The Regular Meeting of the City Council of the City of Edgewater, Florida, held February 17th, 1958 was called to order by Mayor George 0. Sedgwick at 7:30 P.M. ROLL CALL Mayor George 0. Norman Present Trash Collector John Wood Present The Minutes of the Regular Meeting held February 3rd and the continuation on February 13th were presented to each Councilman for their approval. Motion by Councilman Broga these minutes stand approved as submitted, seconded by Councilman Henry and by vote CARRIED. Chisholm 20.00 Lloyd Cox Co. 29.05 Jess Mathas 1.00 Standard Oil Co. 7.75 Motion by Councilman Shaeffer these bills be paid and be made a part of the minutes, seconded by Councilman Farrell and by vote CARRIED. 0IF10ERS REPORT The Clerk read the Clerk's Cash Statement and the Budget Report for the month of January, 1958. Also the Librarian's Report for January. COMMUNICATIONS Letters were read from the following:- Persons holding Beverage Licenses in the City, One from Housing & Home Finance Regional Office of Atlanta to Chapman & Cutler, Bond Attorney's, Chicago, °ne from John H. Moynahan, One from the Zoning & Planning Board, One from Edgewater Civic Association and one from Governor LeRoy Collins. ORDINANCES AN ORDINANCE ADOPTING THE SOUTHERN STANDARD PLUMBING CODE AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF. The above Ordinance was read in full by Councilman Shaeffer and motion duly made by Councilman Shaeffer this ordinance be adopted, seconded by Councilman Broga and passed by the vote of the City Council of the City of Edgewater, Florida at a regular meeting held on the 17th day of February, A. D. 1958. Roll call vote being as follows:- I Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea Upon motion duly made by Councilman Broga, seconded by Councilman Farrell and carried, the requirement of reading said ordinance upon second reading was waived and the Ordinance was ordered put upon final passage. Passed by the vote of the City Council of the City of Edgewater, Florida at a regular meeting of said Council held on the 17th day of February, A. D. 1955, and approved as provided by law, the vote of said Council being as follows:- Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea Two Deeds were prepared by Attorney Chisholm for a 9 Ft. strip of land formally Garage Drive deeding this property to John Clutterbuck and Wife and Grace D. Costigan, life estate and Lorna Whitman. Motion by Councilman Shaeffer these deeds be executed by the Mayor and City Clerk and delivered. Seconded by Councilman Farrell and by vote CARRIED. Letter from John H. Moynahan asking the City to execute an agreement with the Florida East Coast Ry. for a crossing at 26th Street in Florida Shores. Magnuson Properties to stand all expenses of this crossing. Motion by Councilman Shaeffer this agreement be executed by the Mayor and City Clerk, seconded by Councilman Farrell and by vote CARRIED. Roll call vote being as 0 follows:- Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea Attorney William Gillespie, Jr. representing Mr. Bernie Napier ask about the construction of W. Palmway Street, stating the present street as repaired by the Hubbard Construction Company was higher kthan his clients property and drainage from the road overflowed unto his property. Mr. Gillespie was advised that when the construction company got into their maintenance work the street would be taken care of. Letter from the sellers of Alcoholic Beverages. Mayor Sedgwick ask who was the spokesman for this group. He was advised Mr. Frazier was their spokesman. Mr. Frazier was not present, but came in a little later and was given the floor. Mr. Frazier stated he wanted the five questions in the letter answered. He asked Councilman Broga just what he had done when he was appointed to investi- gate this. Councilman Broga stated he was appointed to investigate on the advisability of Sunday Sale of Beer & Wine only and had reported back to the Council against it, unless a referendum was called and did not think it advisable to call a referendum and incur this expense to the City. He stated he had not contacted anyone and no one had contacted him in regard to Sunday Sales, but when he was campaigning for the office of Councilman the majority of residents in District #1 were not in favor of Sunday Sales. Councilman Henry stated he held a beer license and would remain neutral and would refuse to vote if it came before the Council. He also stated he had not contacted any one and no one had contacted him in this matter. Mr. Frazier also wanted to know if any outside pressure had been put on these Councilmen. They both answered in the negative. Councilman Henry ask Mr. Frazier if they had ask for volunteers at the Business Ments Association to contact citizens in regard to this matter. Mr. Frazier answered yes. He was then ask how many had volunteered, and answered none. Councilman Shaeffer ask Mr. Frazier if the holders of Beer Licenses would stand the expense of a referendum, and he stated he could not answer that until he contacted them, but he was willing. He was advised to contact them and see if they would stand the expense of a referendum. Governor Collins letter in regard to the drain ditch on U. S. #1 in the south part of the City. Mayor Sedgwick stated this was the final word, but several citizens present objected and ask that the City stand the expense of filling this ditch. Councilman Shaeffer stated this was a State and Federal Highway and the City had no right to fill any land be- long to the State. Letter from the Civic Association. Mayor Sedgwick also stated that the State Road Department had refused to replace a traffic light at Ridgewood Ave. and Park Ave. and it would be impossible to get a hand signal for Ocean Ave. at the present time. Mrs. Biggs from Otter Drive ask what was going to be done about that Street. Councilman Shaeffer told her to take it up with Mr. Cole as it was not a dedicated street and he would have to put the street in. She said she had talked to him and he had promised to do it, but had not attempted to do any- thing. Also a ditch had been opened up across this street. Mr. Shaeffer stated it was up to the City to put in a culvert on this street as the Mosquito Control dug this ditch, but Mr. Cole would have to shell it. Mr. Ganta on New Hampshire Ave. asked that some shell be put along the paving to keep it from breaking down where the mailman drives off the pavement to put mail in the boxes. Mr. Shaeffer advised him that it would be taken care of when they were puting black top along some of the streets. At present he was short of help and could not do anything in this cold weather. There being no further business Councilman Farrell moved we do now adjourn, seconded by Councilman Henry and by vote CARRIED. Time 9:05 P.M.
