06-02-1986 - Regular (J Q CITY COUNCIL OF EDGEWATER REGULAR MEETING JUNE 2, 1986 MINUTES CALL TO ORDER Mayor Baugh called the meeting to order at 7:00 P.M. in the Community Center. There was a salute to the Flag. APPROVAL OF MINUTES Regular Meeting of May 19, 1986 - Councilman Inman moved to approve the meeting of May 19, 1986. Councilman Prater seconded the motion. Motion CARRIED 3-1. Councilman Rotundo voted NO due to absence from that meeting. BILLS AND ACCOUNTS Councilman Rotundo moved to pay these bills. Councilman Prater seconded the motion. Motion CARRIED 4-0. Mayor Baugh noted there are supplemental bills from the Fire Department. City Clerk Martinez said there are two bills, one from Motorola for $184 and one from Communication Services for $15, and she read the letters of explanation for these supplemental bills. Councilman Inman moved to pay these supplementary bills and accounts. Councilman Prater seconded the motion. Motion CARRIED 4-0. MISCELLANEOUS C. E. Clark, 1818 Evergreen Drive, asked about paving of Evergreen Drive. He referred to the petition and prior conversations with Earl Copeland and with Mayor Baugh. City Clerk Martinez noted there are three little streets with a section on each to be done and they have to be incorporated in an assessment program to assess the property owners on each side with the City absorbing one third. She pointed out it's new construction and it's now City policy to assess the owners. Mr. Clark said there's no problem with the assessments but they want to get it done, and he asked if they need to submit another petition. City Clerk Martinez noted that streets for this year's program have already been established and budgeted dollars are what they included. Mayor Baugh said he thinks they should be included, because these people were told the paving of these short ends would be done and the City crews said it would be done. He requested a motion to amend the streets they have planned for the paving and add those three streets. City Clerk Martinez said she thinks it was Evergreen and Juniper or Kumquat. Councilman Rotundo suggested they wait until they see the names of the streets. Mayor Baugh said it will be on the next agenda. City Clerk Martinez pointed out the assessment program may have gone too far to include it in this group. Mr. Clark commented on the building of a shed with discrepancies as to size, how it was put up, and a flat roof. He said he'd talked to Dennis Fischer, Building Official, who advised him he'd told them it had to be tied down. Mayor Baugh said the Building Official will check on it. Frank Roe, 2732 Juniper, asked Council to do something about the older streets because Juniper, and he thinks it's Magnolia, are run down. He asked Council to consider paved streets that might need resurfacing. ~ o MISCELLANEOUS (Continued) John Gross, 621 Riverside or 404 Riverside, stated he'd filed the plans for a house and D.E.R. and Corps of Engineers have notified him there might be an infringement as far as the wetlands are concerned. He said he'd made arrangements with them that if there's a problem, it could be1mitigated by an exchange of land, and this was agreed to. He said he received a stop order and a notice from the City but that the City couldn't tell him where he had violated any of the laws up to the present time. Mayor Baugh pointed out the stop order shows the sections, and that there were no permits from state agencies to fill the land. Mr. Gross said there are additional paragraphs not properly indicated. City Clerk Martinez clarified there were two stop orders, one was State Statutes and the second was the City laws. Mr. Gross said they chased the carpenters away and he thinks the City is liable for that. Mayor Baugh asked the City Attorney for a comment on that. City Attorney Alvarez said the City Administrator has given a memo to Council and he has nothing to add to it at this time. Mayor Baugh asked if he obtained the permit to fill and Mr. Gross replied that he didn't need a permit. Mr. Gross gave the Mayor a letter from the Corps of Engineers and said he didn't violate that in any way. Councilman Rotundo asked if he was issued a building permit and Mayor Baugh replied yes. Mr. Gross said he got a permit to build the house and it was okay all the way through. Mayor Baugh said he'd like to hear from the Building Official because he issued a building permit to start with it. Councilman Prater suggested a workshop with the Building Official on this. City Attorney Alvarez stated that at this time the matter is at the adminis- trative level and information has been gathered, and he doesn't see how a judgement can be made of a legislative matter at this time. He suggested the administration conclude the process and it will come to Council for any Council action deemed necessary. Mayor Baugh questioned the length of time this would take and City Clerk Martinez replied it would be as soon as it's possible to gather the answers they need from the proper agencies. She said she will get back with Mr. Gross and do what needs to be done. Mr. Gross stated they don't have any jurisdiction in this matter. Mayor Baugh said they have to follow the City Attorney's advice, but he realizes Mr. Gross's problem with the permit being issued and he filled it in and then they put a stop work order on it. Mr. Gross said this may not get straightened out for six months or a year and there were no violations on the house where it stands. Mr. Gross added there were five applications filed for that property over a period of time and they said there were no applications on file. He read the various file numbers and said there were three attempts to modify the canal. Mayor Baugh pointed out the applications were when they were talking about changing the canal. Mr. Gross said the canal is involved and E.P.A. drew one up for him. He said they told the City not to depend on them but to work on their own, and he finally called the Police Chief to talk to his secretary as he called Mrs. Kinsey and five people and nobody would talk to them when the man from D.E.R. called. Mayor Baugh asked who the man was and Mr. Gross didn't recall his name. City Clerk Martinez clarified it's Mr. McDowell and that she was in a meeting when Mr. Gross called. Mr. Gross said he asked for seven people and nobody would talk to him and D.E.R. was telling them then that they're on their own. Mr. Gross added that he'd filed for a permit but now it's not being talked about on the 12th, and there are seven agencies involved and the house is not embroiled in this. He said there's no question about wetlands being involved, and he has the permit and is going ahead with it. Mr. Gross again explained that he got a call from the State and nobody would talk with him from the City. Mayor Baugh replied he didn't know why nobody would talk with them. Mr. Gross stated that all those people couldn't have been in a meeting, and asked what they have to do with other agencies. Mayor Baugh replied he doesn't know. Mr. Gross asked why they're bothering him, and said he'll go ahead with the house and the State agencies will take care of themselves as they're just trying to pull a phony. He added they're just referring to dredging and filling and none was done since March 6th. -2- Council Regular Meeting Minutes June 2, 1986 Q o MISCELLANEOUS (Continued) John Gross (Cont'd) - Mayor Baugh stated they'll contact the State agencies, Mrs. Kennedy and Mr. McDowell, and find out where they stand. Mr. Gross suggested they tell them they're being taped. Mayor Baugh advised Mr. Gross he'd get back with him with an answer. Mr. Gross asked what he's guilty of and Mayor Baugh noted there are three violations of the City ordinance listed and he has a copy. Mr. Gross said it doesn't mean anything to him. Mayor Baugh suggested he come in and get a copy of the Code book that pertains to it. Mr. Gross asked why he can't apply for a permit .forthe.porch. He said there were three surveys done by Dan Cory and they had some things there he didn't know existed. Mr. Gross then referred to the 150 feet instead of 220 feet. Mr. Gross said the City has nothing to do with the other agencies and the agencies told him that five times that the City is on their own. He added they aren't touching the environment, and they're leaving themselves open to a lawsuit. He said they gave him the laws and not the paragraphs, and there are 60 or 70 paragraphs. He asked the City Attorney where he infringed on Friday. City Attorney Alvarez replied that he'd made his comments for the record. Mr. Gross stated he's going ahead and they can arrest him but they should be sure they can prove what they say. He again referred to the columns and said he'll get a permit for the slab. He asked if there's a law to prevent him from getting it. Mayor Baugh suggested he talk with Dennis Fischer. Mr. Gross said the whole thing is silly and he'd made arrangements and both agencies went along with it and the only interference is the City. He asked where he stands if the City is on their own and Mayor Baugh replied he doesn't know. Mr. Gross said the only possible violation is the patio and he was waiting to see the type of columns he'd put on and he understood he'd come back and get another permit when it's decided. COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES City Council Reports - Councilman Rotundo stated he'd received calls from residents on Hubbell and Fernald regarding locations of fire hydrants in case of fire. He asked for assurance to these people that our Fire Depart- ment is capable of preventing a house burning without a water supply. Mayor Baugh suggested they check with Terry Wadsworth on the distance. Councilman Rotundo pointed out they can't put hydrants there because of 2" lines, and they'd need 6" lines. Mayor Baugh noted they have tankers. Mr. Patsy DiLeva, Fire Department officer in the audience, said there are two tankers and pumpers, and tankers will hold 1,000 gallons. Councilman Rotundo suggested we get word to the people that they're protected. Mayor Baugh suggested they talk to Terry Wadsworth to get something put in there. There was a discussion about the closest hydrant now. Councilman Inman stated he'd inquired about the progress of the parks and recreation areas and action hadn't been taken on the ground they purchased on Roberts Road. He said he'd seen a blueprint of the area but they haven't done any work. He said he understands that David Garrett has the responsi- bility of parks and recreation and also roads and grounds. He reviewed the responsibilities of the three employees, noting he was just informed an employee had resigned so he only has two. He asked Council to consider checking into the problem to see if hiring three more personnel for this department would alleviate the problem and get some of the land developed. He said he'd made a study on it and determined for the last half of June, and through September for the rest of this budget year; at 40 hours a week and at $5.00 an hour would total $11,430 which would include a 27% amount for fringe benefits. He moved to TABLE this until a full Council can have a chance to study this particular program and determine if it will alleviate the problem. Mayor Baugh noted that David Garrett's not in town, but when he gets back, he'll request a report and back up regarding the personnel request, and by that time they'll have a full Council to consider it. Councilman Rotundo seconded the motion. Motion CARRIED 4-0. -3- Council Regular Meeting Minutes June 2, 1986 Q o COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES (Continued) At this point, Mr. John Gross came forward and submitted to the Mayor a sheet of paper regarding his permits. City Attorney Reports - The City Attorney did not have a report at this time. City Clerk Reports - The City Clerk did not have a report at this time. Opening of Bids for banking services depository contracts - City Clerk Martinez requested these be referred in total to the administration and the City's auditors as there are many items in the bids and the proposals may be alternates and varied. Mayor Baugh asked if any Councilman had a problem with that and there were no objections. City Clerk Martinez noted they'll get the recommendations back to Council. She read the certification of bids as being received from: First Florida Bank, Southeast Bank, First Bankers, Florida National Bank, Sun Bank of Volusia County, Barnett Bank of Volusia County, and Southeast Bank. She opened the proposals, noting that First Bankers and Southeast Bank had bids that had been opened as they were not marked and sealed as required, and that Southeast Bank had submitted a second proposal in .the proper manner. Mayor Baugh requested a motion to turn these over to the auditors and the City Clerk to make a recommendation back to Council. Councilman Prater so moved. Councilman Rotundo seconded the motion. Motion CARRIED 4-0. Police Chief's request to adopt ordinance to control use of air guns - City Clerk Martinez read the May 28th memo from Chief Schumaker in which he requested establishment of an ordinance to control the discharge of air guns in the City, as the lack of this has created problems during the past months. Councilman Inman moved to turn this over to the Attorney for legal wording and amending this ordinance or drawing up on~ whichever is feasible. Councilman Prater seconded the motion. Councilman Prater questioned the parent's responsibility when it's a child involved. Chief Schumaker pointed out anyone under the age of 16 has to have an adult with them to have a B-B gun in their possession, but for those over 16, there's no ordinance to cover the malicious discharge unless they can prove malicious intent. He referred to citizens who discharge these at wildlife and the only way to address the problem is cruelty to animals and there's a complaint pending now. He noted there was a former ordinance that wasn't adopted into the present code, and he'd like one adopted for enforcement purposes. Councilman Prater said he'd like the legalities and law in the ordinance so people can understand it. Chief Schumaker said the problem isn't as much with the younger people as with the older ones who don't need adults with them, and sometimes the adults themselves. Motion CARRIED 4-0. Utilities Department - opening of bids for de-chlorination system - City Clerk Martinez certified that one bid was received from Chlorinator Services, Inc.. She opened the bid and read the total of $4,920.00, and recommended this be turned over to the City Engineer and Utilities Superintendent for review. Councilman Prater so moved. Councilman Rotundo seconded the motion. Motion CARRIED 4-0. Utilities Department - re: Interconnect with New Smyrna Beach - City Clerk Martinez noted there was a lot of time put into this agreement with attorneys and engineers and the Superintendent, and Mr. Wadsworth is recommending the Council execute the agreement as soon as possible to tie it in with the raw water tranmission main project, which will have a cost savings to the City. Councilman Inman moved to enter this Agreement with New Smyrna Beach Utilities. Councilman Prater seconded the motion. Motion CARRIED 4-0. City Clerk Martinez questioned if a resolution is needed and City Attorney Alvarez replied yes. Mayor Baugh requested a motion to have the City Attorney draw up the necessary resolution. Councilman Prater so moved. Councilman Inman seconded the motion. Motion CARRIED 4-0. Utilities Department - Change Order #2 to water supply well contract - City Clerk Martinez read the May 28th memo from Mr. Terry Wadsworth which requested Council authorization for this change order which would reduce the contract price from $74,145.00 to $70,499.50. Councilman Prater moved to grant him his request. Councilman Rotundo seconded the motion. Motion CARRIED 4-0. -4- Council Regular Meeting Minutes June 2, 1986 o o COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES (Continued) Building Official/Code Enforcement Officer's request for additional personnel in Planning Department - City Clerk Martinez stated there are two memos,one from the Planning Assistant to Dennis Fischer, who is her super- visor, regarding the work overload since her arrival, and from Dennis Fischer, who is requesting one administrative secretary in the Planning Department at a cost for the balance of the fiscal year of $5,000, which would include benefits and salary. She said she's recommending this and they're using the staff at City Hall now. Mayor Baugh asked what additional things she's taken on and City Clerk Martinez replied the Comprehensive Plan, plus she's attending meetings and seminars and handling Department Head projects and problems in the area of the Building Official's office, including researching, and COZ's which were previously handled by the Planning and Zoning Board. Councilman Inman moved that they TABLE this request due to the fact that he doesn't know where they'd put the young lady if they hire her. City Clerk Martinez said it would be in the Assistant Planner's office. Councilman Inman said it's pretty well crowded in that area and all of a sudden they're overworked and he'd like to check into it further and talk with Dennis Fischer about it, and he wants to table it until the next meeting. Councilman Rotundo seconded the motion. Motion CARRIED 4-0. Planning Assistant's request re: boats, docks and waterways - City Clerk Martinez read the May 27 memo from Lynne Plaskett regarding a provision be made for mooring of boats on City property. Councilman Inman moved to turn this over to the City Attorney for the proper wording and change the ordinance as such. Councilman Prater seconded the motion. Motion CARRIED 4-0. Parks and Recreation Board re: intended use of Jurgenson property - City Clerk Martinez read the May 15th memo from the Parks and Recreation Board. Councilman Prater asked how much land is there, and City Attorney Alvarez replied it's more than two acres. City Clerk Martinez noted the natural part of it and the mangroves is part of the beauty of it. Mayor Baugh said it's a park now and the Parks and Recreation Board should come to Council with a plan of what they want to do with it, and he doesn't understand why they asked Council about it. He suggested they send it back to to the Board. Tom Sheridan, Willow Oak Drive, Chairman of the Parks and Recreation Board, said the intention of the memo is to determine if a survey had been made and to determine the acreage to fit it into the overall program. He pointed out they requested the information in November and haven't received a reply. He added that it's impossible for the Board to make a determination or come to logical conclusions unless they get the information. Mayor Baugh said there's a survey on file and they'll get that to the Board. Parks and Recreation Board request for monthly status report from Parks and Recreation Department - Mr. Sheridan said they're requesting this information be forwarded on a monthly basis of the status of all programs and all construction related to parks and recreation. Mayor Baugh asked how often their Board meets and Mr. Sheridan replied every month. Mayor Baugh said it should be part of the agenda from the Director of Parks and Recreation. Mr. Sheridan stated they can't make decisions without information. City Clerk Martinez pointed out that part of the problem is why Councilman Inman made the request due to no staff. She questioned if they're requesting maintenance or new construction only and Mr. Sheridan replied it's the overall action of Parks and Recreation and the status of these jobs. Mayor Baugh said it should come out in the monthly meetings and he'll talk to him. City Clerk Martinez noted that the report covers maintenance and not new construction. Mayor Baugh said the Board wants anything to do with parks and recreation and he'll see they get the information. He added that a lot of it is maintenance. Mr. Sheridan said the Board didn't know there had been an application for a grant for Veterans' Memorial Park and they haven't received anything official. Mayor Baugh said he'll find out. A reporter from the News & Observer in the audience stated that her feature was from infor- mation she received from Ponce Authority and the County Council. -5- Council Regular Meeting Minutes June 2, 1986 Q u COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES (Continued) Merit Board recommendation for job description and pay grade for head life- guard and lifeguard - City Clerk Martinez read the May 20th memo from the Merit Board which recommended approval of the job descriptions with pay grades of 7 for the head lifeguard and 5 for lifeguard. She noted they need Council's authorization to adopt both these titles and pay grades. Councilman Rotundo moved to adopt this Merit Board request. Councilman Prater seconded the motion. Motion CARRIED 4-0. Councilman Rotundo asked Chief Schumaker to come forward to speak regarding the beach, and asked him what complaints they received over the week-end. Chief Schumaker said he'd received information that no lifeguard showed up for duty and it was established there was a switch of shifts and a mixup occurred. He added that there were numerous minor injuries because of children cutting their feet on clam shells, and there was a group of people wanting to swim the channel. Councilman Rotundo asked if there was drinking on the beach and Chief Schumaker replied that he doesn't know that for a fact. City Clerk Martinez said she'd heard that afternoon that when a squad car shows up, it's concealed, but they don't have a patrolman to place there all the time. Chief Schumaker pointed out it's a misdemeanor if it occurs, but the officer has to see it. Councilman Rotundo asked if there's a sign there and City Clerk Martinez replied yes. Councilman Rotundo said he'd had calls about abuse, of drinking and swimmers going out and not listening to the lifeguards. Council~an Prater noted it's hard to control swimmers without markers. City Clerk Martinez pointed out the Marine Patrol made them pull them in. Chief Schumaker noted that the Department answered over 1,000 calls in the month of May. Councilman Prater noted that some parks have to close their gates because of overcrowding. Mayor Baugh asked that they keep an eye on it and address the problems as they come up. Chief Schumaker pointed out they have telephone hookup between the Police station and the park in case of emergency and they have two-way radios on their frequency so anybody in the building would respond to a life and death situation. Mayor Baugh asked Chief Schumaker to meet with David Garrett and the lifeguards to discuss the problems from the Police standpoint and the lifeguards and they can perhaps present a solution for Council. Chief Schumaker noted they're experienced life- guards, and it's impossible to have an on-scene Police officer. Mayor Baugh pointed out if they make some arrests, word will get out they're enforcing it. COMMUNICATIONS United Systems Transportation's request for one parking space at city lot on Mango Tree Drive - City Clerk Martinez read the May 8th letter. Mr. David Hope, Travelers Palm, spoke as the Transportation Coordinator. Councilman Rotundo questioned if the gate is closed at a certain time and City Clerk Martinez replied yes. Mayor Baugh noted that it's locked at 3:30 every afternoon. Mr. Hope asked if he could get a key, and said they also use the County's garage in Deland. Councilman Rotundo asked if it's a County organization and Mr. Hope replied it's with the United Way. Mr. Hope added that they're insured. Councilman Prater asked if he'd talked to Earl Copeland and Mr. Hope replied no. Councilman Inman stated he wouldn't want the City to be held responsible if permission is given and there would be an accident or vandalism. Mr. Hope said they have insurance to cover the vehicles so that wouldn't be a problem. Mayor Baugh asked why they want to park there and Mr. Hope said they take people from Edgewater to doctor's appointments and shopping and they could provide a better service if they're in close proximity. Mayor Baugh asked where they park now and Mr. Hope replied it's in Daytona Beach at Votran and in Deland at the County garage. Councilman Rotundo asked City Attorney Alvarez if they should have something written. City Attorney Alvarez suggested the administration look into a City policy on the matter as a similar request has been made in the past, and they'd need a written document if this is approved by the Council and the liability carrier. Mayor Baugh asked Mr. Hope to work with City Clerk Martinez to work out whatever's necessary to see if it's feasible and then bring it back to Council with a determination. -6- Council Regular Meeting Minutes June 2, 1986 o ~ COMMUNICATIONS (Continued) Ponderosa Homes, Inc. 's request to put Live Oak and Yelkca Terrace Court on paving priority list - City Clerk Martinez stated this is from Perry Barrett, who is working on an office building on Live Oak and apartment complex on Live Oak and Yelkca. She added that they're unsurfaced roads and it would be new construction. Mayor Baugh asked if they want them on the list. Councilman Rotundo said he'll have to file a conflict of interest because he owns property there. Mayor Baugh said it's just to be put on the list if there's no objection and no vote is involved. No Council member expressed an objection to placing these streets on the paving list. Volusia County Public Employees Association and Coastal Florida Police Benevo- lent Association's request to begin negotiations for P.E.A.(General),P.E.A. (Supervisors), and P.B.A. - City Clerk Martinez stated the Associations are requesting negotiations begin but Council needs to appoint a negotiator or negotiating team for FY-87 so that meetings can begin. Mayor Baugh suggested the same team as last year. Councilman Prater moved to go ahead with the ones from last year. Mayor Baugh asked Councilman Inman if he would serve again and Councilman Inman replied that it's election year and he'd hope they can get it solved. City Clerk Martinez pointed out the City Attorney was named, when needed. Councilman Rotundo made that a motion. Councilman Prater seconded the motion. Motion CARRIED 4-0. ORDINANCES AND RESOLUTIONS Ord. 86-0-12 Amending B-2 business district to allow auction services, recreational businesses and churches - Mayor Baugh stated this is first reading. City Attorney Alvarez read this Ordinance. ORD. 86-0-12 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING APPENDIX A, ZONING, SECTIONS 606.01 (b) AND 606.01 (d), B-2 NEIGHBORHOOD BUSINESS DISTRICT, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY ALLOWING AUCTION SERVICE WITH CERTAIN EXCLUSIONS; BY ALLOWING RECREATIONAL BUSINESS AS A PER- MITTED USE AND BY ALLOWING CHURCHES FROM INDIAN RIVER BOULEVARD TO 30TH STREET AS A SPECIAL EXCEPTION IN B-2; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. Councilman Prater moved to adopt Ordinance 86-0-12. Councilman Rotundo seconded the motion. Mayor Baugh asked if it's spelled out as to what can be auctioned and City Attorney Alvarez replied yes. Ord. 86-0-13 Amending Sect. 700.01, off-street parking requirements, to clarify 10 ft. buffer requirements in B-2, B-3, and B-4 business districts -City Attorney Alvarez read this Ordinance. ORD. 86-0-13 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING ARTICLE VII, SUPPLEMENTARY REGULATIONS, SECTION 700.01 (a) REQUIRED OFF STREET PARKING, BY EXCLUDING FROM SECTION 700.01 (a) THE MINIMUM FIVE (5) FOOT BUFFER REQUIREMENTS IN DISTRICTS B-2, B-3 AND B-4, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. Ord. 86-0-14 Establishing parking regulations, prohibitions, and procedures for violations - City Attorney Alvarez read this Ordinance. ORD. 86-0-14 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 17, ARTICLE III, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY CHANGING THE TITLE FROM HANDICAPPED PARKING TO PARKING; BY RELOCATING AND RENUMBERING SECTIONS 17.13 AND 17.14 AND BY RESERVING THEM; BY RESERVING SECTIONS 17.15 THROUGH 17.19; BY CREATING A NEW SECTION 17.20 ENTITLED PARKING; BY PROVIDING DEFINITIONS, REGULATIONS, PROHIBITED PARKING OR STANDING OF MOTOR VEHICLES WITHIN SPECIFIED LOCATIONS WITHIN THE CITY LIMITS AND PUBLIC RIGHT-OF-WAYS; PROVIDING FOR THE ISSUANCE OF PARKING TICKETS, PENALTIES AND ESTABLISHING PROCEDURE FOR THE PAYMENTS OR HEARINGS THEREOF; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Baugh stated this is first reading. Councilman Prater moved to adopt Ordinance 86-0-14. Councilman Inman seconded the motion. GARVEY TO THE MERIT BOARD OF THE CITY OF EDGEWATER; PROVIDING FOR A TERM OF OFFICE; PROVIDING FOR DUTIES AND RESPONSIBILITIES; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
