CITY ATTORNEY/ADVISORY BOARDS MEETING
April 13, 1981
CALL TO ORDER
City Attorney Clay Henderson called the meeting of all the advisory
board members to order at 7:00 P.M. in the Community Center.

The City Attorney explained the meeting was called to review the
rules and procedures of some of the State laws that effect the
advisory boards. He reviewed the responsibility placed upon the
boards because of the new Comprehensive Plan just recently passed
by the Council. The Board of Adjustments, Zoning and Planning
Board and Merit Board will be working more independently and their
decisions are therefore as important. He discussed more of the
goals and accomplishments of the various boards.
Mr. Henderson further explained the Civil Rights Act which put the
responsibility for lawsuits to the individual members of the Council
and the board members.
Mr. Gross questioned the time spent by board members to make
recommendations to the Council then their not taking action.
Mr. Henderson stated that anytime items are before a board a member
should always state their reasons for denial and make them legally
sufficient.
Mr. Henderson reviewed the Sunshine Law and that no meeting of any
advisory board or governmental body of the State can meet behind
closed doors, and members cannot get together in private to discuss
matters that could corne before the board or this could result in
second degree misdemeanor charge of 60 days in jail and/or a $500
fine. He cited the recent Attorney General's decision concerning
Tolar vs the School Board of Liberty County.
Financial disclosure forms were distributed and discussed. Mr.
Henderson stated these should be on file with the Clerk in Deland
and requested all board members turn these in by their next board
meeting.

The Comprehensive Plan was reviewed and Mr. Henderson stated it
ranks in importance with the City Charter and therefore must have
an annual review. Copies of the Plan are being distributed to
all members of the zoning and Planning Board and the Board of
Adjustments and to the chairmen of the other boards. He stated
because of the population of the City growing the Comprehensive
Plan creates a tremendous impact on the restrictions of the City
and no building permit can be issued without making sure that it
is consistent with the Comprehensive Plan. He recommended the
board members become familiar with the Plan and how it effects
their board.
Mr. Henderson discussed the coordinator system of the City and
the newly created Code Enforcement Board. There were questions
from the audience concerning the violations to be tried by this
board and if the board was constitutional. The greatest concern
from the audience were the members to be selected for this board.
Mr. Henderson reminded the board members they should be mindful
of ethics and always state the truth since they were appointed
for the benefit of the community. Parlimentary procedures were
discussed and Mr. Henderson reminded the members to always use
clarity when making motions so they will be clear in the minutes.
The City Clerk stated the boards were being assigned one secretary
to be present at the meetings to tape them. She stated at one
time all the boards were receiving minutes of the other board's
meetings and if the chairmen of the present boards felt this would
be helpful we could resume this practice. She reminded the board
members that the secretaries are not allowed to turn off the tape
recorders at meetings unless there is a recess of the meeting.
Mr. Henderson stated that all major motions before a board require
a roll call vote.
Councilman Lodico stated he had received a lot of comments on how
efficient and well-run the last meeting of the Zoning and Planning
Board had been.
