, I said I call for the question, you can check that on the tapes." Mayor: "I know, that's right, I read the book and I am going by the book and that's all there is to it." Mr. Pendleton spoke. Mayor Christy spoke. Mr. Phinney spoke. Mr. Demuch spoke. City Attorney Henderson spoke. Mayor Christy spoke. Mr. Opal spoke. 3-B-II Mayor: "Now, this gentleman here." Mr. Lodico: "I would like to ask a question of this gentleman - is he a registered voter in this City, if he is not I don't think he should speak." Mayor: "I don't think this issue is relevant as to whether you are a voter, or registered or anything." Mr. Pendleton: "Does he own property here?" Mayor: "No, he doesn't, his Mother does." Attorney Henderson: "There is a provision in the Code of Ordinances that addresses this. I think this wE;i.y'it gives precedent to those people who are from the City but I do not think it restricts those from outside the City, I certainly think that would be unconsti- tut.ional. Mayor: "Alright, then please proceed." Mr. Vasquez: "To clarify the record, Mayor Christy, first of all I am a property owner in the City of Edgewater. You asked me this question last time. You said you found out where my Mother-in-law lived and I couldn't understand how you figured that one out, being so smart, but then you couldn't figure out where I owried property. For your information it is on Needle Palm and..... (interrupted) Mayor: "Will you please get on with your subject please." Mr. Vasquez: "Does that take care of that?" Mayor: "No, will you please get on with your subject." Mr. Vasquez: "Now, let's get on with what I was talking about. I have no personal animosity against none of you gentlemen up there. But I want to say one thing, first of all for the benefit of the audience, my name is Ben Vasquez. I own property in New Smyrna Beach, I own property in Edgewater and Port Orange. Mayor: "You will address the Council. You are not here to put on a stage show. Mr. Vasquez: "I came to this meeting tonight to speak. That's number one. Upon picking up an agenda, and you saw me when I came into City Hall earlier, I went home and I studied it and I did my homework. Well, I wanted to talk on some things tonight. I really felt it was important in this City to speak on the P.I.D. - you got it right down here, the P.I.D. Ordinance 80-0-70, P.I.D. Now you tabled -3- v o , Continued - Mr. Vasquez: that ordinance. Now why didn't you put on the agenda that you were going to table it or hold a workshop even. I will tell you why, because you saw me coming in and you knew I was going to lower the boom on you, that's why." Mayor: "Just a moment Mr. Vasquez. Just a moment please." Mr. Vasquez: "Now let's get on with it." Mayor: "No, you are going to stop right there." Mr. Vasquez: "For what, I didn't say nothing. (interrupted) I j us t to I d. . . . Mayor: "Yes, you did, yes you did. Sit down. Mr. Lodico: (Gets up to leave) "I canr:t 'stand this anymore. I make a motion we adjourn". Mayor: "Jake please sit down." Mr. Vasquez: "Let's get with it. Go on home, go on home." Mayor: "You're getting out of hand, will you please sit down." Mr. Vasquez: "I'm not through." Mayor: "Yes, you are through. You are out of order, escort him out. I'm not going to have this." Mr. Wilbur: "We don't need that here." Mayor: "I'm not going to have this anymore. Mr. Opal: "It's just a circus, that's all." Mayor: "That's what they are trying to make it. I'm not going to tolerate it. That's two forms I'm filling out. " Chief Baugh escorted Mr. Vasquez from the meeting. The meeting continued.
