1. CALL TO ORDER and ROLL CALL

None at this time.
3. OTHER BUSINESS
a. A R-2016-1933 Order of Taking requirement to deposit into the Registry of the Court
City Manager Barlow made a staff presentation on previous approval by Council of Resolution to
determine the necessity for a piece of property west of 442.
City Attorney Wolfe discussed the Order of Taking hearing: the City was required to prove two
things, the taking was reasonably neccessary and estimated value was based in good faith; we have
met our burden of proof and the judge entered an Order of Taking; the Order of Taking requires the
City to pay a deposit into the registry of the Court; and our Appraiser determined that the fair value
of the 5 acre parcel was$85,900.
During City Attorney Wolfe's presentation, Council and staff discussed: failure to deposit money will
vacate the Judges order, and cannot be reinstated; it will only proceed if the original assessment is
challenged by the plaintiff. court and Attorney fees are not included in this deposit request; the idea
behind the Statute is for the land owner be fully compensated; the money for this project will be
equally coming from the General Fund at 25%, Water 25%, Sewer 25% and Stormwater 25%; and
this roadway is private property that has been in existance for many years and will allow extension of
442 for future development.
A motion was made by Councilman Blazi, second by Councilwoman Power, to authorize
the City Manager to amend the budget to compensate for the $85,900 to be submitted to
the Court.The MOTION was APPROVED by the following vote:

4. CITIZEN COMMENTS
Don Sanders, 2226 Woodland Drive, asked what the land is going to be used for and the importance
of spending money on this land instead of improving our streets in Florida Shores.
City Manager Barlow stated: the road west 442 of 195 has been privately owned for many years and
used as an access point to other property owners; four properties bring interest into the future
development of Edgewater; the purpose of the Eminent Domain is to allow connectivity to extend the
roadway for future development.

There being no further business to discuss, Mayor Ignasiak adjourned the meeting at 6:20 p.m.
