10-10-1984 - Special Emergency (..) o CITY COUNCIL OF EDGEWATER SPECIAL EMERGENCY MEETING OCTOBER 10, 1984 MINUTES Mayor Ledbetter called the Special Emergency meeting to order at 4:00 P.M. in the Community Center. ROLL CALL Mayor David Ledbetter Councilman Melbourne Wargo Councilwoman Gigi Bennington Councilman Neil Asting Councilman Jack Spencer Present Present Arr i ved Later Present Present City Attorney Josel Alvarez City Clerk Connie Kinsey Pol ice Chief Douglas Betts Deputy City Clerk Susan Wadsworth Present Excu sed Absent Present Mayor Ledbetter stated the purpose of the meeting is to consider changing Resolution 84-R-47 as there was an error made in 1 isting the two candidates from Zone Two. He added that he was called and asked why the two names were on the primary 1 ist. City Attorney Alvarez said he called the candidate who questioned this and read the pro- visions of the Charter on page 51, Sections 140 and 140A, which establishes the elections. He said the names shouldn't be on the primary since there weren1t three candidates. He stated that he made an appointment with Katherine Odham and Mayor Ledbetter went with him to meet with her. He added that Mrs. Odham was famil iar with it and had already stricken the names from the bal lot for the primary. He stated that he suggested an emergency meeting to resolve the matter and that an amending resolution should be adver- tised at least two times in a large advertisement. Councilman Wargo moved that they amend Resolution 84-R-47 to comply with the proper dates and he then withdrew and moved to adopt Resolution 84-R-50 and advertise accordingly. Councilman Spencer seconded the motion. Councilwoman Bennington arrived at the meeting at this time, 4:04 P.M. Councilman Asting read from Section 141, and City Attorney Alvarez noted that it's Sections 140 and 140A. Councilman Asting asked if they're complying with State law and City Attorney Alvarez repl ied yes. Mr. Frank Opal, from the audience, called a point of question. Councilman Spencer asked they con- tinue their business and Councilman Asting agreed. Councilman Spencer noted that an honest mistake was made and he knows it needs to be changed. Motion CARRIED 5-0. RESOLUTION NO. 84-R-50 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING RESOLUTION NO. 84-R-47 BY REMOVING THE CANDIDATES FROM COUNCIL ZONE TWO FROM THE PRIMARY ELECTION TO BE HELD ON OCTOBER 23, 1984 TO THE GENERAL ELECTION TO BE HELD ON NOVEMBER 6, 1984; DIRECTING THE CITY CLERK TO PUBLISH THIS RESOLUTION IN A NEWSPAPER OF GENERAL CIRCULATION; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. Councilman Spencer moved the motion. Meeting was that the meeting be adjourned.
