10-02-1986 - Public Hearing " '. . ~ , ~ o . Q CITY COUNCIL OF EDGEWATER PUBLIC HEARING OCTOBER 2, 1986 MINUTES Mayor Baugh called the Public Hearing to order at 7:00 P.M. in the Community Center. He stated the Public Hearing was called for the proposed Compre- hensive Plan Amendment. ROLL CALL Mayor Earl Baugh Councilman Louis Rotundo Councilman Russell Prater Councilman Neil Asting Councilman James Inman City Attorney Jose'Alvarez City Clerk Connie Martinez Chief Lawrence Schumaker Present Excused Present Present Present Present Excused Present Mayor Baugh stated they called this meeting due to changes in the Statutes regarding the Comprehensive Plan. Mrs. Lynne Plaskett, Planning Assistant, advised that they have to comply with statutory requirements to update the Comprehensive Plan to include annexed properties in the City since 1981. She said the properties include the Radnor Corporation, the Fong property, the 14 acres used for parks and recreation off Roberts Road, Edgewater Acres, and so on. She noted they updated the population, number and location of parks, number of wells in conjunction with water, dates of ongoing policies, all maps for land use, soils, existing and future parks, etc. She continued that on August 21st the Planning Board moved to accept the updated Comprehensive Plan with a vote of 5-0 and they held the local planning agency meetings, public hearings, advertisements, and sent the updated plan to the Department of Community Affairs. She said from the time Planning and Zoning approved it and the time Council gave the permission to send the plan to the State, the law changed for procedures, so this is an extra precautionary measure they're taking even though everything has been done. She added that the public hearing is to entertain comments from the public. Attorney Glenn Storch, Owens and Storch law firm, said this is to comply with new statutory requirements, and there were new regulations to hold public hearings. He noted they've changed the Comprehensive Plan law three times in the last three years and it's a complicated law. Mayor Baugh stated the Public Hearing is on the changes that were made and then it has to be sent back to them and Attorney Storch agreed. Mayor Baugh then asked for public input. Bill Klein, 2910 Needle Palm, stated he wanted to point out inconsistencies that exist in things that happened with the Council. He read from the minutes of the July 21st City Council meeting. He said the Fong rezoning recommendation was tabled by Council and then Councilman Asting moved to rezone it B-3 and the remainder be R-l instead of R-2, which cut down on number of occupancies. Mr. Klein said on Caldwell, Councilman Asting moved that the property be zoned R-l to be compatible to property just to the north of it after Planning and Zoning had recommended it be R-2. He added this also brought down the number of units to be built. He said later in that meeting after comments from Silver Ridge residents, Councilman Asting suggested they consider the impact of the development on water and sewer, garbage, trash, police and fire pro- tection, and schools. He added that Attorney Watts asked for several things and Mayor Baugh told him he didn't know if it couldcbe handled then and he recommended tabling it until they get more information. He further read minutes pertaining to Radnor's annexation and said he asked to be recognized to see if they were going to do a study on the impact on services by this development. He added that Councilman Prater expressed his concern for the number of people in Florida Shores who need sewers. -, () u Public Hearing on Comprehensive Plan Amendment (Continued)- Bill Klein (Continued) - Mr. Klein stated this was on one agenda and it was moved up on the agenda so the public could speak and then the public left because they didn't understand, and Council had already prepared for. that meeting Ord.86-0-20,< which was the first reading for annexing it. He asked if they predetermined that it would be approved. He said on Ordinance 86-0-22 City Attorney Alvarez said it will not take effect until the amendment to the Compre- hensive Plan is complete. He said the ordinances came up after the public left, because they thought they were through. Mr. Klein read from the engineering report that was submitted on the sewer study, including population growth, number of homes being built each year, and anticipated flow through 2009. He read from the financial pages and noted that the City is in an excellent financial situation and interest rates are low. He pointed out any developments south of the present subdivision will have to pump wastewater past Florida Shores and with the Radnor Corp- oration, it would require major renovation. He pointed out there's been a moratorium in the County for the last two years and it was extended through December 31st. He said the river is one of the most important assets and most of the environmental meetings were held in this Community Center, and he asked Council members if they were at any of these meetings. Mr. Klein said he was told they'd get impact fees from 400 or 500 units from Radnor, but there will be fees from 365 homes in Florida Shores. He said if they add 400 to 500 units, they'll take away some of the capacity from the people who have been living here for years, and have been paying taxes. Mr. Klein read from a portion of Ordinance 86-0-20 and said the whereas clauses were a lie because the Planning and Zoning Board voted 3 to 1 on this annex- ation and it did not pass. Mr. Klein said at the budget hearings they were told the City would pave roads and there was $100,000 for the study on the sewer system and more Police protection. He said the people living here for years are due more than that for their tax money than people coming in right now. He asked what fee is set for connection. There was a lengthy discussion about the amounts set for connection, impact fee, and hook up. Mr. Klein asked Council to deny this addition to the Comprehensive Plan and repeal or void Ordinance 86-0-20 because it doesn't contain the truth. Mrs. Plaskett read the recommendation made on the rezoning of Radnor and stated that it wasn't a recommendation to approve or deny because the motion failed. She said she didn't know how the ordinance was written because she didn't type it, but it could be a typographical error. She said that Planning and Zoning did not stipulate that it was approved by the Board. She pointed out that the land use map adopted in 1981 showed the type of density wanted in the various areas, and the City has since down zoned Fong and Radnor. She reviewed the number of units permitted in those areas prior to down zoning, noting MH zoning is lowest_density, and County planners said it is the smallest impact on the river. She said when the water and sewer for Caldwell was requested, the report wasn't completed and Caldwell wanted over seven units per acre. She reviewed the costs for Radnor units for water and sewer and said the fees have nothing to do with the development cost of sending the lines to the development or upgrading the system. She added that it's over one million dollars in impact fees and that could be used up front to get started with the Florida Shores project. She said the $650 is an assessment, and not an impact fee, but to run the line. She added that if they had the seven million dollars to sewer Florida Shores, it would still take five years to have it to everyone in Florida Shores. She said they want to do it in the five phase system so the money can help each phase along as it comes in. She noted the new development is willing to pay the costs up front, and when Florida Shores was built, there were no requirements for improvements. She said Radnor people will pay taxes the same as regular homes. She said they would need one more policeman and four more were authorized for 1987. She added that it will be a retirement community with no burden on the school system. She pointed out at the Planning meeting when they voted to forward it to D.C.A. that Bill Klein voted for it. -2- Council Public Hearing Minutes October 2, 1986 ~: ..... o o Public Hearing on Comprehensive Plan Amendment (Continued) - Mr. Klein stated they're talking about an impact fee of $1,000 per home and are charging people building in Florida Shores the same assessment. Mrs. Plaskett advised him that's not true, and she pointed out Radnor has to pay the fees up front and people in Florida Shores have ten years to pay it. Mr. Klein referred to how many years they've been paying taxes. Mayor Baugh noted they've been working on this project for almost a year and Mr. Klein said he didn't know that and all of a sudden it came up and Councilman Asting was there. He said when the vote went 3 to 1 the attorney afterward asked who the gentleman was sitting there as he has to talk with him. He said he wanted to know why. ~ Mayor Baugh stated they're doing something about the sewer system in Florida Shores, but it will take time, and it has to be expanded regardless. Mr. Klein noted the third phase will have to have the expansion of the plant. Mayor Baugh again said it has to be expanded, regardless of when. Mr. Klein said it will have to be expanded earlier and will cost more money. Mayor Baugh disagreed, noting they'll have the money up front to expand while interest rates are low. Councilman Asting stated the impact fees collected from Radnor if it comes into the City will generate one half million dollars toward the sewer system and that's money which Florida Shores won't have to pay. Mr. Klein stated that everyone in Edgewater will have to pay for it. There was further discussion about the amount to be collected. Kenneth Dore, Florida Shores, asked how much larger the wastewater plant has to be for Radnor and Mayor Baugh replied none. Mr. Dore questioned the water supply. Councilman Asting said it will take care of 20,000 population. Mayor Baugh noted with the four new wells put in on 442, it will handle 20,000 people. Mr. Dore asked what Radnor pays and Mayor Baugh replied it's $562,000. Mayor Baugh pointed out this is just a public hearing and they can't take any action. Councilman Asting advised the public that the sewer plant is running at 50% capacity and they have about 2,000 available sewer connections before they go to an expansion program, and as of about six weeks ago there was a count of 750 homes in Florida Shores. Mr. Dore stated they built those in two years. Mr. Klein pointed out that according to the survey there are 2,500. Councilman Asting stated that's an estimate. Mayor Baugh requested a motion to adjourn the Public Hearing. Councilman Rotundo so moved. Councilman Inman seconded the motion. Public Hearing was adjourned at 7:43 P.M.
