06-20-1984 - Special ~ ~ o ~ ~ ~ CITY COUNCIL OF EDGEWATER SPECIAL MEETING JUNE 20,1984 MINUTES Mayor David Ledbetter called the Special Meeting to order at 4:15 P.M. in the Community Center. ROLL CALL Mayor David Ledbetter Present Councilman Jack Spencer Excused Councilman Melbourne Wargo Present City Attorney Jose' Alvarez Present Councilwoman Gigi Bennington Present City Clerk Connie Kinsey Present Councilman Neil Asting Present Police Chief Ed Overman Excused Mayor Ledbetter stated the purpose of the meeting was due to Chief Overman's declining the offer of Council of Monday night, the Council will review the 12 applications still pending, and add any others, plus establish a procedure for interviewing. Councilman Asting said he went through the 12 applications and he came up with 7 names that he'd like to interview. He read the 7 names.as: Michael Handley, David Johnson, Gene Johnson, James Kolbinskie, Chester Kowalski, Tony Raimondo,. and John Van Tronk. He suggested they be contacted and see if they.ll go along with the terms. Council- woman Bennington suggested they decide the terms first. Councilman Asting said they should go back to the advertisement in the paper. for a salary in the low 20.s. Councilwoman Bennington asked if there were any objections to any terms other than the salary and Councilman Asting said no, but he objected to terms presented by the Acting Chief. He added that he considers the Chief a department head and other depart- ment heads are making much lower salaries, and don.t have a contract. Councilwoman Bennington said it should be an appointment in the form of a resolution with terms outlined in the resolution, and Councilman Asting agreed. Councilman Wargo said he disagreed with the $25,500. Councilwoman Bennington pointed out that of the 10 people selected, five of them dropped out because of the salary and only four were interviewed. Councilman Asting noted that he liked David Shaver and he was willing to go with $22,000. and he also liked Charles Sexton. Mayor Ledbetter suggested they go through the twelve and decide who they want to inter- view personally and the City Clerk can call them. Councilman Asting said he'd like to see action as soon as possible because the 30 days is about up and they could recess this meeting and re-convene as soon as they can schedule the interviews. Council- woman Bennington agreed but said she'd like to see about 20 in a pool for interviews because not all of them will come. Mayor Ledbetter asked how much is left for the year in the Chief's salary. City Clerk Kinsey said it's pretty well depleted but there is money in other positions, such as Deputy Chief, and there's not.a line item for the Chief. Mayor Ledbetter recalled that the Lieutenant's position was abolished by Council which left a vacancy. Councilman Asting said he didn't feel the Chief has any more responsibility than any other department head and Councilwoman Bennington brought up the matter of vicarious liability. Councilman Wargo read his list of four names he'd like to interview. The names were: Michael Handley, Michael Kelly, Chester Kowalski, and Jorey Krawczyn. He suggested they set a figure of $22,000. to $24,500. and go with $23,000. Councilman Asting agreed that should be the top. Councilwoman Bennington asked how they could offer someone less than they paid Ed Overman. Councilman Wargo said he felt they had a better man. Councilwoman Bennington asked how they stood legally on that. City Attorney Alvarez said the low 20's could be through $24,500. but the majority of Council agreed on a figure and there was an offer made to an individual and refused. He said if it can be established how the individual was different from the pool to receive the higher salary than they could change it. f' :; I , .. ..... ~ o u Councilwoman Bennington suggested they offer $23,000. and Councilman Wargo agreed and said if the man says he has to get $23,500., then Council can make the decision. Councilman Asting said it's up to the individual to tell them what helll work for. City Attorney Alvarez said it could be $20,000.to $25,000. and it should be in that range and true to the advertisement. Mayor Ledbetter suggested they not offer top dollar when he comes and they can raise it later. City Attorney Alvarez noted that if they set a range there's more competition among the applicants. Councilman Asting suggested they recess this meeting to give Council members time to go through the applications. Councilwoman Bennington suggested they set up interviews and she wants to go with all 12 because some will probably turn it down. Mayor Ledbetter agreed to the 12 and they can narrow it down. Councilman Asting moved that the City Clerk contact the 12 names on this list and set up a schedule for interviews as soon as possible. Councilwoman Bennington said it should be by Monday. Mayor Ledbetter noted that he wouldn't be available Tuesday. Council agreed to 20 to 30 minutes per interview. City Attorney Alvarez asked if some of the others had with- drawn as he didn't want someone to come back and say they were ignored or not been given an opportunity. Councilman Wargo said that $25,500. was not even in their realm. Councilwoman Bennington suggested they call them and tell them. Councilman Asting noted that all these 12 are in the State of Florida. City Attorney Alvarez said if none of these 12 are selected for whatever reason, then another pool could be prepared. Councilwoman Bennington seconded the motion. Councilman Asting asked to amend the motion to "those available of the 12" and Councilwoman Bennington seconded the amend- ment. Amended motion CARRIED 4-0. Original motion CARRIED 4-0. There was a discussion about the salary range to tell the applicants when theylre contacted for the interview. It was agreed that it would be the low 20's as advertised. Walter Gross, from the audience, said he felt itls wrong to set a range and bid for a man's service and he felt it should be a base salary to give him incentive. He added that with 126 applications, they can be choosey. Tom Sheridan, from the audience, suggested they send telegrams for contacts. Council- woman Bennington said they could use overnight delivery also and as they call back, schedule them in that order for interviews. There was a discussion as to the most efficient means of contact. City Attorney Alvarez suggested they try both systems. There was a general agreement that the interviews would start Monday, June 25th, at 9:00 A.M. and would last 20 to 25 minutes per person. Councilman Asting moved to adjourn. Councilwoman Bennington seconded the motion. Meeting was adjourned at 4:50 P.M.
