04-30-1981 - Special ~ ~ u ~ CITY OF EDGEWATER CITY COUNCIL SPECIAL MEETING April 30, 1981 CALL TO ORDER Mayor Robert B. Christy called the Special Meeting of the City Council of the City of Edgewater to order at 3:30 P.M. in the Conference Room. ROLL CALL Mayor Robert H. Blazi Police Chief Earl Baugh Present Present Present Excused Present Present Excused Present The purpose of the special meeting was to discuss the Building Official's contract and work procedures. A review of the actions taken at the April 20, 1981 Council Meeting which led to this special meeting was held. City Attorney Henderson reviewed the recommendations regarding operating procedures which had been discussed. He noted, however, that no contract changes had been recommended. The Mayor then noted that there had been numerous complaints regard- ing the hours the Building Official was accessible. He felt that the Building Department should be manned from 8:00 A.M. to 4:30 P.M. Councilman Ledbetter then spoke on several complaints regarding allegedly erroneous disapprovals made during inspections. Mr. Murphy discussed his findings relating to these particular incidents. Councilman Wilbur voiced the opinion that the limited number of complaints opposed to the number of inspections indicates to him that the Building Department is functioning as well as can be expected. This, he said, was the opinion of the majority of builders in the area. The City Attorney then spoke indicating that the Building Code Board felt that the above incidents were a personality problem and asked that Mr. Murphy personally conduct all inspections for Mr. Harris for 2 months. He also pointed out that Mr. Harris' complaints had been tabled by the Building Code Board as he did not appear at the meeting where they were scheduled for discussion. Councilman Wilbur stated that he felt the Building Department should be identified with a sign stating the hours of operation. Mr. Murphy indicated that a sign had been ordered and that the department would be staffed from 9:00 A.M. to 3:00 P.M. Councilman Lodico then discussed a problem with a particular structure not meeting the foundation codes. Mr. Murphy said he would investigate. City Attorney Henderson then explained the proper channel for regist- ering a complaint and asked that the Council not get into individual cases at this time. The Mayor then read Sections 3 and 4 of the Building Official's contract, indicating that Mr. Murphy was not fulfilling the mandates therein. 'f' u (j A general discussion followed regarding the enforcement of the sign ordinance. Councilman Wilbur made a motion to adjourn. The motion died for lack of a second. The Mayor then read a letter from the Zoning and Planning Board dated April 28, 1981 recommending that the Building Official be responsible for all site plans for single-family residences and duplexes in the platted subdivisions in the R-l, R-2, R-3, RI-B and R2-B categories contingent upon compliance with the 880 Ordinance and the Comprehensive Plan. Mr. Wallace clarified the above-mentioned letter with the aid of City Attorney Henderson. The Building Official will be responsible for all single-family R-l, R-2, R-3, RI-B, R2-B and all duplexes in the platted subdivisions that have been approved by the Zoning and Planning Board. Councilman Lodico then made a motion that the Council accept the Zoning and Planning Board's recommendation with Mr. Wallace's clarification. A general discussion followed on R-4 and multi-family zoning and whether existing so zoned areas would have to corne before the Board. It was agreed this was unnecessary as these areas had been considered and zoned prior to our current Site Plan Ordinance. Councilman Wilbur then seconded Councilman Lodico's motion. Upon roll call the motion CARRIED 4-0. A discussion then followed regarding participation by councilmen in board meetings. City Attorney Henderson pointed out that they attended only as.individual citizens, with no other authority, and that care should be taken as their opinions could possibly prejudice a vote and expose the city to liability. Councilman Ledbetter made a motion to adjourn. The motion died for lack of a second. There followed a general discussion regarding complaints made against Mr. Tobin. It was agreed that Mr. Murphy be allowed to handle this matter personally. In response to City Attorney Henderson's questioning, Mr. Murphy stated that he would like enforcement of the sign ordinance removed from his contract. A discussion followed on whether the following areas should also be removed: fire prevention; pumps and irrigation; signs; water retention; stormwater management; flood control. Councilman Wilbur made a motion to instruct the City Attorney to correct the Building Official's contract as discussed and to put into the proper perspective to the departments the areas of enforce- ment of ordinances and resolutions. The motion was seconded by Councilman Lodico. Upon roll call the motion CARRIED 4-0. ADJOURN was seconded Councilman Lodico made a by Councilman Ledbetter. The meeting was ~.
