Minutes
Mayor Earl Baugh called the joint meeting to order at 7:03 p.m. in the
Community Center.

Councilman Inman moved to recess so that the Industrial Development Board
could call their meeting to order. The motion was seconded by Mr. Rotundo
and CARRIED 4-0.
Mrs. Doris Massey called the Industrial Development Board joint meeting with
the City Council to order.
Members present: Mrs. Massey, Messrs. Faidley, Gnau, Schneider and Cichewicz.
Excused: Mr. Vazquez and Mrs. Middleton. Also present: Mrs. Taylor, Secretary.
Mr. Schneider moved to recess the meeting and turn it back to the City Council.
Mr. Faidley seconded the motion, which CARRIED 5-0.
Mayor Baugh explained that the joint meeting was called at the request of
the Industrial Development Board to discuss the role of the Board and the
Council to see how they could work together to bring industry into the City.
Mrs. Massey said that she would like to discuss a few items which had been
discussed with the Council previously. A meeting was held November 3, 1983,
at which access to industrially zoned lands was discussed. She pointed out
the obvious necessity for access to these lands, recalling the recent fire
there. The police and firemen were unable to get across the tracks because
of the barricades. Mrs. Massey referred to the 1984 :Chapter 351.35 regarding
safety and what the railroad company has to do to their tracks. In April of
1983 the question was raised at the Council meeting when Joseph Grooms of
Grant, Florida wrote to Council about the Florida East Coast Railroad blockades
to his property. It was Mrs. Massey's feeling that if someone would look into
the law a little more deeply something could be done through condemnation and
street right of ways.
Councilman Asting agreed that one thing the City could do is to accept the
streets, as they are not dedicated at the present time.
Mrs. Massey said that she is able to discuss Dale Street, but for her to
discuss John Street would be a conflict of interest. She suggested that
the streets be dedicated and access may possibly be gained through con-
demnation, because the railroad tracks do not meet safety standards. It
was explained that Dale Street is the most westerly street. The truss plant,
to the right of Dale Street, is now owned by the Southeast Bank and to the
north of that is Dr. Morgan's property.
Councilman Asting felt that the City Council should pursue this, because if
the Daytona Beach Community College comes in it will be another access to it.
Mayor Baugh agreed that the Council should take action on this. They pointed
out that the Florida East Coast Railroad is in conflict with the Florida
Statutes as far as safety goes.

Mayor Baugh asked about the ownership of the property referred to as Dale
Street. Mrs. Massey said that it was used as an easement and she did not
know who owned it. Mr. Schneider rec0mmended that a title search be done
to determine who owned it.
Mr. Cichewicz asked what her conflict of interest is on John Street. Mrs.
Massey explained that she does have property in the area of John Street. He
questioned if any of her property adjoined property next to Dale Street and
was advised that it does not. Councilman Asting asked who owned the property
east of Dale Street. Mr. Cichewicz asked if Dale Street is opened up would
she be adjoining the property next to it. Mayor Baugh interceded and asked
Councilman Asting to proceed with his question. Mrs. Massey said that the
property on the east side of Dale Street was recently taken over by the South-
east Bank. On the west side is owned by Mr. Grooms. To the north of the
railroad tracks is owned by Dr. Morgan.
Mr. Cichewicz asked if Dale Street is dedicated, does the property to the east
side abut the property owned by Mrs. Massey, and was advised that it does not.
Mr. Schneider suggested obtaining an expert opinion on the condition of the
tracks, but Councilman Asting thought that photographs would be evidence, as
part of the tracks are missing. Mayor Baugh referred to the Florida Statute
351.36 which says that the Department of Transportation shall employ safety
inspectors to inspect the physical condition of a track. It was agreed that
this should be done, although Mr. Cichewicz remarked that this might cause
moreharm than good because it might eliminate rail access to the industrial
land. Mr. Schneider argued that I-l does not use a significant amount of rail.
Councilman Asting pointed out that all the City wants is access to the property
on the other side of the spur at Dale Street.
Regarding the location of the proposed Daytona Beach Community College campus,
Mayor Baugh advised that the proposed site lies within the City of Edgewater
across 10th Street from the new junior high school.
Councilman Asting reported that in 1983, because of his concern for the fire
protection for the north side of the spur, he contacted the Fire Chief and
the Fire Chief wrote a letter stating that it was necessary to have a crossing
of the spur. The F. E. C. turned it down. Mayor Baugh read the letter from
the City Clerk written at that time saying that the City Attorney and she had
reviewed the Dale Street and John Street information and it was determined
that they are not a public right of way and are not maintained by the City of
Edgewater. If the F. E. C. would be in agreement to opening the crossing the
cost would be in excess of $100,000.
Mrs. Massey said that with the new statute she felt that something could be
done. Councilman Asting asked if she could initiate the dedication of that
street to the City, i.e. get with the owners. Mrs. Massey said that she would
and asked if she could have some help from the City Attorney, and was told that
she could.
Mayor Baugh said that he was aware that Mrs. Massey could not talk about John
Street, but suggested that in talks with the attorney about Dale Street, John
Street should be included. The other council members agreed with this sugges-
tion.
Mayor Baugh gave those present an update on the Daytona Beach Community College
plans for an Edgewater campus. At a meeting attended by Councilmen Asting,
Prater, and the Mayor in New Smyrna Beach, they learned that everything is
going forward for the junior college. The site has been approved.
NEW BUSINESS
Use of industrial land under the Comprehensive Plan
The Chairman discussed the several requests for special exceptions for auto
repair shops in the industrial zones, and suggested that a special site be
designated for these types of businesses. Mrs. Massey recommended that close
scrutiny be given to requests for automotive repair because the industrial
land is being taken for this use. Mr. Schneider pointed out that there is
a need for these businesses but they don't need highway frontage and recommended
that perhaps the B zones be expanded to encompass it.

Industrial Appreciation Week
Mrs. Massey read the letter from Lieutenant Governor Wayne Mixson concerning
the proposed Florida Industry Appreciation Week scheduled for September 16 - 20.
Mayor Baugh asked the Board to put together a proposal to Council of how it
would like to have the City participate. Some localities are re~ognizing
new business coming in by a newspaper story each month, he stated. Also,
those businesses which are adding on and giving their buildings a facelift
should be acknowledged.
Common goals between the City Council and the Board
Councilman Asting said that the Council would like to see light industry
develop in the City and they would encourage it, and would be in 100 percent
support of it.
The Chairman said that in cases when the Board makes a recommendation to the
Council, if Council does not go along with it, an explanation would be appre-
ciated; she feels that the Board is getting good cooperation from this Council.
Mayor Baugh said that he is in total support of the Boards, and when something
is sent to them from a Board the Council will get back on it. Councilman
Asting agreed that a recommendation from the Board is appreciated and Council
does consider them. The Council retains the prerogative of appointing and
acting on recommendations.
Mr. Cichewicz questioned this statement and asked if the Council thought they
were supporting the Boards when they did not take on the people which the
Boards recommended. Councilman Asting explained that the Council looks for
people who would be compatible with the other members of the Board. The Board's
function is as an advisory Board to the Council.
Reports - Planning for Growth Seminar - March 7
Mrs. Massey said that she felt the seminar was beneficial and well received,
noting that she had sent a letter to Mr. Michael Bobroff thanking him for
putting on the seminar. Mayor Baugh asked how the information was provided
to the State regarding buildings which are available in the City, referring
specifically to the Wagner buildings. Mrs. Massey said that the forms were
given to Mr. Wagner and he sent them in. Mayor Baugh asked if the forms
could be given to all of the businesses in the City for them to fill out
and send in. He explained that most of these people are not aware that the
information can be provided to the State. The Mayor urged the Board to
get the forms to the industries so that the information on the available
buildings could be put into the computers. The Chairman agreed that this
was a good suggestion and the Board could work on it.
Daytona Beach Community College Seminar reo economic development in Volusia
County.
Mrs. Massey reported that she and Mrs. Taylor attended the March 1 seminar
and explained that valuable contacts were made with those people who will
be working for economic development in Volusia County.
MISCELLANEOUS
Mr. Cichewicz read a statement to those present in which he expressed his
appreciation for having had the opportunity to serve on the Board. He
regretted that he was not given more time to work with the members, he said,
but looks forward to having the opportunity at a later time. Those who
volunteer for these Boards without self interest should be encouraged
instead of being denied the opportunity to do so. He suggested that in
the future, when considering people for the Boards, that they allow for
differing opinions.
Mr. Faidley moved for adjournment, seconded by Mr. Schneider.
Councilman Asting moved for adjournment of the Special Council meeting,
seconded by Mr. Inman. The motion CARRIED 4-0.
The Joint City Council/Industrial Development Board meeting was adjourned at
8:14 p.m.
