CITY COUNCIL OF EDGEWATER
SPECIAL MEETING AND WORKSHOP
FEBRUARY 27, 1986, 2:30 P.M.
MINUTES
Mayor Baugh called the meeting to order at 2:32 P.M. in the Community Center.
He stated the purpose of the meeting was to meet with the Planning and
Zoning Board for review, recommendation, and possible authorization for
necessary people to sign the mylar of Pelican Cove West.

Also present were Mr. Gerard Ferrara, City Engineer, and Mr. Luis Geil, repre-
senting Pelican Cove West.
Mayor Baugh stated that he didn't feel they need to go into a Workshop session
for this item and no Council member objected. He asked for comments from the
Planning and Zoning Board members.
Mr. Wheeler asked about Phase III and Mayor Baugh explained this is just for
Phase II. Mr. Mackie asked how many phases there will be and Mayor Baugh said
he thought it was just two phases. Mr. Mackie said there were two phases and
the one they had trouble with. Mayor Baugh clarified it was Pelican Cove East
and then two phases in Pelican Cove West and Phase I is built and Phase II is
proposed now. Mr. Mackie asked if it's the west side of the highway and Mayor
Baugh replied yes.
Mr. Mackie stated they never saw the prints and he suggested they go to Planning
and Zoning to be checked out. Mayor Baugh pointed out it's the same print that
was approved 3 or 4 years ago. Mr. Mackie said he'd never seen it. Mayor Baugh
said it was approved by a past Council and City Attorney Alvarez added that it
was in November of 1982.
Mr. Ferrara stated that the project was about three-quarters constructed when he
became involved in it and he'd contacted the owners and asked for an updated plan.
He added that he'd asked for changes for stormwater locations and manholes and he
got a new print which he's reviewed and checked it in the field and found that
the problems were corrected regarding drainage, etc. Mayor Baugh asked if he's
satisfied with the corrections and Mr. Ferrara replied yes. Mr. Ferrara stated
that he came specifically to look at it and signed it off, and they'll be looking
at it for one year and will have to make any corrections before the City will
take it over.
Mayor Baugh noted that the City Attorney has the plans that were approved.
City Attorney Alvarez said he saw the plans 4 years ago and City Clerk Martinez
said it's a copy of the same plat. City Attorney Alvarez pointed out it was
signed by the former Planning and Zoning Board. There was a general review of
the plan and discussion of some of the items.
Mayor Baugh again asked if it was cleared by the engineer and Mr. Ferrara
replied yes. Councilman Rotundo asked if Planning and Zoning has seen it and
Mayor Baugh pointed out the former Planning and Zoning Board voted on it.
Councilman Rotundo noted that they're having problems in that subdivision and
he's putting homes wherever he wants. Councilman Asting clarified that was
not in Phase II, which is all they're talking about. Councilman Rotundo stated
that Planning and Zoning should have it before Council votes on it. There was
further review and discussion of the plans.
Mayor Baugh stated that Council will be able to watch this now and the engineers
will monitor it, and if something is done wrong, they can stop him.

Mayor Baugh asked Mr. Wheeler if he had any problems with it and Mr. Wheeler
asked what he can build on such small footage. Mr. Ferrara replied that it's
the zero lot line concept with two units taking two lots and one touching the
other. He added that the wall between is a fire wall. City Attorney Alvarez
stated that was what was approved and what has to be built. Mr. Wheeler asked
if it's two lots with twinplexes and Mr. Ferrara replied yes, with zero lot lines.
Councilman Prater stated that some day the zero lot lines will cause Edgewater
problems. Mr. Ferrara said this was approved this way and they don't have to
sign it if they don't approve this concept.
There was a brief discussion about the homeowners' association taking care of
their own maintenance.
Mr. Geil pointed out that technically these are attached single families.
Councilman Rotundo stated that they have to meet the side and rear setbacks
and Mr. Geil agreed. Councilman Asting noted that the engineer has no
objections to information shown on the mylar. Mr. Ferrara agreed.
Mayor Baugh requested a motion to authorize him to sign it on behalf of the
City and for Planning and Zoning authorization. Mr. Wheeler asked if that
takes it out of Planning and Zoning and Mayor Baugh replied no. Mr. Mackie
stated that the mylar is only to verify they can go ahead with it. Mayor
Baugh noted that anything that is done incorrectly goes back to Planning and
Zoning. City Attorney Alvarez said they have to go by this. Councilman Asting
pointed out that the Building Official will watch the construction. Mr.
Mackie again said he'd seen nothing about this property. Mayor Baugh said the
City Clerk will forward the engineer's letter to Planning and Zoning.
Councilman Asting asked if Mr. Wheeler has an objection to signing the mylar
and Mr. Wheeler replied he doesn't if the City Attorney okays it. Mayor Baugh
asked if the City Attorney has any problems with this and City Attorney Alvarez
replied that the entire project was presented to Planning and Zoning in November
of 1982 and it was approved and it should be built as to the agreement made with
Belmont Homes. He referred to the problem with the R-4 density according to
Attorney Clay Henderson and that 80% of the lots were given variances.
Chief Schumaker arrived at the meeting at this time, 2:54 P.M.
Mr. Wheeler said he doesn't like the way the plan is drawn up but he'll sign it.
Mayor Baugh requested a motion from Planning and Zoning to authorize Mr. Wheeler
to sign this mylar. Mr. Mackie moved that this mylar is signed by the Chairman
of the Planning and Zoning Board. Mr. Finn seconded the motion. Motion CARRIED 5-0.
Mayor Baugh requested a motion to authorize him to sign it. Councilman Asting
so moved. Councilman Prater seconded the motion. Motion CARRIED 5-0.
Mayor Baugh requested a motion to adjourn. Councilman Prater moved to adjourn
this meeting. Councilman Asting seconded the motion. Meeting was adjourned at
2:57 P.M.
